Relocation cases are some of the most difficult cases that judges have to decide in a child custody case.*

Judges have told me in these type of cases there is a clear winner and a clear loser. If the judge rules that the child can relocate with a parent then that parent 'wins' and the other parent loses and vice versa.
The burden of proof is on the person seeking to have the children relocate with them. That means that they have to prove to the judge that relocating the child is in the child's best interest. Depending on where you live there is a list of factors, on top of the normal 'Child's Best Interest Factors' that the judge needs to look at to decide whether relocation is in the child's best interest.
So where ever you live, you need to do relocation research and find out what the relocation laws are in your state. You need to know each and every factor the judge is going to look at because you have to adjust each and every one of them.
In your relocation hearing , If a parent wants to relocate then the judge is going to want to know whether there is still going to be the opportunity for the parent who's left behind to have a substantial and continuing relationship with the children, especially if the parent who is being left behind has had a lot of involvement and bonding relationship with the kids.
The fact is, if you are moving your child out of state, the child will be thousands if not more miles away then that relationship, once the child moves, will never be the same. That parent will no longer have the ongoing or weekly visitation that they had before. The parent for example won't be able to attend parent/teacher conferences, be involved in their child's extra-curricular activities. It is really going to affect the level of that parent's participation in their child's lives.
If you're the parent seeking to relocate with the children you are going to have to show the judge how that quality of relationship that the other parent shares with the children can continue. I will say that in a lot of my relocation cases where I am representing the parent that is wanting to move with the children, I encourage them to tell the other parent that they can have every single break, that they can have all or most of the summer...all the times that the children are not in school, they can have.
In a lot of cases, that does increase the chances for the parent that wants to relocate, however in some cases, it has not made a difference. The reason is because the parent who wants to move has not proven to the judge's satisfaction that moving is in the best interest of the child.
If you are the parent wanting to relocate it is not impossible. I've had a lot of judges grant the relocation in spit of the other parent's objections. You just have to really do your research in your state for the factors the judge is going to be looking at. Get your evidence ready and your ducks in a row and be ready to present it.
If you are the parent who is opposing the relocation of your child, same advice for you. Look at the relocation factors in your state or jurisdiction. You will need to spin those in a way that the judge will have no choice but to find that relocation is not in the best interest of the children.

I owe you the BIGGEST THANK YOU!!! I watched your videos and filed a motion to relocate. I want to move to Puget Sound in Washington in order to live the lifestyle I want to give my 2 girls. I am an avid skier and outdoor enthusiast and lived out west but had to move back to Minnesota when my youngest daughter was born. I took on this challenge with the knowledge learned in your videos, without an attorney and won. I am planning my move now, and will be making 50% more pay, live in a nicer house, be able to take my kids camping and skiing in the mountains, kayak down beautiful rivers, go paddleboarding and boating on the Sound, wander along beaches, and teach them to be environmentally sustainable and responsible individuals. My kind of life.... THANK YOU. In my divorce, hearing I was terrified. My husband had representation. I did not. I sat speaking with a trembling voice and had no idea how to argue in an effective manner, or how to argue my case in front of my referee, who was biased and not in my favor. I requested a new referee. I never went through with the request, but when I spoke to the court assistant, she couldn't give me legal advice prior to filing, but she went ahead and assigned me a new female judge. I don't know if she saw my request, or if the other judge quit, but I find that hard to believe. Anyhow, I won and I owe it to you. 😊💙💛💜🧡

Hi im moving in nov because i can no longer afford to live in nj i have no familly support here in nj all my familly is in nc i was offered an opportunity to give my daughters a better life better cost of living better education familly help something that there dad non custodian dad cannot do. I have spoken to my daughters father about the move nd he was ok with it as long as hes able to see his daughters i aggreed to what hes asking for i have no intentions of stoping him from seeing his girls i offerred summer vacations holidays weekly communications access to their school too see how they are doing but then the next day he took me to court to stop me from moving. Now i have a court date nd dont know what to do i cant even afford to hire a lawyer im scared im going to loose my girls because hes been threatning me to take them from me only because i have moved on with my life

What if the other parent moved away 5 years ago. Only payed child support and nothing else (not even court ordered 40% daycare costs). Then moved back. We are going through a custody case and I had already made plans to move when the youngest child is in kindergarten. He doesn't want me to move and says I am just trying to flee. The kids have no bond with the dad and he is refusing to split supervised visit cost before the judge makes his ruling.

I enjoy your videos cuz it's helping me out but when it comes to relocation no matter if the person staying is bad or good if they have a parenting plan child custody order the way I see it and the way any judge should see it is If the parents have come to a agreement of child custody agreement and one of them wants to move by all means let them move that is their choice they want to move so let them move but they have got to leave the kids behind for the parent that is staying and doing everything right in the custody agreement there shouldn't be no battle if they want to move let them move but they're going to leave their kids when they do they made a promise and they signed the promise and an agreement so they should honor it if the other parent is

What about relocation with no court order? And never married... I relocated and told the father and then I sought child support (after 9 years of financially supporting the child on my own) he went to file for custody and child support as soon as child support papers were sent to him
