@luis velez Exactly I know people who work in nursing in CNA nursing That got into an argument at home With their significant other and went To jail for domestic fighting. Because they was charge with a domestic abuse charge they automatically lost their license to work in a nursing home hospital any longer.. So how is it a cop can Assault and brutalized citizens wrongfully and be allowed to go to another city thinking he won't do the same thing there.

Something like that is necessary, but it should probably be a bit more nuanced. There are too many cases where the entire police body is corrupt and the few incorruptible officers get fired. It's not a good idea to make it even harder for them.

I’m a cop. This was totally an unjustified useof force. From the video I saw, she never tried to hit any of the officers. She pulled away, which is considered obstruction. Our use of force policy says we can’t use hand strikes unless they are assaultive. Fire him. I’m sorry she had to go through this. There are bad cops out there, but please don’t think we are all like this.

@@willienewman5898 my department does. If a business wants someone trespassed, we get there and tell them they need to leave first. If they refuse, then we can ID them and issue trespass warning.

Are you blind? You screwed up racist. had this been a white karen you'd say she was scared or upset. She got pissed because the officer reversed the situation against her. No only did she break no laws, but stated she was leaving when she got her money back and olny stopped so the officers would have to chase her down. Right then and there they should have let her keep it moving and been don, but instead they created a situation and messed up.

The problem we have is our people always trying to cut these evil race soldiers a break on the evil things they do! There are no good cops they sit by quite while the evil ones do what they do so that alone makes them a party to a crime if it we me and a friend and he beat a women and we both jump into a car and pull off we both will be charged the same should go for them and we have to put an end to us footing the bill for these race soldiers evil wrong doing!

What scares me is the cops body camera didn’t catch the punches. I feel like they’ve learned how to around the cameras. This beautiful soul is traumatized and I hope she gets justice.

Her ACTIONS were not "DEADLY FORCE" !!!! Her actions were basically her constitutional right. You are dealing with a case of "TRESSPASSMENT"! There is no need to IDENTIFY for mere Tresspassing(Civil)...Sherlock ! If she would have returned after being lawfully Tresspassed then it would rise to criminal. And even then "Deadly Force" is inappropriate and criminal.

She threw a whole temper tantrum, BUT so did he. They didn’t remake her sandwich so she pitched a fit. She didn’t do what he said so he punched her in the face. They were both wrong and went too far. Both need to be held accountable.

So? Drunk drivers cuss the police out for stopping them, they say terrible things about the officers families, they fight being handcuffed, physically try to get into a fight with police, police even get called racial slurs and person tries to run away but they don't get punched in the face for it. Police are only supposed to use as much force as necessary. There were two of them, there was no reason for using excessive force. If that was someone you cared about, you'd feel different. I'm betting you're one of those people that starts screaming about your rights as soon as you see an officer.

I've looked at the bodycam footage. The only person who was being unreasonable in that parking lot was the woman. She was originally detained because McDonalds called the police on her. McDonalds is claiming that her behavior in their restaurant was unacceptable. Her biggest mistake was that she kept arguing her position even after it was established that McDonalds had given her a refund in full. She got her money back so there was nothing else that the cops could do for her. As her anger started to build she kept aggressively arguing her position when she had already been given her money back. Her complaints after receiving a full refund were completely ridiculous. She was demonstrating her rudeness and verbal combativeness on video. Which merely confirmed McDonalds original complaint against her. All businesses reserve the right to refuse service to anyone. From the beginning she should have taken her refund, gone home, and complained to McDonalds corporate offices. She could have lodged a complaint with McDonalds corporate in regards to how she believed she was given horrible service. Odd's are McDonalds corporate would have given her a coupon for a free meal in an effort to smooth out the situation and not lose her overall patronage. That is what the corporate complaint department usually does when a disgruntled customer goes so far as to call corporate to put their grievance on record. She kept arguing over a piece of cheese. But she already received a full refund. All she did in the parking lot was treat the cops in a way that proved that McDonalds was right about her. Her angry, rude, and entitled, attitude turned her into her own worst enemy. Her behavior made her look extremely unreasonable to the point of total incompetence. She obviously didn't have the good sense to cut her losses, take the criminal trespass, go home, and move on with her life. McDonalds requested that she be given a criminal trespass order. They have the right to do that. The cops can't decline that type of reasonable request from any merchant or private citizen if the merchant or private citizen can show just cause for requesting it. At that point the cop asked the woman to show identification so that he could write up the trespass order and give her a copy of it after she signed it. She angrily refused and her anger kept escalating. Legally she had no legs to stand on. Once the criminal trespass order was on the table the woman was obligated to ID herself to the cops. She couldn't legally decline the order to identify herself because the cop gave her a reasonable and articulable order to identify herself because McDonalds had requested that she be formally served with the criminal trespass order. Once faced with identifying herself over this issue she couldn't legally decline. That's why the people who audit the police will only film an audit on public property or else they would be criminally trespassed on the regular. This woman was originally arrested for failure to identify herself after being given a lawful order. Both cops told her over and over numerous times that they needed her drivers license to confirm who they were giving the criminal trespass order to. The cops told her that after she signed the criminal trespass order she would be free to leave. She kept getting more and more angry and she foolishly refused to ID herself over and over, again and again. She was the one who kept escalating the situation with her aggressive and argumentative behavior. So after giving her enough warnings the cops told her that she was under arrest. Then she began resisting arrest. Just because you're verbally claiming that you're not resisting arrest, while you are actively resisting arrest, that doesn't mean that you're not resisting arrest. There are tons of video's on this platform that show that once they tell you that you are under arrest, and you start fighting, the cops are going to do whatever they need to do to get you in handcuffs. I've seen people dumped on their heads on the concrete and much worse. Believe me if the cops were wrong I would say so. I always support the citizen when the cops are violating any citizens rights. I can't stand it that cops have - QUALIFIED IMMUNITY FROM PROSECUTION - to trample all over citizens rights. But that is NOT what happened here. This chick was absolutely wrong. Based solely on her behavior the cop was well within policy to use a taser (or any other less than lethal device) on her. So she got off lucky and she took a shot to the mouth and then they got her in cuffs. I kept wondering if the reason she refused to ID herself was because she knew that she had an active warrant out for her arrest. Because it made no sense that she refused to ID for the trespass order when she admitted that she was never going to eat there again anyway. We all have to consider the fact that this woman's attorney is not playing the police bodycam footage in this press conference. He's not showing the bodycam footage because he is well aware of the fact that the bodycam footage does not help his clients case. In fact the bodycam footage blows his clients case out of the water. In closing the last thing that needs to be honestly pointed out is that the only people being RAY - SIST in this case are the three people in this video. The more people play the RAY - SIST card under these ridiculous conditions, the more everybody else will become desensitized to it, and roll their eyes in response. It has come to the point where most people are beginning to realize that... It's the people who scream RAY - SIST all the time who are usually the real RAY -SISTS. Especially when you get right down to it and look at all the facts. :-I

Did you really watch the bodycam video? How the hell did you not see how the police came ready to escalate the situation for an arrest? She clearly told what had happened and said that she just wanted to leave and never come back to that McDonald's. Everything could get solved if he just told her "Ok, please leave the premises" and problem solved. No lawsuit, no police brutality, no nothing. She is a woman not a man, he is a trained police officer with qualified immunity so he can even kill her and nothing would happen to him thanks to the judicial system being so bad.

The fact that she said that she never wanted to come back there was the reason WHY she should have identified herself, signed the no trespass order, and then she was free to leave. Throwing a hissy fit, talking a bunch of bull, and refusing to identify herself, was the act that demonstrated that she might of had a warrant out for her arrest. Once she started fighting with the cops she instantly put herself in a situation where she was going to get hurt. It's her own fault. One way or another the cops were going to make sure they found out who she is. No way they were going to let her go without serving her the criminal trespass warning. She acted like a completely immature whack job. The cops have to serve her the criminal trespass. She had to identify herself. If she would have acted like an adult there wouldn't have been a problem. But she resisted arrest after they gave her numerous warnings. She's lucky she didn't get tased or worse. Grow up. :-I

This could have all been avoided by Ms. Hancock taking her refund (which she did) and just leaving the establishment. As it has been referred to as 'made whole'. I just finished watching the bodycam and how this all resulted with her arrest gives credence to the reason / reasons the fast food restaurant called the police in the first place - even though we didn't witness that part. Lastly, the grandstanding and performances exhibited by the attorneys and Ms. Hancock is downright cringe.

Yes that bystander came to her aid in so many ways, now they going to have to justify why, why they did this to the poor young woman with a six years old child and thank goodness her child was not with her seeing her mother being punched in the face by police officers. Wow😢

I live in Dayton, and my husband and 23 yr old daughter had a run-in with that same cop. My husband left the car running while he went into McDonald's. The cop asked my husband if that was his car was running, and he said yes. Then the cop got in my husband's face and said, "it's against the law to leave your car running unattended. So turn it off now or I'm going to give you a ticket." My husband stated that he didn't know that, and he just left. I hope that this lady gets justice and the cop gets fired.

Your client was the one who escalated the situation......over a piece of cheese. When being trespassed, she is required to produce ID, but it became obvious thar she didn't even have a drivers license. They attempted several times to talk her down and tried to get her to cooperate, but she was not interested.

This whole situation could have been avoided if she had just given her information to the OFFICERS so he could have written the NO TREASPASS notice for her . The OFFICERS deserve a raise for putting up with her BS for as long as they did before taking her into custody .

Read the trespass law, you have to come back after being asked to leave in order to have violated the trespass and then at that time have broken the law. Once the law is broken then she would be required to ID. Don’t you believe in the constitution?

It doesn't work that way. You can't bring criminal charges. Only the D. A. can do that. The only thing you can possibly get, the *only* thing, is money. And if you reject their offer and take it to trial you might end up not even getting any money. You'll only get what the jury determines you're entitled to. Which in many cases is much less than the initial offer from the city, county, state, whoever.

She went through a lot for a piece of cheese. If she had given her name for the ticket, all of this could have been avoided. The officer should be disciplined for punching her in the face but in all fairness her behavior started the situation. McDonalds could have just given her the darn piece of cheese. I got a feeling they're going to pay a lot more than what that cheese cost going forward.

No one knows the side of the McDonald's. How was her cheese situation communicated between the employees? We have HER interpretation, but not the actual employees. So, it seems that the first McDonald's employee was polite and tried to assist her, but the 2nd employee was the one that she had the issue with. BUT - did the 2nd employee understand that she had paid for the first extra piece of cheese, but did not get it on her hamburger, OR did she interpret that REGARDLESS of how many pieces of cheese was already on the hamburger, she STILL wanted an extra piece - and therefore by the 2nd employee's interpretation, she needed to pay an extra $0.30 cents for the extra piece. That the 2nd employee did NOT understand that the piece of cheese she was wanting, was ALREADY PAID FOR but NOT given. The side of the story the woman gave was not entirely clear on that, and there's been no disclosure of what the employees interpreted or understood. We only have one side......

@@mixdmusic2898 - Police Brutality? That didn't happen here. I've seen much worse happen to people who blow a fuse and refuse to go into handcuffs after they have been formerly arrested. She was fighting the cops well before he popped her one and the cops had good cause to arrest her. He could have legally used a taser on her or another less than lethal device once she tried to fight them so's not go into custody. The bottom line is that if the cops were violating her rights then I'd be on her side. But she didn't have a legal right to refuse to ID herself in that situation. Had she simply Identified herself (because legally she was obligated to ID herself at that point) and she signed the criminal trespass order she would have been able to leave. But she was being ridiculous. They gave her several warnings. So they arrested her for failure to identify herself, she fought them, and one cop popped her one in her mouth to force her to comply. They could have done all sorts of brutal stuff to her once she decided to fight them. She was running her mouth for so long (acting like a fool) that it was kind of poetic justice that the cop popped her one in the mouth. They could have body slammed her on the pavement or much worse. She got lucky. Because she was her own worst enemy. :-I

The cops were called after efforts to resolve the matter failed and temper's rose to dangerous heights. I watched these officer literally beg her to sign the trespassing ticket and be on her way . She refused and wanted to leave without signing . That choice instigated the entire event's that followed. At which time she continued to resisted arrest , while hollering " okay okay okay " but never complying . Officer's goals are not too get a suspect to agree to be handcuffed , but too actually get them on as quick as possible to eliminate any possible threat . Unfortunately many people like this are looking to create a lawsuit for financial gain . Like pouring oil on the grocery store floor to fake a slip and fall. BS.

UPDATE for all the cop apologists: The Ohio Bureau of Criminal Investigation investigated the use of force, and, following the investigation, Sgt. Todd Stanley was charged with assault in Vandalia Municipal Court. It was found he did not act under the colour of the law. No matter how uncooperative, unattractive, argumentative the young lady was, there was no need for requiring she provides ID under threat of arrest. And there was no justification for the use of force.

Can't agree about the "her and her descendants until the Lord comes back." It's not supposed to pay for the rest of your life: it's supposed to compensate for her loss. Now because there's was also the loss of her job after being in jail for 5 days, the reparation could/should be considerable. But she has no basis for being able to retire on it. This whole thing was a travesty. She began very calmly explaning to the officer her side of the story. And she had a decent case. Never got a good explanation as to why the McDonald's worker didn't even follow the direction of her own manager.

For a simple trespass you don't have to I.D.! Now if you refuse to leave, or come back, then it becomes criminal trespassing and that is a crime and requires I.D. what trespass were these cop's enforcing exactly? @1wpk911 in all states the property owner or agent (i.e manager) has to ask the person to leave in front of the police. The person has the opportunity to leave. Only if the person refuses, can the police trespass them. She was not given that opportunity. In some states (not sure about OH) a property owner can sign a form making the police an agent and allowing them to ask people to leave and trespass them without consulting the property owner. But in this case, even if they had that authority, they had not given her an opportunity to leave so its moot.

And she was more than likely controlling her behavior for the police. So why shouldn't the McDonald's be able to call the police on an individual causing a disruption in such a way? The problem is the police have Qualified Immunity,that protects them from any liabilities, all lawsuits are paid for by the citizens of that city or state! The Supreme Court needs to abolish Qualified Immunity for all law enforcement officers! When that happens, the Police won't act this way because then they have to pay for the lawsuit!

No one has video of what took place inside the McDonald's. All we have seen, is the account from this woman......a woman who totally freaked out and became unreasonably enraged outside the restaurant over the police just doing their job. I've seen that video of the incident - the police actually seemed to be on the woman's side of the issue regarding the extra cheese on the hamburger. They seemed to be sympathetic to how she was treated inside, but AGAIN, they and we had only the woman's side of the story. No one knows if the woman became as equally enraged and emotional INSIDE the McDonald's as she became OUTSIDE of it with two police officers who seemed to be taking HER side of the incident. IF she did, then the employees INSIDE the McDonald's certainly had every right to call the police and file trespass on her to never visit that restaurant again. But, they do NOT need such right or reason. They are supported by the US Constitution to refuse service to ANYONE for any reason, beyond certain discrimination such as racial, etc. But we then transition away from the incident INSIDE the McDonald's, to the new incident OUTSIDE the McDonald's. The police were called, so they have a job to do. They HAVE to file a trespass against the woman, and for that to be official, they NEED the woman's official information. They cannot rely just on visual description with no name, etc., because that would not prevent the woman from violating the trespass in the future and getting away with it, nor prevent an innocent woman who fits the description from being targeted by the police mistakenly. SO they NEED her official info. And if the woman was in the right, there should have been NO reason for her to refuse, right? But she DID refuse, and that is what transitioned and escalated the incident into her getting arrested. In the video of the arrest, not only did the woman get louder to the point of screaming at the police as she continued to refuse to give them her info, but at one point she got emotionally aggressive towards one officer, slamming her fist into the palm of her other hand as if to imply that she was on the verge of getting physically violent, moving around in increasingly agitated actions, etc. When after multiple times of refusing to give her info, at one point she seemed to start to comply, and gave her last name, but when the officer asked for her first name, she then retreated back to refusing to give her info further, and that's when the officers decided to arrest her for obstructing the attempt to file the trespass against her. Was the need to hit her in the face necessary? I would think not exactly: two male police officers should have been able to physically contain and handcuff the woman without the need to physically strike her. A lower level of physical compliance would have been to move her to the ground, where once on top of her they would both be better able to control her arms and hands for handcuffing - it would seem untoward to throw a female to the ground, but in my opinion it's a better resolution to simply punching a female in the face - only if the female was throwing punches herself and trying to physically harm the officers would IMO such physical assault in return be appropriate. But it never got to that point. But at that stage of the incident, the arrest of the woman was entirely justified, and brought on entirely by the actions and decisions of the woman herself. So while the punch could have been avoided, everything else resides on the shoulders of the arrested woman. She made her choices......

I'm sorry this happened to her and glad she wasn't seriously injured or killed. This should have been handled differently. That person who called the police on her should be fired and Mc Donald's should have some responsibility.
