It is perfectly legal for a male officer to conduct a search. However it is advised that a same sex officer does the search. If a male does do the search, he should use the back of his hand when going around certain areas. Which this officer does. This lawsuit will get tossed

As long as I've been alive, and I am not a youngster, have I ever seen a pat down done on a woman so intrusive. As a matter of fact, even female officers don't go that far. Male officers should only use the back of their hand to go under the breast in a swift manner and tell her beforehand what they're about to do, not like what this clown did. If this is the way they train male state troopers in New Mexico, then I feel sorry for any female crossing their path, because it will lead to being sexually assaulted. Whoever thought of this sick idea of searching female suspects in that manner by a male officer should not be working with the public. I would question the mentally of that individual. That was sick and disgusting.

I've been patted down like that before. He even pulled on my bra cups so see if anything would fall out of it.* Tip to anyone pulled over:* When they ask if you smoked weed today, never answer with the truth "yeah, earlier," especially on Christmas Eve! They're out to get ya, especially if they're working on a holiday. LOL I was less than a mile from my parent's house for the annual Christmas Eve party. *He was sitting in a church parking lot and pulled out behind me*, flipped his lights on and when he got up to my window said, *"I was driving down the road and you came at me head on. Is everything ok?"* My mouth literally dropped in disbelief, this is shit ya see on TV not experience first-hand! I refuted his statement and he said he could smell marijuana and wanted to know if I had smoked today. I said. "yeah earlier but I'm on my way to my parent's Christmas party now." He gave me a field sobriety and searched my car. I had a bag of Crayola crayons in my backseat pocket from a babysitting gig I had and *he thought he found my stash, when he pulled out the crayons he was so mad that he flung them ALL OVER my car*, in the back seat, on the dash, that man threw them in anger! He came back and said, "well, I'm going to take you to the hospital almost an hour away) and get some bloodwork since you've been smoking." He put me in handcuffs and that's when he pulled on my bra and "patted" me down. Worst Christmas Eve, EVER!!

@Mike Borden I mentioned it to my lawyer. He said not to make waves - the SOB cop didn't even show up to court due to a "family emergency" but they still proceeded with the case!!

@Mike Borden Technically, they weren't even suppose to proceed with my case. Since the officer didn't appear in court the case should have been thrown out for me. Yes, every officer that "searches" women like this is committing sexual assault and should be prosecuted!!

@Mike Borden It is most certainly a tactic that many corrupt officers use, just like he did, who don't want to get up and go to court first thing in the morning. He had multiple cases that day, they had all of us stand in a line almost 40 people deep, and the judge went through the line and we had to say guilty or not guilty. I signed a few papers and left, when ALL of us standing there should have had our cases thrown out due the officer's absence. I asked my lawyer, "since he didn't show up what should I say," "you say guilty and so long as you don't get in trouble in a year your record will be expunged." But, that expunged record can still be seen by any officer that pulls up behind me to run my tags/plates and that will encourage them to harass me. Our judicial system is so corrupt, but no one wants to believe me when I preach about it, and not just toward black people, most of us that day were white.

Why do they hire these worthless, filthy, slime ball criminals? They lie and sexually assault people and then get away with it. I hope he lost his job. We don't need criminal trash like that patrolling our highways. My brother-in-law was stopped by a state trooper in Oklahoma. He was on his way to his friend's house. The moronic state trooper stopped him and made up some lie about speeding. Then he searched his car, which was illegal, searched him, got a k-9 to sniff for drugs and then asked questions that had nothing to do with speeding. He asked him where he was going and why. Then he asked what was his friend's name and why was he spending a couple of days with him. He had another low-IQ trooper with him and acting in that same manner. After he was done with loads of illegal questions he let him go. This is what some of these evil troopers are doing. They need to be fired, arrested and serve prison time for the crimes they've committed and make sure that they don't get that pension. It's the only way they're going to learn. No male trooper have any business searching a female in that type of manner. They are sexual predators in uniform and should be locked up.

@@benparks3564 Seems like searching gives them a power trip like no other. Nosey mfkers. I don't think these cops even realize the real damage they are causing. They are literally ruining people's lives with illegal searches every day. Take my situation: illegally searched, charged and found guilty of the charges and lost my license. In turn, I had no means of transportation to Graduate school 1.5 hours away 3 times a week, I lost my scholarship due to that, causing me to spiral into the deepest depression (that I still have lingering effects from) which led to a 10 year heroin addiction. All because he couldn't just say "Merry Christmas," and let me drive the remaining mile back to my driveway. SMH when I sum it up like that it makes me think "damn, these fkers really got me good." I will never trust another police officer as long as I live.

This happens ALL the time in New Mexico, Geoffrey Stone an Albuquerque police detective at the time Happened to me when i was 20 or 21 .. a cop didn't like that i was standing on my right to remain silent and so when he "patted" me down he squeezed my testicles so hard i almost feel to the floor. And then he used that as me resisting and lifted me up to my feet and pushed my head into the back of his car with my face shoved directly into the rear antennas on the car.

She was a criminal and had a warrant for her arrest. And if you are law enforcement they are trained to use the back of the hand and to have another officer present, if a female officer is unavailable. This woman is just trying to make some quick cash.

For a man is no big thing. But, I'm sure for a woman is a big deal. Putting his hands all over her body, including her breasts is not the same as patting down a man. Also, this was not a pat down. It was more of a sexual assault. That kind of pat down should have been done by a female officer.

What was the reason for the stop? If a traffic violation, I would think the passenger has nothing to do with the stop. Why was she pat down? Was was she even asked for ID if maybe she had not broken any laws there??

I gave him the benefit of doubt being that she had a warrant for battery.........but after viewing the video, his ass was out of line. If you can take the time to call out a canine unit to conduct a search, whether reasonable or unreasonable, why not call a female officer to pat her down or search her? Officers can conduct a “PAT DOWN “ if they reasonably suspect a person is carrying a weapon (terry vs. state of Ohio) , but he went beyond that during this search.

I was going to come out over Terry Searches, "in which a reasonably prudent officer is warranted in the circumstances of a given case in believing that his safety or that of others is endangered, he may make a reasonable search for weapons of the person believed by him to be armed and dangerous." Officers routinely skip that little bit that the officer needs to believe his safety in endangered. The problem here is twofold. First, you have a search incident to arrest. Actually, there are departments where the officer would have been disciplined for NOT patting down the passenger with the ticket non-payment warrant. But there is also the fact that the driver's warrant was for an assault. That pretty much is going to get anyone patted down subsequent to arrest. Was his search overly intrusive? I'm uncomfortable with it, but I'd want to see a video of his searches of male subjects, which sadly the way many departments stonewall FOIA requests may well require a lawsuit. Did it violate policy? If it did, the officer just left the department open to a whopping big judgement. The courts are actually more likely, in my unexpert opinion after having read several dozen court opinions, to find the officer lost his qualified immunity for violating department procedure versus violating the constitution. A "reasonable officer" may have felt the auditor was too close, for example (as in he didn't want an independent audio recording of him violating the detainee's rights) but it is pretty much universally held to be reasonable that the officer knows department policy.

@rebelfrom1944 NOT sure if you actually read what I said - it's a guide to how to succeed in the legal arena AGAINST police who abuse their power. I don't agree with some of the BS - but in the courts law enforcement is penalized more often for breaking their own published rules than for violating the constitution. Unless you're willing to go out there and shoot police, and that's a fool's game, as they can always deploy more force than we can, and with the surveillance state they are going to get you most of the time. Go out and VOTE, especially in your primary elections. The primaries are where you can really make a difference.
