It sounds like Kirstin didn't have effective lawyers at trial. The appeals lawyers did a good job. In 2019, Kristin filed a federal lawsuit against the Las Vagas police and detectives who handled her case.

Good, I hope she has/will bury them. Police sometimes get terrible tunnel vision, and cannot appreciate the absolute devastation they can render on the lives of innocent people when doing so. There's no excuse for it, and they are just as guilty of causing harm to the innocent when they do so as any criminal. The consequences for such actions should be devastating, to remind other police they must at all times be guided by evidence alone, not by their own subjective judgments.

A friend made the mistake of talking to the police because "he had nothing to hide". Yeah, the lawyer's fees bankrupted him. The lawyer told him it would have been a lot cheaper to not talk to the police.

Ted Bundy, Jeffrey Dahmer, Wayne Williams, Gary Ridgeway (the Green River Killer), Joseph DeAngelo (the Golden State Killer), Lonnie Franklin Jr (the Grim Sleeper), Ivan Milat, mass shooters like Martin Bryant or Nikolas Cruz, not to mention more recent cases such as, Jodi Arias, Letecia Stauch, Stephanie Lazarus and countless others.

"When a person adds substances to their life, they subtract the presumption of innocence." This statement is so haunting to me, as a person in long-term recovery from substance use. I have been clean for several years - because I attend a methadone clinic I am regularly monitored and have a lengthy and consistent record of clean drug tests - however, I know that the fact that I was once an IV heroin user will be a dark cloud hanging over my head for the rest of my life. Forget about the fact that I have a degree from NYU and have worked for some of the largest newspapers in the world - if I were to ever find myself in a situation like this one, in which I coincidentally happened to cross paths with an individual who ultimately ended up dead through no fault or involvement of my own, I would certainly end up as Suspect #1 due to my "incorrigible history of hard drug use." It's a bitter pill to swallow knowing that law enforcement (and a sizeable percentage of the general population) will _always_ perceive me as just another junkie no matter what I accomplish in my life.

One thing religious cults try to do is to repress human sexuality. All that does is to cause pressure to build up until finally there is an explosion. This is what happened to Kirstin and it happens to people like her. Their natural urges are suppressed for a long time until eventually it all comes out in the form of promiscuity and sexual addiction.

In addition to his knife wound the victim also sustained a terrible beating and the police never showed that Kirstin inflicted that beating or even had the physical ability to do so. The defense attorneys should have raised this, as well. It is clear the she did not receive a fair trial.

I always say that it is shocking how horrible our education system is yet the same government expects randomly selected jurors to be effective in deciding the outcome of a trial. A lot of jurors can’t read or write their way out of a paper bag let alone properly apply critical thinking skills. The only thing more tragic is how eager police and DAs are to convict ANYONE versus the actual perpetrator.

Thank you for shedding light on this all too common occurance. Never talk to the police. Always have representation, your freedom may depend on it. We like to think the truth prevails, not so. If someone has been prejudged by an investigator they tend to find evidence to support their theory. Members of our family, a husband & wife, got into a physical altercation, the husband pulled her hair leading her up some steps. The detective called the wife to inform her he had changed a couple words in her statement to police. He took out pulled her hair & wrote choked her. She & I asked a lawyer why he would do this. He said because pulling hair is misdemeanor, choking is a felony. This detective wanted a felony charge. We found out what lengths some will go. Sad

She may have been acting in defense or just made up a story that coincidentally sounded similar to an actual situation, but some of the things she did/said did not help her case. If it was in defense, it would look suspicious to many that she would simply leave without calling for help or alerting authorities. If she just made the story up, that is not the wisest thing to do either, especially with how gruesome the story was. And whether it was in defense or made up, what you should definitely not do is tell authorities you did not think anyone would miss an individual you seriously injured as a justification.

Where drug addicted, troubled criminals lifestyles, get them caught up in hairy situations. Guilty, or not, you see a lot more less empathy. You see a lot more comments in the judgemental vein. "That's bad. But maybe if you weren't a druggie out on the streets, you wouldn't have gotten caught up in this mess" A far more stern sense of admonishment, generally. Just find it interesting, how the sense of connection with the human condition, seems to vary depending on who we're looking at.

Kirstin Blaise Lobato is a Nevada woman who was exonerated for the July 2001 murder and mutilation of Duran Bailey, a homeless man from St. Louis who was living in Las Vegas at the time of his death. At her first trial in May 2002, she was convicted of first-degree murder and sentenced from 40 to 100 years in prison. In a 2006 retrial, she was convicted of the lesser charges of voluntary manslaughter and sentenced to 13 to 45 years. Lobato's case gained significant notoriety due to the publication of new evidence, which some believe points to her innocence of the crime.

The fact that there was extensive fingerprint, DNA and shoeprint evidence at the crime scene - none of which belonged to Kristin - should have easily resulted in no charges being filed against her. It is inconceivable that she could end up in trial with all this exculpatory physical evidence.

I don't understand why people feel the need to talk to the police. Your first question should be 'am I under arrest?'. If the answer is no, then walk. The police are not your friend. Maybe if a random stranger grabbed you and attacked you and tried to rape you, it would make more sense to you. Consider panic, fear, adrénaline, traumatic stress, etc. That fucks with your memory. It doesnt always make a person hyoer aware to detail when your just trying to avoid being killed or sexually violated.

My advice to everyone is never talk to the cops. An officer from the Miami police department responded to my home for a domestic violence dispute. My sister and mom attacked me, then called the police to say that I was beating them. They asked me a few questions and I just told him the same thing over and over again that I never hit her over the head with my phone and I never attacked her. Somehow in the police report, they put down that I admitted to beating her which was a total lie, and can be proven a lie with dash cam and body cam footage. We never had to make a big stink of it because my lawyer was able to get my mom to recant her statement and they dropped the charges. However, had I been somebody who was in the middle class or lower middle class and didn’t have the money for a lawyer I would’ve been in a unpleasant legal battle.

I have self defense insurance because I carry a firearm for protection and the number 1 thing that is told if have to defend yourself is only tell the police when you call, that you have been a victim of a crime and need assistance, give location and advise if need fire, ambulance etc... and hang up. That's all you have to say. Other than that call your attorney.

It's very sad that prejudice led the way with this case. It took so long for her to be set free, but in hindsight, it may have helped her- she was still young enough to change her mind and leave her hometown after a year or so after moving back there, and who knows what might have happened with her. It's still sad though, and I hope she leads a happy life.

As soon as I heard the man was found in a dumpster leads me to think that it's more likely she didn't kill him. I'm sure she could have managed to get him up in there somehow, had it actually happened, but if so, where's her DNA?. By her being open to admit to others that she was attacked and tried to dismember him is more believable and would not have spoken of it if he died at her hands. Maybe word got out on the streets of his attack and injuries, and the killer used this to establish the similaries. The fact that she was nowhere near the place during this crime, just goes to show the police bias you mentioned. There should never have been any charges to begin with. They had no problem wasting tax payers' funds to attempt to frame an innocent woman.
