But king once they are kings tend to deal viciously with judges that try to tell them what to do. The court obviously would rule against any Democrat President. The President is not a king if they are a Democrat

​@@Aldarionz9 Not much you can do without a constitutional amendment (although I would be in favor of that). The Constitution specifies that federal judges serve "during good behavior", meaning that unless they're impeached, they serve for life. You can, however, increase the number of judges* on the Supreme Court by legislative action (i.e., no constitutional amendment required). That's also something I support, for a number reasons, not the least of which is that 9 is too small a number of members for a body that has so much power. It gives each judge too much power, and it gives the presidents who appoint them too much power. Increasing the number of judges on the Supreme Court is controversial, and would require strong support in both houses of Congress and the White House. Given how fractured and dysfunctional Congress is these days, I don't see that happening, unfortunately. ☹ ________________________ * I refuse to call them "Justices", considering that most of them have absolutely no regard for justice.

Like it or not if the courts ruled otherwise then literally every single president after trump will just be arrested day one in office, letting the court decide if the president of the free world is allowed to govern or if he is to report directly to prison instead would turn us into a laughing stock, Congress already has power to impeach the president to circumvent congress and give power of the presidency to unelected judges would've ruined the integrity of the three branches of government

I'm not American. Safe to say, I'm amazed that an advanced nation like this has a Supreme Court that does not adjucate based on the law but, rather, along political and religious lines. In most countries, politicians make laws and I nervously assume it is the same in the US. Why then do they not simply pass legislation that CLEARLY stipulates that a former President is NOT immune from prosecution, taking it out of the Supreme Court Justices' hands? And why on Earth does the US allow Presidents to appoint SC Justices, making said Justices indebted to said President? Can anyone help me out here?

​@Darian___ Around 1:09 he explains how the president **is** above the law and cannot be prosecuted for anything done during his hold on office. I thought this just applied to executive actions (Ordering drone strikes or special forces hit squads sort of stuff) but the Supreme Court, in their infinite wisdom (definitely had nothing to do with who apppinted them [seriously, why is the president allowed to apppint Supreme Court justices. Absolute bonkers]), decided it applied to any and everything done while holding the office. So I guess he was right, he could've shot someone on the street and no one would be able to prosecute.

What this ruling says is that you can't constantly badger a president you didn't like with years of lawsuits for acts he was absolutely within his right to take while in office.

It's essentially this: If the constitution says the president can do X, it's legal. That's it. No other branch can declare X illegal (separation of powers). Nor can they ask why he did X. X is his power and his power alone. If it's clearly a constitutional power he has total immunity. If you're unsure it's only presumptive immunity Presumptive immunity works like your presumed Innocence. It can be challenged but the onus lies on the state to prove their case. (That it's not covered by constitutional powers). It has to be like this or you don't have a president. If congress can inhibit or criminalize presidential powers then congress is the defacto president and you vote in a figurehead. This would put the president under congress which would be a violation of the separation of powers.

I’m not a legal expert by any means But this seems like it has the possibility to lead to so many bad outcomes. No one has ever thought that the president was liable for mistakes they make while doing their official duties. Obama was never indicted for drone strikes, bush never for the war in Iraq and the lies he told to get us there etc. I worry about what Trump will do with it if he wins, but I worry even more about what future people that hold the office could do. The president should have immunity so they can execute the duties of the office without fear of prosecution later. But it seems like it would make more sense to me for the court to rule narrowly. “Trump’s communications with the DOJ are immune because they’re official acts” etc and leave the rest later. The court was not forced to take up this question but the direction of the court means they *want* to continue to concentrate power in the executive (which has already happened over the last 4-5 decades especially due to Congress being worthless) as far as I can tell.

They said "core presidential powers" are absolutely immune: can't be prosecuted, can't collect evidence, can't touch them legally at all. One core power: command of the military. Think about what can be done _with that._ Nothing Trump "officially" orders the military to do would be illegal, as long as he, the President, orders it. That means he could "Seal Team 6" a political opponent, etc. Another core power they _defined_ is conversations with his AG (orders to him). Now, even if he unlawfully tells his AG go after a political opponent with totally fabricated evidence, and the AG follows that - yes, that would be illegal and not immune to prosecution, but guess what his other core power is? To pardon individuals, so they'd never get prosecuted, anyway - it'd probably be a legal question as to whether following a President's orders which are absolutely immune from prosecution, thus literally above the law, is even illegal. Really, you'd better follow Trump too, when he's ordering you to do things, because you know what power he has. This is absolutely a dictator opinion and ruling. Do not let anyone say it's "hysterical" and if more people, including _his own supporters_ read what Project 2025 has in store for their lives - they wouldn't be happy. A ton of Trump supporters are about to see their parents on Medicaid end up having _work requirements_ to stay on it, otherwise have to shop for horrible private insurance, since they're getting rid of the ACA, so back to "pre-existing conditions." So, per Trump sharing a post suggesting doing so, just this after this ruling: Liz Cheney rounded up as a "traitor" for a televised military tribunal. He certainly could order the military to detain whoever if he wanted, and despite being wildly illegal, he's the commander in chief, and that's already part of his "core powers", which are now _absolutely immune_ from prosecution.

A president acts a a CEO of the country and should be held accountable for illegal, self serving, or negligant acts with a defined and clear rule set. Impeachment creates a vauge rule set which is variable per the political wind of power. Gerrymandering or any act if interfering with elections should have the highest legal consequences with a clear and defined swt of parameters. Otherwise lawfair and intetfearence will corrupt and weaken our country.

Impeachment only works when you have enough votes to both impeach and convict. If one party controls both the house, senate, and presidency conceivably that party could do whatever they wanted with immunity and no legal recourse in the courts. You have now handed an unjustified amount of power to one party in a very limited two party system.

What I don’t understand is what this has to do with a candidate committing blatant crimes in an election he lost. Candidates, even when they’re the current president, have no role in the process of certifying the election. All of the actions he took have zero to do with the presidential duties. This was a person criminally using the power of the office to intimidate officials into criminally disenfranchising who Americans chose as their president. The klan court taking this case and declaring that their preferred president and the president that literally installed half of the unqualified white supremacist that came to this decision EXPLICITLY for this moment is one of the most shockingly acts of unmitigated corruption in this country’s history. The fact that all of the decisions of this far right wing court have been to undo 50+ years of settled law is largely possible because a twice impeached president was able to install a partisan and unqualified extremist on the court after Americans had already casted votes to elect a different person makes any decisions they make illegitimate, full stop. It’s going to get much worse before it gets better, but the days of a 9 justice court have to end for that to happen as this court declares with absurd and contradictory decision after decision.

44 presidents went almost 250 years without needing this. Well, one needed it: Nixon. But apparently neither he, nor his legal counsel, nor the DOJ, nor did anyone in government at that time know about this. This includes Ford, who pardoned him, although according to this ruling, he didn’t need to.

IMO this is a strong point made by the majority. Why hasn’t it crossed the minds of prior prosecutors to bring criminal charges against a sitting president before? I never did hear a good rejoinder to that. Morrison v Olson clearly messed up a lot of things as far as executive privilege is concerned and this case is the natural progression of that.

There have been impeachments, the Constitutionally mandated way of dealing with a rogue chief executive. The facts of this prosecution, however, run contrary to that. Qualified Immunity does not cover Criminal actions. It is to prevent a Civilian from bringing a frivolous lawsuit against an officer.... However, it does have the same flaw as Qualified Immunity: How can an Officer know if the actions violated immunity, until the Legislative or Judicial Branch informs them? This is a serious problem in Qualified Immunity cases, offices can do things that violate our Civil Rights and then claim ignorance. If the matter hasn't been resolved by Congress or the Courts, said court will give the Officer a 'free pass,' claiming they couldn't have known they where doing something that violated Civil Rights. All acts will be 'offical' until otherwise stated by the Courts....

That's not what the opinion said. First of all how is that his exclusive power granted by the constitution? So absolute immunity doesn't apply. You could argue it's an official act so presumptive immunity would apply but this can be easily refuted. And one would argue that what you suggest isn't an official act but an unofficial one...

This ruling isn’t “just for Trump”. I protects past, present and future presidents. It will protect Biden from involvement in his dealings if they were in his official capacity as president as well. It effectively puts a stop to political prosecution from both sides against the other.

The law already prevents political prosecutions from happening. Prosecutions require valid laws and actual evidence to proceed. Political motives are not part of the equation, except in Banana Republics. Trump's prosecutions are not political - he's being prosecuted for breaking the law, not being a Republican. No person, President or otherwise, should be above the criminal law of the land. This Supreme Court opinion will go down as one of the worst in American history. As a lawyer myself, trained in Constitutional and criminal law, I cannot express how disappointed and incredulous I am about this decision.

The Supreme Court said they can not assume motive. If he had said make up 11,000 votes so I can win, that would be concrete. But, he said find votes. There is a case in Fulton country now that addresses voter fraud.

In his second term, he'll be surrounded by like minded people onboard with his agenda. Those who've developed Project 2025 will provide the people who will follow his directives without question. With today's ruling, he'll know there will be no legal consequences no matter how much he bends the rules or breaks the law. 🤡

One of the most baffling things as an outsider is how the US can claim to have separation of powers when supreme court justices are appointed by the president. Of course the ruling is going to be down partisan lines..

Possibly they think so… that they are the ones deciding if an act is official or not. And hence they limits what crimes the POTUS may and may not commit. However, the POTUS can now at any time direct someone to remove justices. And have them replace with some who think it is an official act to remove and replace justices in that way. The POTUS is King. His Hand is only so as long as it obeys the King.
