In the child-restraint case with Trooper Morales (starting at 2:12:40), Judge Brown twisted logic into a pretzel in order to side with the trooper. The statute requires that the child restraint device must be used "while transporting a child." Attorney Todd pointed out that Trooper Morales did not witness the child unbuckled until his initial approach, with the car parked. The operator of a vehicle is not transporting anybody during the moments when his car is parked at the side of a road, having been pulled over by a trooper. Judge Brown read the relevant statue aloud at 2:19:52, but still ruled against the defendant. 316.613 Child restraint requirements.- (1)(a) Every operator of a motor vehicle as defined in this section, ***while transporting a child*** in a motor vehicle operated on the roadways, streets, or highways of this state, shall, if the child is 5 years of age or younger, provide for protection of the child by properly using a crash-tested, federally approved child restraint device. The Judge was just scared to rule against a fired up cop.

Why is background music playing during the video? It’s not really necessary, and why does the music get louder when somebody is speaking and then quieter when nobody speaking kind of hard to hear this way

LOL, I motioned to dismiss my parking ticket in Seattle (head-in parking in a back-in parking space) because the parking enforcement officer was not present. The judge refused to dismiss - I was given a $10 discount in exchange for waiting 3 hours in the courthouse lobby.

I love traffic court. These numb-nuts believe that by accepting a hearing in lieu of no conviction, no points and nominal fines, they will fare better. What a waste of judicial time. You have to anticipate a tougher go at it when you appear at the hearing. I could see if the goal is to extend the period in which to ultimately pay the fines and costs, but it's rollin' the dice. I had a speeding ticket and took it to hearing. There were about 10 others who were, like me, offered impeding traffic, no points, fine of $250. One of the defendants asked what are the chances of beating the ticket if he went to actual hearing. The clerk said honestly, "less then 5%". We all took the offer.

Also, the construction of a Money (to) Order is well within the statute if it meets section 3.1, which when one looks at the statute there is no restrictions on who, where or how a Money (to) Order has to be constructed. The fundamental issue here should be boiled down to the above, then once that is done the boundaries can be argued, I think he wins in all honesty, just for the fact that this female attorney actually called the alleged wrong instrument a “Money Order” on no less than 2 occasions.
@restoresmile3 ай бұрын
The clip is interesting, but I don’t think it’s completed in defence argument, we didn’t get to hear if the instrument in the hands of the defence attorney was in fact the instrument that was sent to the IRS (which if it’s a copy he’s holding then deems it ‘non est factum’ or “this is not the deed”). If the IRS have only produced a ‘copy’ of the instrument to base their argument on then I would say that the defending attorney has missed a real and seriously tangible argument. By reason, if the government (treasury) were to seek a prosecution that a $5.00 bill was not real by presenting a photocopy of the bill in court, but not the actual $5.00 bill itself, then the argument from the defence should be “show me the money” otherwise by the government actually keeping the instrument (or the $5.00 bill) they have very clearly demonstrated that they have accepted it and, that in itself, is fraud.

If you are in court in texas for speeding after the D.A. says something lik e"Mr X was driving Y MPH over the posted speed limit and thats prima face evidence that he was speeding" say objection your honor, move the court to read both 201.904 and 545.351 of the texas transportation code into the record he wont do it. he will just dismiss the case right then and there with no explanation. because he is an FSCKING FRAUD and EXTORTIONIST and you just caught his hand in the cookie jar. I also dont have plates on my car and 502.003 says i dont have to

That van driver's money was well spent on that attorney. I wonder what the ruling would have been, if the evidence had been admissible. Without knowing the area, I can think of situations where common sense would seem to justify parking an HVAC van obstructing a bike line. Horrible situation for everyone.

@Ryan-The-Grifter5 ай бұрын
The music and distracting watermark is an attempt by this channel to claim copyright to this video of a public courtroom. The worst part is that KZfaq will allow them to copyright strike any channel that tries to use parts of this video through legal fair use. Scummy tactic to take video from the public domain and monetize it while adding nothing to it.

Does one have the intelligence to create and monetize for money or entertainment? If you would like to purchase a video without the watermark just say so. If youd like to use the content for your channel without purchasing, we would be happy to receive monetization via check for the efforts of our producers painfully taking time out of their day to screen record these interesting interactions for you to enjoy. Thanks for your support and good luck!
