Is it considered intermittent leave if you would like to take your leave in one continuous 12 week period but several weeks after birth instead of immediately following the birth?
@frontrangeinjuryattorneys
@frontrangeinjuryattorneys Ай бұрын
@@Flabmasterj it's only intermittent if you take fmla leave in intervals between work and leave like a couple weeks on and a couple weeks off. But you could still take fmla leave weeks after you give birth. You may need leave for medical reasons or just for bonding with the newborn. Both are supported under FMLA.

When my wife nearly 40 suddenly decided she HAD to have a baby right away (I still believe that was peer pressure) and was tripping out that it wasn't happening, she made a series of appointments in the middle of the work day and week to see a marital therapist. The 1st several visits neither of them allowed me to say a single word beyond hello. It was entirely Rag on Me time. No allowance for me to respond. The therapist spent more time ragging on me than my wife did and she didn't even know me. I was getting very frustrated. About 3/4 of the way through the 3rd appointment I walked out. When my wife came out I had moved the car to a shady parking space. I saw her come out the door, but I wasn't where we had left the car. She was panicking that I was gone. After the abuse indoors, I let her stew for a little bit before I honked the horn. I told her I was only getting angrier and thinking about divorce continuing to attend these smash once sessions.I was done with the therapist. If she wanted to keep attending, she would have to figure out how to get there on her own and I was going to keep working. I was self employed and she didn't drive. That was a Tuesday. The wekend was Father's day. She woke me early that day with breakfast in bed. Why? Under the knapkin on the tray was a ziplock bag with a pregnancy test inside showing positive. She told me she had seen a doctor (easy to do, she was a nurse) and verified she was 2 months along. While we were seeing a therapist about our marriage which damned near ended it, she was tripping on the raging hormones of pregnancy the whole time.

I will keep it simple. Everything i tell you I have documented support for it. Hernia mesh failure caused my intestinal wall to breech. Had emergency surgery to repair it. Found out I was qualified for a case. Filed a report with MedWatch of the FDA. I got my report for a hernia umbilical mesh that I received. Contacted risk management for ETHICON. Sent record of implant to her. Week later they sent me a report saying my umbilical mesh by them wasn't the cause. ETHICON said it was my right inguinal mesh that failed and not the umbilical mesh they make. I then received my 2nd implant surgery report from the hospital I had another one implanted just 2 years before the umbilical mesh was implanted. It was a right inguinal mesh made by ETHICON. So I sent in the second surgery report of the implanting a right inguinal patch made by ETHICON. A month later they said it was my own lifestyle that caused the mesh to fail. Even though they already said it was the right inguinal that they make that failed. Now I have the Lot numbers for the ETHICON implants. All reports regarding this. I know of the MDL in superior court in New Jersey that Josh Kincanon headed up. I chose not to utilize him and be placed in a 2800 person payout matrix. I had trouble giving up 40% twice. I have two ETHICON implants. Moreover I yelled for 6 hours before the surgeon rushed me to surgery. I didn't like the idea of someone who didn't suffer getting 40% twice. Twice meaning a local attorney would get 40% after Josh got 40% off the top. I have the money to pay for representation. But no one will answer if I can move forward. Can I contact your office?

“Innocent until proven guilty” if they fire you how is that insubordination similar to putting a plea deal when you know you don’t commit the crime why do the time? A contract is void without acknowledgement meaning it’s not legally binding without acknowledgement? Insubordination is refusing authority but if the allegation isn’t true, it’s libelous. Meaning a counter suit of slander, libelous, decimation of character, and more correct?
@frontrangeinjuryattorneys
@frontrangeinjuryattorneys 2 ай бұрын
No--the standard for insubordination is very low. If your employer instructs you to sign acknowledging a write up and you choose not to, that's enough. A write up isn't a contract so it's effect on your job is not affected by your acknowledgement. A write up also wouldn't be defamatory just because it includes inaccurate allegations. For a defamation claim you generally need publication to a third party and the general rule is that employees within the same company do not constitute a third party for a defamation claim.
