I could be wrong, but isn't the reason they all want to go to federal court because they think that A) by and large States aren't allowed to make their own laws, 10th amendment or not, and B)Because they think that once they get to federal court, suddenly the Judge will say "Oh yes, according to the UCC, you AREN'T a driver, case dismissed!".

Those zoom proceedings are just terrible for the justice system, you realize there is no consequences, it is a farce at best, some are in court for the exact same issue over and over and some prosecutor would dismiss or reduce charges over and over, no wonder why there are so many crimes....

When he's on the bench, Judge Middleton does a good job. Alot of people are wondering why he, during this broadcast, was obviously untruthful about Prosecutor Marvin finding the defendant in the house with the complainant. Even more puzzling is how Judge Middleton falsely accused Debbie Davis of lying, when she was actually telling the truth. Is there something medical going on with him?

Mrs. Davis left out the part where she told Judge Middleton that the contact between the victim and the defendant caused the victim to not want to testify that day, and that's why the bond should be canceled, and now shes admitting that the contact occurred after Mrs. Davis had decided to release the victim from the subpoena. I read in the paper that Judge Middleton thought that Mrs. Davis had lied to him, and I believe the judge. He comes across as very honorable and fair, whereas Mrs. Davis comes across as someone who is willing to skirt the rules for the greater good of protecting victims or prosecuting crimes or whatever noble excuse she makes up in her mind. Victims of domestic violence are often very vulnerable and can sometimes be manipulated by overzealous prosecutors to act against their own best interests. Hopefully, the voters in St. Joseph County do not elect this unethical attorney who curiously filed allegations against her former boss only after she knew that the axe was coming. Despicable.

I just reviewed the 3B case, which is still up on Middleton's site. She didn't say that the specific incident caused the witness to not want to testify, but rather that "repeated contacts" did, and that the witness was "not in a good place" and might not testify truthfully. It's the Preliminary Examinations 3B District Court January 16, 2024 stream. I think Debbie's recap here was reasonably in line with the truth, taking into account the vagaries of memory.

@defaultuser1447 We must have watched two very different videos. In the beginning of the video, you can see Mrs. Davis sitting at the desk with her arms crossed, pouting. When Judge Middleton first asks Mrs. Davis about the status of the case, the first thing out of her mouth is the bond violation. She makes no mention of releasing the victim from the subpoena. In fact, she never mentions it in the entire hearing. Furthermore, at 1:03:04 Judge Middleton asks Mrs. Davis, why did you let her walk out. Mrs. Davis responded, "Because he was starring at her." She absolutely had an ethical duty to admit to the judge that she told the victim that she was being released from the subpoena, and that's why she was leaving. Then Mrs. Davis said that it was very obvious that the victim did not want to cooperate, and Mrs. Davis tells the judge that the reason is because the 'continued contact.' But this is just an assumption on Mrs. Davis part, and she never offers any evidence of any other contact prior to the hearing that would have led to the victim's hesitation. She is clearly gaslighting the judge into believing that the contact that happened at the court is why the victim isn't testifying. Because Judge Middleton is smart, he suspects something is not right, but hes trying to give Mrs. Davis the benefit of the doubt because he trusts her to be truthful with the court. At 1:06:15, Judge Middleton asks, "At some point, she got up and walked out of your waiting room?" Mrs. Davis, again, fails to tell the truth that the victim was leaving because Mrs. Davis released her. She continues, "At this point, he has contributed to the unavailability and hostility of this witness." and "We dont have her here today to say that." Again, shes not there because Mrs. Davis released her. Mrs. Davis was upset that the victim did not want to go forward with the case, and she manipulated Judge Middleton into punishing the defendant as a result. She let her emotions cloud her judgment, and as a result a man went to jail. Her termination was absolutely justified.

Simple question for you: Did Mrs. Davis have an ethical duty to tell Judge Middleton that she had released the victim from her subpoena. And if not, why not?

I agree with you entirely! She was either vague, avoiding the ‘specific’ answering to the question then minimising or maximising details, with the clear intention of only giving information that would favour the outcome she wanted & not, though disappointing, would be the ethical outcome, as is the expectation of the law. You don’t always like the result but if that’s the legal process the court expects it to be followed. Clean hands needed from all involved. My boss would say one of my role requirements was to manage his expectations,. She knew what Judge Middletons expectations were & she failed to manage them! I wouldn’t give my vote for either as both have shown evidence of shady tactics. But my expectations are for them to behave this way as too many egos & need to be the winner any way necessary so I suppose they are my expectations! Haha😂 xx

I haven't heard why Debbie was gone. I was shocked that the issue was that Middleton thought Debbie intentional mislead the court. The underlying story to the "same house" case is interesting in that it wasn't Marvin of course, or actually Debbie, it was the officer watching the zoom that picked up on it and then the team got to work so she could lay that smack down live on Zoom.

I have watched several cases on KZfaq that Debbie prosecuted. She appears to be a fantastic prosecutor who is intuitive and wants justice served. I wished her the best in her election campaign. I don’t live in Michigan, but the little bit I have read on his firing of Debbie appears to not have followed basic universal HR steps for her release from employment. Go Debbie!

Jeff Middleton is a grumpy condescending and very cheeky man , who has been very disrespectful to anyone who struggles with zoom, wears something he deems unsuitable or doesn’t act exactly as he wants. He’s all for landlords not tenants and delights in telling someone the sheriff will put their stuff on the kerb in 10 days ; he grumbles about maybe 90 mins of eviction cases : contrast and compare this to Judge Cedric Simpson of Ypsilanti Michigan court who every Friday does 5/6 hours of landlords tenants cases and strives at all costs to keep people from being evicted ; even over plaintiffs objections. He’s also very nosey and asks people regularly where they work and where they live even if it’s nothing to do with proceedings , he thinks he’s a right to this information and I await the day he’s told it’s none of his business. He loves the limelight he’s participated in an episode of “snapped”, has his own KZfaq channel and does this! He loves being recognised that’s why he won’t cut his hair. I watching from Ireland find myself often open mouthed at the mean uncalled for things he has said to various attorneys and laypeople in his courtroom. He also is far far to close to the landlords the “Richmans” and is totally impartial when handling their cases. I don’t watch anymore as he’s just not a nice man. He also does look his age.

If the defendant in a criminal case cannot afford to hire a lawyer, in the USA they have a right to a court appointed lawyer which the government will pay for. That is the reason a judge asks those kind of questions about work and other financial questions. The judge is trying to find out whether they qualify for this benefit, so he can order it for them if they are. You'll hear Judge Simpson tell people to fill out the paperwork if they want a court appointed lawyer. Some judges don't leave it up to the defendants to recognize the importance and urgency of filling out that paperwork for their own benefit, so they ask the same questions in court and get the ball rolling on getting that person a lawyer for their case.

KZfaq streaming may be embarrassing for defendants/parties, but it also PROTECTS them. It's hard for the state/police/judges to get away with corruption when you have the entire world watching them. I have a huge side eye for judges who don't want people watching what they do.

Dave Marvin is a pushover. He makes sweetheart deals that you wouldn't see in other courts. He even once reduced a meth sales charge (a lifetime felony) to use of meth (IIRC a 90 day misdemeanor). He might be a nice guy but he is too much of a pushover for prosecutorial work. Debbie might be a bit better but I think even she would be very lenient. From what I have seen between Dave Marvin and Debbie Davis I think I would vote for Debbie (and I don't usually vote Republican). However, I do not live in St. Joe County.

And I don't know that you can say that Debbie is that lenient considering she had to work under Mr Marvin's management.

I love Judge Middleton, but him doing that bothered me A LOT! He can't claim he doesn't remember, because his mind is a steel trap. He remembers everyone, their parents, their grandparents, where they lived, what they drive, who they dated in high school decades ago, & what charges they, their family members, or friends may have faced during their lives! He always spoke so highly of Debbie, & she of him.
