Benford's Law should be used as a "possible" indicator of fraud. It can lead you in some directions but it shouldn't be taken to be a definitive indicator of fraud on small datasets.

Question off topic… assume in 2012 a brother inherits a traditional contributory IRA from his older brother… then, the inheriting younger brother dies in 2024 and leaves what’s left of the inherited IRA to his daughter. Now, does the daughter take RMD’s annually like her father did… or does she need to fully distribute the inherited IRA within 10 years?

I am in the midst of a probate case, where my sister decided, unilaterally, that she was executor, for the purpose of inheriting the entire estate and performed no executor duties. I am wondering and considering if I should pursue a civil and/or criminal case against her. As it is, although I don’t know for sure, I have evidence that she “may” have committed Social Security Fraud. I only know that the SSA had begun an investigation, to trace funds. Estate forensic accounting is complicated and takes a lot of time. Gather and organize as much information as you can, and bring the file to a forensic accountant for review. Typically this would require a $10,000 retainer. The forensic accountant will review the file and discuss it with an attorney so that you can be advised of your legal options

@@Rabcpafirm my case might not be able to be based upon forensic accounting. My mother (the decedent) was a hoarder. However, my sister formed a joint account with my mother, where I believe funds were commingled. Once my mother passed, I asked my sister if she reported the death to the SSA or there might be criminal charges. She stated she hadn’t and that she hoped they’d send another check. That was 2 years ago. Then I received a SSA benefits statement, for our mother, Jan, 2024. SSA began an investigation to trace funds. However, I have everything in writing, that my sister (the defendant in our probate case) said that she had been the executor since before our mother passed and proceeded to perform zero executor duties, because she wanted to inherit and control the entirety of the estate. For this probate case, we’ve been in litigation since September 2022, although the court has appointed an administrator. Still, had I understood that the defendant could possibly be brought up on inheritance fraud charges, perhaps, probate would’ve been ended in a short few months, rather than 2 years. So, what I’m looking for is to charge her with inheritance fraud. Deeds to both properties have been distributed. But we’re at the stage of handing personal property exchange, where 5 opportunities were setup by the court, because the defendant would not participate in the first 4. It only continues, because the defendant has decided that almost nothing is “acceptable” to her, in terms of what items she is receiving. It is for the initial reason of possible inheritance fraud and the dragging out of this case, because she is working to keep me out of my property, that I am considering this inheritance fraud, as well. I have steep costs (at least for me) in relation to this case, because the defendant has broken into my home and changed the lock, overriding the court’s approval for me to change the lock to keep her out, she has stolen furniture and she has stolen mail, on video (there are police reports). I’ve remained in my apartment, at great cost, to maintain a firewall between us, paying both rent for my apartment and property taxes for the house.

we were never married and lived only 15 months together in total. After 2 months child was born we were no longer lived together, we never had shared budget together. Now after 12 years Judge ordered to do CIS. Now we are both married (not to each other). How to fill it out now so many years later especially we have/had nothing to share? We did not even had vacations. And now all assets are shared with the current spouse which complicates everything. ANy adfice? and thanks for the video!

It is a complicated matter one you should discuss with your attorney. However one key issue is the date that you are using to fill out the asset values on the CIS statement. For example, you could use the valuation dates for any assets as of the date you broke up. Thanks for the comment on the video

It also depends on what you mean by small; in a stock market, hundred-million-dollar companies are considered small. If you’re talking about a small business with under $10 million in sales, there’s usually a better methodology to find fraud.

I have an attorney, he is not letting me speak directly with the forensic accountant that his firm chose, resulting in the forensic accountant spending time analyzing accounts that are not of importance in for what I need them to analyzed. As you said, I know my case and the history best. Is there a legal reason why the lawyer is not allowing me to communicate directly with the forensic accountant? I am being charged for accounts such as my children's savings from grandma and my new personal accounts, being looked at instead of my husband's. I'm feeling like it is just because they are looking to increase their billable hours.

My number one rule for dealing with attorneys and legal matters is: Protect Your Own Interests: While most attorneys are trustworthy professionals, it's important to stay informed about your case and ask for regular updates. If you have concerns about how your case is being handled, address them directly with your attorney. In my 40 years of forensic accounting I’ve never once had an attorney tell me I could not speak to the client directly. However, some attorneys do like to be there when the conversations take place so they can protect client attorney privilege.

Men are not angels; that's why we need a government. The government is only effective at a few things, protecting us from foreign threats and providing a court system and a police force. Early in the 20th century, charities provided most of the help to those in need. The citizens who work for charities are motivated, care deeply, and are very effective at providing aid to those in need. Unfortunately, when the government started helping those in need, bureaucrats created a system that was inefficient, complicated, and usually made things worse. Once the government became involved in programs meant to help those in need, charities stopped or cut back on their support offerings. We need to get back to a system where charities supported by the government aid people, not the other way around.

Hi Kathleen, we have performed thousands of financial statement fraud investigations; what I usually tell clients is to obtain as much information as possible that suggests there is the possibility of fraud before hiring a forensic accountant. Fraud investigations are difficult and time-consuming and usually require large retainers.

I was forced to take my own case after an uninsured driver totaled my car and he didn’t have insurance. I tried to find a lawyer but they all declined to take my case. And I get that. But that left me with only one option. So I filed it in small claims since there is supposed to be relaxed standards. Long story short I was railroaded by the judge. Rushed. And couldn’t find the sheet of paper proving I’d served the defendant. He didn’t answer. Didn’t show on the day of court. And I still lost. If I had the money to pay for legal representation I would have won in court. Hands down. But because I was a pro se litigant the judge already didn’t like me.

That’s the interesting thing with my case: I beat Harvard and their high-powered attorneys twice before two federal judges. The only time I lost was when I appeared before Judge William Young, a Harvard undergraduate and Harvard law school graduate. There was a 92% chance I would have won if my case went to trial, but somehow, the case was assigned to a District Court judge who was a Harvard alumnus.

It is very difficult to make sense of your conclusion. Most of us do not have the luxury of" having fun" spending thousands of dollars suing for justice when apparently in the state of Massachusetts, or in the federal court system,, justice cannot be found. Perhaps the message is that Harvard is corrupt, their graduates are corrupt, the state of Massachusetts is corrupt, and there is no justice in this country. Am I getting something wrong?

The point of the video is to make people aware that they can file complaints against Federal judges. However, the video also demonstrates biased federal judges and federal courts; in this case, we have Harvard, a powerful institution that controls the District Court of Boston, where a legitimate complaint against Harvard stands no chance of having a fair hearing or any justice.

Just look at how other countries do taxes. Way simpler. US taxes are so complicated and full of so many loopholes they had to bring in standard deductions and minimum tax rates.

Our tax code has many loopholes because Congress uses it as a policy tool to control citizens' actions. If they want to increase the sale of residences, they allow you to deduct real estate taxes and mortgage interest. If they want you to invest in companies rather than put your money in a bank account, they allow you to apply a lower tax rate to the gain (capital gains tax) on the stock sales. They've done this thousands of times, making the tax code extremely complex.

@@Rabcpafirm all laws are made with good intentions, but after decades of these incentives piling on the tax code it just gets so complicated that it defeats the purpose of having those incentives because of how few people are even aware of them. But fundamentally I also despise targeted tax breaks and subsidies because they encourage funds to move to inefficient sectors of the economy. The farming industry is the prime example of this, government subsidies (and sugar tariffs) have made corn so cheap that even though sugar is cheaper to produce and a better quality product, HFCS has taken over as the sweetener of choice.

Surprisingly, Federal District Court Judge William G. Young would trash both his reputation and the Boston District Court of Massachusetts. He did this to protect his alma mater, Harvard, from a lawsuit they would have surely lost and to impress the defendant's attorneys. Overall, my experience as a Pro Se litigant was very enjoyable, and I encouraged everyone to go Pro Se once. My next video on this case is going to be extremely interesting.

I would argue that the randomness or deviation from natural order is less when you find randomness applied non universally, in other words if everyone is cheating, the magnitude or severe-ness of the cheating is also a measurement of natural order. The regularity or uniformity with which misreporting is applied can contribute to Benfordness.
