People who want to claim a waterway is a p.o.s. Makes no sense for any landowner to claim the water. And that's not navigable waterways in most rivers because the water isn't even deep enough.

It’s definitely unsettled law here in Georgia. The federal government says you have a right access but in Georgia it has to be a navigable waterway, defined here as being maintained by the army corps engineers for commerce if it isn’t, the landowner can throw you off. Read about the national park service battling one landowner on the Toccoa River

Its just better to stop fishing and hunting today. Youre treated like a criminal even if you are a good person. Everyone is trying to get money out of you. The laws change so often it is very difficult to stay within the law. If you stop hunting and fishing a huge amount of $ will stop flowing into the state, the courts and the numerous agencies. You dont want to fund criminals Im guessing. If your rights are violated with permission thats what youre doing. And the non meat eaters will find out that hunters love the outdoors and respect the health of animals and Flora and water cleanliness more than any other group and this group funds all the conservation projects. Young people are falling away from fishing hunting and boating more than ever. Want to see rules that are common sense and the people out enforcing them change their aggressive attitude? Quit for a couple years

In Kansas landowners can own a river. You’re trespassing even if you kayak on it. It’s crazy but true. Farmers freak out seeing kayakers and call the cops.

It is weird how we humans are. We start fishing with a basic kayak because it is cheap and easy to get in and out of the water. Then we say, you know what would be cool! so, we add that, then we say boy if we could add this it would be great. You are just slowly building a boat.

I bet if they can't prove the own the bottom of the river I would say technically they are stealing land from the state of Georgia

Dunno how much different Georgia laws are different from TNs, but even *if* a creek/river passes through your property here, if your property doesn’t encompass 100% of it (start of creek to finish), you don’t own the body of water OR the land under the creek. Every single not-enclosed by one owner body of water in TN is public property

Home owner doesn't realize that when you buy a home on a water that boarders your property that the water is not included in the property line, but the water does determine where your property line ends. So if the water is depleted then you just gained more land and visa versa.

I guess if you want a private river you must buy a lot of land and build a river within that property. .. ? Otherwise there are no land rights to rivers. Also, rivers used to be a primary way of shipping cargo between towns/states etc. If it were private owned there could be serious issues with trade (at that time).

Georgia: Georgia’s definition of “commercial navigation” gives private landowners more rights than boaters or anglers. In Bosworth v. Nelson in 1930, Georgian courts ruled, “If the . . . owner owns upon both sides of the stream, no one but himself may come within the limits of his land and take fish there and . . . his rights to the fishery are sole and exclusive.” Translation: unless you have permission, no boating, no swimming, no wading, and no fishing on rivers and streams in Georgia even if they are considered navigable. I was shocked to find this out! Georgia is different. If that man owns both sides of the land you need his permission not only to fish, but to even travel through. Crazy stuff!!!
