This wasn't a civil trail though so Pals Graf did not apply. But in Criminal Court really he's responsible for murdering the pilots and not just other drivers on the road even in the second degree? However, because Judicial Review isnt a thing at that time, Judge Marshall cannot proceed with it because under the Constitution, such a power was not vested in the Judiciaeyry yet.
