Hi. I got a question about the penalties! I left the job in Uk and moved back home (abroad) beginning of 2022 for a family reasons and I’ve done the tax for 2021-2022 in time and after that nothing to declare but after I moved to be with my family I didn’t pay attention on many things I had a tough period and I open the HMRC account yesterday after year and a half and I see msg that I have to pay penalties for not filling the tax for 22-23! Simon, I am buying a MUFB with 5 flats. Currently owned by Ltd company who are happy to sell the company to me thus avoiding SDLT. My aim is to split the title on purchase, increasing the value as 5x individiual flats and borrowing against this higher value. The trouble with flipping in a company is that you pay Corp TaxI and then income tax/Dividend tax if you withdraw it which is particularly onerous if flipping is a side hustle and you have another job.

Hi Simon, i asked this question a couple years ago and you weren't sure of the answer, who is responsible for paying tax on rental property the owners on the mortgage deeds or names on the tenancy agreement, the reason my wife and I own a property in joint names and rent it out in joint names on the tenancy agreement we receive £12k a year, but next year she retires early from work so would it be worth signing the property over to her sole name so she won't get taxed because she will be using her taxable allowance up ??? would love to hear your response to this.

You can do a deed of trust and transfer the majority of the beneficial ownership to her. It is the beneficial owners that pays the tax. Get some tax advice as here are trip hazards here

f you're living in China and buying UK shares you generally won't have to pay UK Capital Gains Tax (CGT) on any profits you make from selling those shares. You would pay UK CGT if you were UK resident in certain circumstances

Great questions There is a 325 IHT lifetime allowance and a 175 residential nil rate band these rates doubled for married couples The 175 is reduced by £1 for every £2 over a net asset value of £2m. This is quite complex and professional advice is worth seeking

A company is its own legal entity. Self-employed references your personal tax position. A limited company will pay corporation tax and self employment will result in income tax You will need to pay to close the company even if it has not traded.

Whether you're liable for income tax on your father's UK pension funds depends on various factors, such as how the funds were structured and inherited, as well as your own tax status. In the UK, there's usually no inheritance tax on pensions when someone dies before age 75, but income tax might apply when the pension is inherited

I have a PI trust. Bare trust. I didn't get as much as I thought in my PI trust and I'm on benefits. I was told the money is for care but if I get a business I lose a third of my trust pay out and lose my benefits. My son who is one of the trustees said he can do buy to let's. A property has become available that is an absolute bargain has a great surveyors report in a rural village in a beautiful scottish village smack bang in between a few city's, I can double my money putting it back into the trust making up for the shortfall on remortgage after my son has finished doing it up. He works with a team of fully qualified plumbers electricians tilers etc. As his day job. My question is. I CAN buy it outright... But I'd rather get a mortgage on a few property's (it is written into the trust that the trustees can buy and sell property within the trust and any property's income can go back into the trust because the property belongs in the trust and the trustees can pay themselves a wage from it. Can you get mortgages within a trust for a buy to let within a are trust? If so are there any specific company's I can check out? I'm with skipton currently going through a referral to cater Allen as skipton won't pay a third party so I can't buy anything directly from the trust... I really want him to do this as the final evaluation is more than double the cost of this property... There is a reason for this as it's under a specific classification making it cheaper and as they go through the change of purpose for the classification of the building I've agreed to buy it if it changes. I wud just rather have a mortgage fronting a smaller amount of money before it's revalued. Are there banks out there or lenders that are OK doing this in a bare PI trust set up so that the buying and selling of property within my trust is OK?

A great addition to note, thank you 😀. SIPPs/SSAS, amongst other products that are pensions, sit outside your estate but only if you have nominated a beneficiary for each pension type. Failing to nominate a beneficiary means that that specific person will fall back into the estate and be subject to UK IHT.

Only just caught up with this video, Simon! What about re-investing the post-Annual Allowamce gain into an EIS in order to defer the CGT charge to a futrure fiscal year? Then, on the sale of the EIS shares, you get to use another year of Capital Gains exemptions. Furthermore, as you are selling SHARES and not a BTL property, the CGT is ar the lower 20%, and not the 28% as previously! Alternatively, invest the gain in an SEIS, where half the gain is written off and the other half deferred, so we can benefit from a lower CGT rate (20%) and get to use another year's worth of exemption. Your thoughts?

Hi- I just happened to see this video. I have couple of questions. 1. I was in UK during 2013 -2016 which essentially covered 4 tax years. I again moved to UK in Feb 2018 which I am not sure if I will be considered to be a resident for 2017-2018 tax year as it was only 2 months. Since then, I had been a tax resident. So will this gap be considered for the criteria 7 out of 9 years? Or should it be 7 continuous years in the last 9 tax years? 2. Also if I have not remitted any of the foreign income back to UK so far, can I skip declaring the income in the last tax years until 7 years ( ie, neither declaring using remittance nor arising basis) and directly report my income on arising basis from the 8th tax year in case I wish to remit the money grown/capital at offshore then?

Thank you for sharing, very interesting. Gun crimes in USA I heard about, but that they could just randomly kick you out of the country for no reason, that is quite scary indeed. I have lived in UK a long time, but then got fed up and moved to Asia. Quite an interesting (and different) experience. I have moved to Jakarta (Indonesia) because of my wife's job, and I can definitely relate to narrow roads. In Jakarta its the same, but times 10 worse! Small roads, tons of traffic and almost no pedestrian walkways. On the other hand there is the lowest crime rating in the world, but not sure it is worth it, haha. I have traveled and lived to other Asian countries, Thailand, Singapore, Malaysia, etc... One hidden gem of Asia is Taiwan. The living standards, the transportation, quality of food, quality of life, prices of everything, healthcare, general safety, it is unbeatable on many levels and is one of the best countries I have stayed in by far. The only caveat is knowing Chinese language. I have Taiwanese wife, so it helps :) And also salaries are not that great, so best work remotely there if you can. But in my experience Taiwan beats US, UK, Baltic countries and other Asian countries by far.

I don’t think this works in a global economy. Outsourcing and automation (robotics) will replace British workers to a large degree. In addition, despite the education system available the British public do not have enough skilled workers. There is a constant shortage of skilled work force be it doctors, teachers, accountants. There is an also a huge shortfall of drivers. In my opinion foreign workers do the jobs that British people rather not do. Finally wage inflation is not negative but high. The real issue is the cost of living that exceeds wage increases. That is being seen more in the UK than most countries.

As an employer we do hire British people but usually second or third generation foreigners. The reason for that is that they are more reliable and committed rather than expectant and demanding.

Sorry to bother you with long comment. 1) I was out of UK for a good decade but never knew had to still file tax for rental income... So recently with an accountants help finished it. 2) From now I want to do it myself as it is very expensive every year and also I moved back to UK. 3) If I'm working for an organisation, have got P60... Am I eligible for filing rental income tax on my own, online through self assessment or does it apply only to self employed? Couldn't understand even after reading HMRC guidelines 3) If I'm eligible, can I still file on my own and remove accountant registration on my behalf?

Surely if the CGT allowance is an ANNUAL allowance, you should be able to sum every year's allowance according to the number of years between when you bought and sold the property, so if I bought a 2nd property for £200,000 at the start of year 2019/20, and sold it for £236,900k at the end of year 21/22, there would be no net capital gain (CGT annual allowance = 3 x £12,300 = £36,900)?

I live in Spain and I received income from a Traditional IRA distribution in the US, from a pension for the years I worked in a EU country and from a US bank interest. In Spain I paid taxes on all 3 sources. Can I get FTC on my US taxes? Do I get this by filling form 1116? If yes, do all the above go into the same category, passive income? Or do I also have a general category (for which source)?

You pay Spanish income tax on your worldwide income as you do in the US. You can use FTC to get a tax relief on US taxes to prevent double taxation. 👍

In most Tax software you would enter the different categories of income and then apply form 1116 or form 2555. I cannot comment on this too much as I am not the one who does the tax returns in our firm

Yes 2015 rule worked ok but Spanish CGT is then enormous
