Must I have liability insurance if I'm only re selling already made cookies brownies etc at flea mkts in Pennsylvania?
@CottageFoodsLawsКүн бұрын
many states dont require it but I HIGHLY recommend it if you sell anything YOU have a certain amount of liability and you should protect yourself, if not you can be personally sued.

Where can I learn more about hot sauce? Because I’ve been told that if it’s strained and bottled it’s fine, because it falls under flavor vinegars, but if it’s chunky and not strained it doesn’t. Just wanna make sure I’m following the right laws.

Tennessee allows sale of single cut fruits and vegetables. Example, you can sell a head of lettuce, not shredded lettuce. Also drying your own produce for making spice blends. They'd have to be dried whole and then crushed. If you chopped your peppers before drying them, then it is not allowed.

North Carolina stands out among states with its unique approach to home food processors. Unlike other states with specific laws overriding federal restrictions on home-based food sales, North Carolina lacks such legislation. Consequently, their home food program operates in a legal gray area, potentially subject to shutdown. Despite this, the North Carolina Department of Agriculture has long supported and educated home-based food businesses, showing more leniency compared to states with formal cottage food laws. The state’s program imposes several restrictions and involves a lengthy application process. Approved home processors enjoy significant flexibility regarding what, where, and how much they can sell. A key restriction is the absolute prohibition of pets in the home, even during nighttime. Applicants must draft a business plan and, depending on their products, might need to undergo product testing or complete an acidified foods course. Following application submission, a home inspection is required before business operations can commence. While the application and inspection are free, additional requirements might incur costs reaching into the hundreds of dollars. Once established, home processors in North Carolina can sell unlimited quantities of non-perishable goods at any location, though some items may require lab testing for approval.

Do I need a tax receipt to operate a cottage food business from home ?
@CottageFoodsLawsАй бұрын
there is no mention of taxes under cottage food laws BUT income if your selling say 20,000 worth and it costs you $10,000 to run the business the $10K should be claimed as income on your taxes.

Can I sell my spices from Michigan anyone ?
@CottageFoodsLaws28 күн бұрын
Yes, you can sell spices from home in Michigan under the state's Cottage Food Law. Michigan’s Cottage Food Law allows individuals to produce and sell certain types of food from their home kitchens without needing a license or inspection. Spices, being non-perishable food items, fall within the types of foods that are allowed under this law. Here are some key points to consider: Labeling Requirements: Your spice products must be properly labeled with the name and address of the producer, the name of the product, the ingredients in descending order by weight, the net weight or volume, allergen information, and a statement indicating that the product was made in a home kitchen not subject to inspection. Sales Venues: Cottage food products can be sold directly to consumers at places like farmers' markets, roadside stands, and directly from your home. Online sales and wholesale distribution are not allowed. Annual Sales Limit: There is a cap on the annual gross sales of cottage food products. As of the latest update, the limit is $25,000 per year. Compliance: Ensure you comply with all local regulations and zoning laws that might affect home-based businesses. If you plan to sell spices, it's a good idea to familiarize yourself with all aspects of Michigan's Cottage Food Law to ensure compliance and successful operation of your home-based business.

So salsas cannot contain garlic? Or can salsa have garlic as part of the ingredients?
@CottageFoodsLaws28 күн бұрын
In Texas, the Cottage Food Law permits the sale of certain home-produced food items, but there are specific restrictions regarding low-acid canned foods, including salsas, especially when it comes to ingredients like garlic. Key Points: Low-Acid Foods: Salsas are considered low-acid canned foods, and the Texas Cottage Food Law does not allow the sale of these types of products because they can pose a risk of botulism if not processed correctly. Garlic in Salsa: Garlic can increase the risk of botulism in canned foods if not properly acidified. Therefore, salsas containing garlic (or other low-acid vegetables) are not allowed under the Texas Cottage Food Law. Allowed Products: You can sell certain types of foods that do not require refrigeration for safety. These include baked goods, jams, jellies, dried herbs, and spice mixes. If you want to sell salsas or other low-acid canned foods, you would need to follow the regulations for a commercial food establishment, which involves proper licensing, kitchen inspections, and possibly adhering to specific food processing guidelines.
