Hello, I have photos taken in October 2023. It gives an error when entering the date in Excel. Is it not possible to process because it is the previous year?

I love your composition. One thing I would recommend is using Noise Reduction to clean the grain in some of the darker areas shown, like the hard grain on the navy chair at 0:45

I’ll answer as though I’m telling this to myself when I first started - shoot everything you can for practice, but your portfolio should have the things you WANT to shoot. If you don’t have access to those things - that is where you determine the first steps in marketing yourself and getting access

Work for hire almost always means that whoever is hiring or employing you holds the Copyright. You'll need to review the agreement terms carefully and contact an attorney for legal advice though.

Saw this come across my feed and felt to tell you the video is INCREDIBLE!! You have a wonderful eye for getting food sight lines. The only thing I would change is the music. It's really going to depend - there are a lot of variables. I would recommend reading the AP Almanac pricing guide to get a good sense of going rates.

Thanks Jordan! I was able to copy the file names to my notes app in mac by using paste and match style and then copying that list to Google sheets to avoid paying for Excel.

I don't understand the question, sorry. Font? You can name them whatever you want just be mindful of the number of characters you use. Ultimately, the Copyright office only cares about the image itself. Personally, I use this naming convention when delivering to clients as well so it works for me.

A good topic to cover is what to do AFTER your photo has been used and you have not gone through the copyright work. I'm learning how important it is to now copyright my work in a timely manner through the copyright office. But, what do I do once a client has not paid and has/is using the photography but the images are not officially copyrighted? Other, than call an attorney and you then give all monies to them...

*WATERMARKS:* Though timely copyright registration is *critical,* including one or more watermarks (logos), copyright attribution with your URL/social media handle, robust metadata, licensing information, and/or other *“Copyright Management Information” (CMI),* part of US copyright’s DMCA, *reinforces* your creative & legal rights. CMI can be subtle & transparent and positioned in the corner of a photograph or artwork; it just needs to be readable to the average person to be legally effective. US-based copyright infringers, who *knowingly/intentionally remove, cover-up, or change CMI*with AI, apps, Photoshop, or any editing software to hide their copyright infringements or induce others to infringe, can be liable for the photographer’s actual money damages and lost profits OR $2,500 to $25,000 in statutory damages PLUS attorney fees & legal costs (at the court’s discretion). A timely registered copyright claim is NOT required to pursue CMI violators. See 17 USC §§ 1202-1203 (part of copyright’s DMCA). If you don’t include CMI (or a website strips your metadata), copyright infringers could argue that their infringing actions were “innocent,” as they didn’t see any copyright identification affixed to your posted photographs. If a federal court accepts that *“innocent infringement”* defense, your statutory damages could be as low as $200 (17 USC § 504(c)(2): Statutory Damages). On the other hand, copyright owners can *statutorily defeat* (bogus) “innocent infringement” defense claims by including CMI to their posted media (17 USC § 401(d): Evidentiary Weight of Notice). Including multiple CMI helps keep photographs from being “orphaned,” i.e., the copyright owner can’t be located, even with a reverse-image search. *Intentionally removing CMI can suggest WILLFUL copyright infringement to a federal judge.* If the work was timely registered, the infringer is now facing two causes of action: Copyright infringement + a CMI violation = up to $175K in statutory damages + attorney/legal fees.* See Agence France Presse v. Morel). Copyright attorney, Andrew D. Epstein, writes, “We recommend always attaching a watermark or other copyright management information [CMI] to all works that you distribute. Although you do not need to have a copyright registration to recover under the DMCA [CMI], we always recommend [timely] registering your photographs with the Copyright Office to be able to qualify for maximum awards for copyright infringement ($750 to $150,000 per infringement, plus costs and attorney’s fees).” Timely copyright registration + including some CMI really, really count!

23:10 *Titling Photo Images With Just Numbers:* Jordan, wonderful of you to share your published photograph registration workflow! And unlike you, me, and others, many photographers skip including/listing their content titles (photo names/titles) when preparing their registration applications. Though there’s nothing wrong naming your registered published photographs as a set of numbers (dates), those images are not likely searchable in the USCO’s on-line Public Catalog database. Consider the following situation: A third-party comes across one of your registered photographs that’s missing metadata, a watermark, or isn’t showing up in a reverse-image search (re: orphan status). Eager to find the copyright owner to obtain a license, the party contacts ASMP, the Copyright Alliance, and other professional photo/IP associations for assistance, and is told to search a variety of sites especially the USCO’s Public Catalog. Using the USCO’s text searching features, the party enters a “written description” of your image. Since your images are identified (titled) by a long string of numbers, your images won’t likely show up in a text search. In another situation: When my copyright litigator or I contact a non-Fair Use infringer, we’ll include my Certificate of Registration and photo file numbers (text description + short number) and a pin-point link to the Public Catalog (or screen-capture). Infringers can easily see that the unlicensed image appearing on their website matches the text description listed in the Public Catalog (and in my Certificate of Registration). Along with my timely registered work, this text naming convention reinforces my creative rights and helps push copyright infringers to settle out of court.

I typically shoot in Raw. Slider length - honestly a small slider is sufficient. 2-3 feet max.

*Registering Quarterly:* Timely registering published photographs every three-months (quarterly) might work well for some photographers, and not so much for others. What happens when a photographer gets swamped with client work, family, friends, and personal matters and either forgets or they didn’t have time to register their published images within the three-month timeframe? It’s easy to see a photographer making mistakes preparing the registration application and/or deposits when they’re rushing against the quarterly deadline. On the other hand, registering published photographs more frequently, like once every two-months, may benefit photographers, as they would have an extra month to register. Aside from a photographer’s business & personal delays, there can be interruptions at the USCO that may cause photographers to miss timely registering: 1) The USCO’s on-line registration portal may be off-line for maintenance during weekend (evening) hours; 2) In some (rare) situations, the eCO system might have trouble accepting applications and/or not allowing deposits to be uploaded; and/or 3) The USCO is not responding to your calls or email for immediate registration assistance or it’s a federal holiday. When I searched the USCO’s Public Catalog, it’s not unusual to find registrations of published works that just missed their three-month deadline by a week or less, and that can jeopardize the copyright owner’s ability to push infringers to settle out of court. Waiting till the last day in the quarter to register your published photographs can be risky. By registering your published works ever two-months (or more frequently), you have a safety cushion to get your images timely registered.

*Timely Copyright Registration For Published Works:* The copyright statute states that a published work must be registered within *"three-months"* of its first-date of publication, rather than “90-days,” to be eligible for statutory damages and possible recoupment of attorney fees/legal costs. See 17 USC § 412(2) (Registration as prerequisite to certain remedies for infringement). FYI: There’s an oddity in the following consecutive calendar months: February (non-leap year) has 28-days + March has 31-days + April has 30-days = 89 days! This 89-day peculiarity will occur if a work is first-published on any day in February’s 28-day calendar. So, if you rely on the incorrect “90-day” window to register your published work AND your registration timeline falls within the above months AND you wait till the last day to register (the 90th day: 3-months plus one-day), you’ll be one-day short and unable to pursue statutory damages and potential attorney fees and legal costs against infringers. If your retained attorney specifically advises you to register your published works within 90-days, and you miss timely registering, that’s a potential malpractice action against your attorney. To be accurate, photographers/creatives are encouraged to use the language *“within THREE-MONTHS of first-publication”* instead of 90-days to identify the timeframe to have a timely registered copyright claim.

Very impressive! To shoot such a big space with so many different light temps, is not easy!! did you get multiple exposures, (HDR) then blend by hand using amongst other many programs, luminosity masks panels...? or did you use strobes as well...? Thanks!

You can upload directly through the website. I believe you can mail them in if you want though.

Or is the upload enough?” If you’re registering digital photographs AND you’re using the eCO (the US Copyright Office’s/USCO on-line electronic system) to register your images, you only need to upload one copy of each photograph. This is the preferred way to register your digital photographs. If you use US mail or use FedEx to delivery your images to the USCO, it will typically take MUCH longer (months???) for the USCO to process your registration application and mail your Certificate of Registration to you.

Jordan!! This video is outstanding! One quick question though - when you include the metadata dates created into the file names, those dates often wont match up with the dates the images were actually "published" (i.e. delivering to a client, posting to portfolio, sharing on social media etc.). So does that technically impact the way we would populate the third column in the Excel template? For example, what if we had a shoot at the end of December 2023 but didn't publish the images until January 2024. Which registration would those images be included with (2023 Q4 or 2024 Q1)?
