It's pretty clear from the discussion that Roberts made his opinion and that footnote ambiguous enough that these highly trained legal minds are sent off chasing their tails and counting Angels on the head of a pin. To us regular English speakers, the term "public record" has a fairly well understood meaning. Trump vs United States was not just wrongly decided: it was CORRUPTLY decided.

What I have learned from the last few years of Trump’s trials and the law is: the law is intentionally imprecise and justice depends on the moral and ethics of people involved. If the parties are immoral or if driven by egotistical underpinnings, justice will never be served. The legal gymnastics that goes on taxes even these bright lawyers minds. If there wasn’t a bottomless pit of monetary funds in the Trump case, would we really be at this point in this discussion? Lawyers and judges are not talking about the crime, they are talking about the prosecutors personal life (GA case), or the validity of an appointment.

I'm unclear about what constitutes "the public record". Suppose the president, on a public visit to a supermarket, sticks a candy bar in their pocket and doesn't pay for it when leaving the store. Not allowing a Secret Service agent to testify about what they saw could be justified because the president and the agent are in the Executive branch. But what about the store owner who saw the event on a security camera? He's not in the Executive.

Sorry Ben Wittes. I think you have misunderstood what this Supreme Court thinks of the written law or previous Supreme Court’s rulings. Thomas Jefferson once warned of a Supreme Court which would treat the law as “wax in their hands” to manipulate as they wish to have it instead of what it actually states.
