I love Prop 13. I have been in the house for 30 years and still paying taxes largely based on the purchase price with a 1% or so yearly increase in the tax bill.

This video is literally a godsend. My mom lives in L.A. and is in poor health and qualifies for Medi-Medi. I moved to Portland, Oregon 33 years ago and comparing the benefits between the two states is mind blowing. I think there is another definition for “re-settler” - a California native who moved away for many decades and plans to move back to California.

Great video! One thing I think worth mentioning is the Capital gains tax on sale of home with the $500K exclusion at Fed and State level. Works in your favor if only $500K gain but against you heavily if the excess gain triggers your income to move up several brackets and thus you can be paying another 9-12% on the excess gains on the CA side. Not uncommon for a house bought at $350K and sold at $1.5M. That severely taxed cap gain portion above the $500K exclusion in this scenario is $650K which gets hit already at 15% and then a portion at 20% by the Feds and the gain automatically throws you into the 9.3% California tax bracket without even considering other income so you may jump into the 10.3% pretty easily.. this was based on joint tax tables 2023. Maybe a video would be good on CA gets you on this on, eating away your Cap Gain profits. Additionally there are a series of “Transfer” fees when selling at the State, County and sometimes City level that further eat away on the gains of a real estate sale. Don’t know how this all compares to other states with similar income tax ranges so your mileage may vary in that case. Hopefully I stated all this correctly here.

3:00 probate in CA is based on the GROSS VALUE of assets! Whoa!. That means regardless of any debt you carry the fee is based on the asset value NOT the net worth!

I think what you're saying is- California is a good place to retire IF you already live here and own property in an area where property values have gone up and are valuable. I grew up in San Gabriel Valley. I couldn't afford to live there now without selling my current property. I now live in a valuable area of San Bernardino County where home prices (07/24) are higher than I would pay, but many rural areas in California are affordable still today, especially when you price in, as Cunninghamlegal has pointed out, the climate and AMAZING natural beauty California has. To me, it is pretty priceless. I've never lived anywhere else so I'm not one to compare, but waking up to the sun, beautiful mountains, weather that calls you outside, beaches, rivers... How much is that worth? I'm blessed where I am, not letting our crappy politics kick me out, and have no plans on leaving.

That is not a requirement to be a Trust Protector, but you will need a U.S. Trustee if you have a US Trust and you are not a United States citizen residing in the United States or a U.S. permanent resident.

If the transfer is a “proportional interest transfer”, then there should be no reassessment. This means that the transferors of the property to the LLC must be EXACTLY the same as the “members” or “shareholders” of the LLC. I've been trying to get my father to make a will, since he inherited property from my grandparents. But he is deaf and can only communicate by ASL. Are there any attorneys that are also fluent in ASL or would we need both an attorney and an interpreter? Also, there is a lot of legalese that would need to be explained to my dad for him to understand that all these things mean. Do you have any recommendations?

What if the will, banks and probate is being transacted overseas, in order that the net inheritance can be delivered to the USA? Is the money then free of any additional legal reporting? Currently, my inheritance is being held at an overseas bank which has a fixed rate of payment required before the inheritance can be wired into my local credit union here in Oregon or to another credit union which I have an account at in California. Is it then free to be used and placed into a living trust here in California or Oregon? I spoke with one of your staff about my challenges and have not yet heard back about whether you may be able to help me. If the trust is used solely for ease of liquidation of the primary residence compared to probate, and all other financial accts pass outside of it via beneficiary/POD designation, what is the best way to provide ready cash for the trustee heir to use for legal assistance, maintaining the home, any tax liability and so forth ? A separately funded trust bank acct?

Typically, all cash accounts should be in the name of the trust. If the person who created the trust remains the sole trustee until death, sometimes there can be a bit of a delay in getting a death certificate. However, in many situations the “successor” trustee will start serving as trustee or co-trustee with the person who created the trust before the death of the person who created the trust. In that situation, there should be no delay in access to cash accounts.

After I cashed out a lump sum, I still have about $760k left, but at this rate, and with how the market is (we were putting money away in an index fund), I’m starting to get really worried.

I'm 61 and retired about 3 years ago, 15year mortgage was paid off in 10 years. I have lost 45 pounds, and my blood pressure has dropped into normal range. A take a walk or bike ride almost every day. I make music and art, garden, cook, read, write, travel, and get to follow my muse wherever it may lead me. I haven't been this happy and healthy since childhood. Retirement is paradise to me.

Typically, estates with over $1M+ in Net Worth (all assets including retirement accounts, investments, real estate, etc.) see the most benefit from the tax planning that we are able to do with estate planning strategies. But avoiding probate is one of the key factors for creating an estate plan!

Great video. For all the hardships of subsisting on SSDI, it's worth it to me because of the Medi-Medi care, full variety of healthcare services available for my chronic psych and physical needs. I grew up and have lived here most of my life, so I'm accustomed to the natural beauty, diversity of people and their cultural contributions, diverse cuisine options and fresh foods galore, the social commitment to and respect for education, and a friends network I would be loath to abandon, even while many of my dearest have moved elsewhere to raise families and nearly all my family in the region died off.

"Pros"? You gotta be kidding me! I lived in Crazy-fornia for 35+ years and relocated out as soon as I was able (10 years ago). The inmates there have LITERALLY taken over the asylum. Ever increasing taxes and bonded indebtedness by the left-wing (Democrat) state government; adding more benefits & services for illegals (oops, I mean undocumented immigrants). Governor Gavin (The Nuisance) Newsom--Nancy Pelosi's great nephew through marriage--is back living in the 1970's, knowing only how to increase taxes and the size of government. Although California has the highest corporate, personal, sales and gasoline taxes in the nation, infrastructure is crumbling. But at the same time, the legislature decided to fund the "high-speed rail" train to nowhere pork-barrel project, which ballooned from its original budget of $25 billion to nearly $70 billion, at last count. They finally gave up and suspended the entire hairbrained project. Air pollution, urban sprawl, homelessness, crime and gang violence are all out of control. We said, "Enough!" and relocated to *******, and have never had any cause to regret our decision. Our adopted home has a much smaller, less intrusive state government, along with modest, reasonable taxes, and is VERY friendly to retirees. And the violent crime rate is minuscule compared to CA. People here can still leave their cars unlocked at the local shopping mall--I don't, too many years of living in CA, I guess. Any middle class people that still persist in staying (or retiring) in California deserve what's coming to them. Personally, I think you must be on the payroll of the California Chamber of Commerce.

You forgot to accompany those beautiful pictures of the mountains in California with the corresponding fire insurance bills. I’m paying $11,000 a year for fire alone. That doesn’t include any other property damage or earthquake insurance.

Up until recently, I was dead set on moving to Henderson/Summerlin, NV in 14 years at age 60.5. Then I kept reading about how bad the healthcare system was there. Now I'm thinking it's not such a great idea to move from a quality healthcare city (San Diego) to one of the worst during a time when I'll increasingly need healthcare more. So I'm thinking I'll stay.

For example, if I sell $50,000 of stock (assuming $40,000 is the capital gains, $10,000 cost basis). Does this $50,000 count income for this year? In other words, if I have $20,000 of income from interest and dividends for this year, is my income $70,000 ($50k + $20)?

California does have a capital gains tax, but unlike the federal government, California makes no distinction between short-term and long-term capital gains. It taxes all capital gains as income, using the same rates and brackets as the regular state income tax. Bonus depreciation, which is generally taken after the Section 179 spending cap is reached, will continue to phase down from 80% in 2023 to 60% in 2024. Bonus depreciation will continue to ramp down for ensuing years: 40% for 2025, 20% for 2026, and 0% beginning in 2027.

Every state is different on tax of IRA withdrawals. For example in MA you get a tax deduction when contributing to 401ks but not IRAs so upon distribution you pay tax on 401k withdrawals but only pay tax on the IRA gains not the contributions to the extent they were already taxed in MA.

"Could you?" is a different question than "Should you?". For accounts, theoretically yes. For real estate, this is state specific. Assuming you were in California, you could use a revocable transfer on death deed. However, this has significant downsides that we discuss in other videos (property tax reassessment, subject to creditor claims, disputes, and complexity with joint ownership, to name a few). Again, it’s a question of “should.” This is the value that a savvy estate planning lawyer can bring to your matter.

I'm a lucky one. Live in Northern Calif. Decided decades ago after divorce to live way, way below my means and save and invest. The small city I live in is more affordable rent-wise and safe. Retired 4 years ago and living a level of freedom that can't be articulated, it has to be lived to be fully understood and appreciated. I answer to NOONE. No boss, no wife, no girlfriend. People ask how I've achieved my financial stability, and I reply, "I never re-married." Smiles!

The Medicare Income-Related Monthly Adjustment Amount (IRMAA) is an additional charge on the premiums for Medicare Part B (medical insurance) and Part D (prescription drug plans). This surcharge is imposed solely on Medicare beneficiaries whose Modified Adjusted Gross Income exceeds $103,000 for those filing individually or $206,000 for those filing jointly in 2024.

If there is a “formal” probate in California, the State of California is entitled to reimbursement from the probate estate.

Retirement in Canada, it can be pricey, but there are definitely affordable areas outside the big cities. Plus, no state tax on Social Security!

Earthquakes are a risk, but honestly, the fire season here in Arizona is getting out of control too. At least California has beaches to cool off at!
