We don't know why they divorced, whether they had kids, or what she actually did in the marriage. The ex came out pretty light.

I've done some research and by far the best way to avoid a messy divorce is to NOT get married.

Hi, I have a question for a friend of mine Who is a Filipino citizen currently living in the Philippines and has been separated from her husband since 2010. They got married in the Philippines and her husband is an Australian citizen. They’ve been separated for 15 years because her Australian husband was both physically and verbally abusive to her. She has photographic evidence of the abuse. He has a mental illness but never took his medication while they were married. She has been trying to get an annulment in the Philippines for about 15 years now, has spent thousands and thousands of pesos on two different attorneys in the Philippines, but still no luck. And her separated husband has never cooperated, even though he apparently has moved on many years ago, is back in Australia and has had other relationships with other girls since that time. Meanwhile, my Filipino friend has been stuck living like a prisoner unable to move on with her life for the last 15 years. So the question is how can she get divorced from the Australian guy if he is not cooperating in the matter, and help in the divorce be recognized in the Philippines? I mean, she can go abroad and legally get a divorce in some countries, but in the Philippines for divorce will not be recognized and get in legal trouble there.

There are cases and cases, Not every partner is abusers, sometime there's no more feelings in the relationship and that's the cause they separate, both parts needs to be mature and responsible for their acts, if your partner doesn't give permission, just accept and life goes on, no child deserves to be raised without a father

What I do not understand is why children will still end up in the custody of a mentally unstable mother using the system to segregate the mentally stable father from the children. Australia needs to really re vamp the domestic and family violence system and start mentally assessing the mothers who place orders on men because men who are on disability pensions and men who are financially fit are the highest percentage of people who get accused of domestic violence

Hey Hayder, I have a difficult situation, my son is born overseas in Slovenia but my ex is not giving me access to my son I am born in Australia, and my ex and son were born and live overseas. I was overseas recently staying with my ex in her apartment so I would not have to pay for accommodation thinking over the years we had a good relationship chatting online and things were going great. Anyways she agreed and I moved in (stupid move) things were ok up until mid through my trip when I went to another country where I have a family to visit and she replied you are not welcome back, she then decided not to give me access to my child because she said I wasn't engaging with my son enough I was belittling her and telling my son how bad of a mother she was and saying that my son doesn't want to speak to me because of it, I initially didn't see my son for 5.5 years and this was the first trip I made after 5.5 years when my son was 3 years old and like I mentioned everything was ok but then this happened, how do I get access to my child, I am now back in Australia.

Hi Mark it sounds like your child is currently in Slovenia. If that is the case, you would need to start legal proceedings in Slovenia to get access to the child. The courts in Australia will determine that Slovenia is the appropriate jurisdiction to deal with such a matter. We are uncertain as to the custody laws in Slovenia, so you would need to do some research and speak to a lawyer there.

Hey Brother my partner and I are currently going through the family law courts trying to obtain custody of our daughter back from maternal grandmother. We are fully recovered drug addicts both work full time and are having a hard time trying to get her back. We do hair follicle testing and urines and D.A counselling, is there any advice you could give us please mate?

Hi Ahooks, it really depends on the orders that have been originally made that gave custody of your daughter to the grandmother. It sounds like you are on the right track - the testing and the counselling will show the court that you are on the right path. Make sure you take a proactive approach and accept any time arrangements that get presented to you. It will probably be a slow process but you will get there.

Yes this is possible, you will need to establish that the Australian courts have jurisdiction to get a divorce order: You are able to get a divorce in Australia even if you were married overseas if one of these conditions apply to you: 1. You or your spouse are an Australian citizen, or 2. You or your spouse think of Australia as your home, or 3. You and your spouse normally live in Australia and have lived in Australia for at least one year immediately before applying for a divorce
