There is a lot of information in this video that conflicts with my understanding which is as follows: Under the Basic Agrarian Principles law foreign individual cannot legally lease (or buy) land and build on it (an Indonesian individual can) but a foreign investment limited liability company (PT PMA) can if the land and building investment value is greater than IDR 10 billion and it obtains a ‘Right to Build’ title (Hak Guna Bangunan). (Nominee agreements are illegal as are any constructs that attempt to give foreigners rights that are only available to Indonesians under Indonesian laws.) A leasehold (Hak Pakai meaning ‘Right to Lease/rent) never confers ownership rights. It’s simply a long term rental agreement that confers, as the Civil Code states, “the right to have full enjoyment of a property which belongs to another individual” so therefore there is no ability to sell for a profit later any more than a lessee can sell a leased property in a Western country. They can only sell the remainder of the lease period, if the owner agrees and if the buyer is a resident of Indonesia as the original lessee must be. A PT PMA cannot under any circumstances obtain a freehold title (Hak Milik meaning ‘Right of Ownership’), it cannot be used as a vehicle to obtain a residential home for one or more of its shareholders (there has to be at least two and one, the Director, must live in Indonesia) and it cannot run a short-term rental Airbnb type business as KBLI licenses for that are reserved for Indonesian micro, small and medium businesses. (a 68-year-old Australian man was deported from Bali recently for doing exactly that while living on a PT PMA investment KITAS - see the Sanur Weekly No. 650, P 24). If the above points are incorrect then please advise exactly what laws make them incorrect before anyone is tempted to risk their life savings based on possibly misleading information.

This video is rather misleading in several ways and offers no real information. Firstly, the intro text says “In this video you’ll discover…..” but not a single thing in the list was mentioned in the video. Secondly, Bali is not a nation, it’s an island province that’s part of the nation of Indonesia, it’s nowhere near the second most visited ‘nation’ in the world and neither is Dubai the most visited. The most visited nation in the world in 2023 was France with 89.4 million foreign visitors, Dubai comes in about 27th with 15.37 million and Bali had just 5.27 million foreign visitors which, if you want to consider it as a ‘nation’ puts it in 49th position behind Cambodia which had 6.6 million but a more comparable holiday island would be Phuket (it's 1/10th the size of Bali) which had 8,376,464 foreign visitors. Thirdly, and most importantly, as far as I’m aware there was no new law introduced last year that enabled foreigners to invest in freehold property and prove legal ownership either “through their passport” or any other way but, if there was, then please let me know the name and number of it because if it does exist then the entire land mass of Bali will be snapped up by foreigners within months. My understanding is that under the 1960 Agrarian Principles Law neither foreign individuals nor any business entity can obtain freehold title - it’s called ‘Hak Milik’ or the ‘Right of Ownership'. Individual foreigners are only allowed to lease a completed property, but are not allowed to lease land and then build on it, while companies can obtain a 'Right to Build' title (Hak Guna Bangunan) over land for an initial period of 30 years and then build on it (either the State or the Indonesian citizen owner retains the freehold title and owns the buildings at the expiry of the HGB title which can be extended but not indefinitely) so if I'm wrong then please let me know in which way by quoting the relevant legislation.
