Question ? One of my tenants wants to move out and are giving me a 30 day notice. Do they need to pay rent for the month ? No contract month to month
@dangeroreilly2028
@dangeroreilly2028 22 күн бұрын
In Ohio, it is expected that one gives the other the notice not to renew in writing. Also, a "month's notice" doesn't mean June 10 to July 10. If rents are due the first of the month, a month's notice must be given 30 days before the next rent is due. So if a tenant gives a month's notice on June 15, he owes the full month of July rent. Of course, unless the 2 parties come to some negotiated agreement.

I'm in North Carolina been I'm home 4 years no lease landlord want give one he told me from day one rent due on 1st late on 4th now he texted 3 days before rent due mad for personal reasons and trying charge a 75$ late fee one day late is that legal rent is 700 a month
@SlanepropertiesLLC
@SlanepropertiesLLC 21 күн бұрын
It’s not legal to charge a late fee before rent is actually late. In North Carolina, fees can't be imposed until rent is 5 days late. Document everything and consider contacting your local tenant rights organization for assistance.

Absolutely! As a landlord, you can update lease terms, including utilities and rent. Just make sure to follow local laws and communicate changes clearly with your tenants. If you're unsure, consult with a real estate attorney or housing authority. Keeping open communication can help smooth out any adjustments. Good luck!

Without a lease, you might be a month-to-month tenant. If you're short on rent, your landlord could ask you to leave with proper notice, depending on local laws. Talk openly with your landlord and seek advice from tenant advocacy groups or legal aid. Also, consider negotiating a payment plan to catch up on rent if possible. Good luck!

We are a tenant and have been for 10 years. The landlord was an elderly woman who was taken advantage of by a prior tenant she was offering a lease option. The house was gutted so we agreed that she would give us 23000. To apply when we decided to purchase the home as compensation. We agreed and spent thousand putting in a kitchen, flooring, painted, put in cabinets etc. Did landscaping well a lawyer came buy and told us she was incapacitated and he was the guardian and wanted the lease. I told him about the 23,000 that was owed and he said he would look into it. Are we going to get screwed? We own a flooring contracting and are considering getting a mechanics lein to protect the money we put into this house. We have evidence of all work and the state of the house before we moved in.

In that case, you should document everything, attempt to communicate with the tenants, and follow local eviction laws. Once they move out, you can change the locks and find new tenants.

In Colorado, a new law just passed that doesn't matter if you're month to month or on contract with the landlord, you cannot lawfully evict a tenant WITHOUT cause now. You cannot force them out by the sheriff until you've gone to court. I'm going through this right now. My landlord's DAUGHTER is trying to evict me, she's going about it all wrong, she's not even my landlord, and if I have to be taken to court, SHE is gonna be the one who looks like the fool. Plus, I'm mentally ill, and here in Colorado, it is illegal to evict a tenant without mediation FIRST if they receive public assistance, which I do. Every state is different. Landlords can't just throw you out "Just because" in some states. The realtor showings have been exacerbating my mental illness and I'm about to go to small claims court and file a lawsuit for the violation of my right to peaceful enjoyment of the premises, the mental distress caused by all this, including all the illegal things her father (the official landlord and owner) has done to me in the entire 8 years living in the house I'm about to be booted from. All because they don't get to do showings when I mentally can't handle having people going in and out of my house. It was getting to the point where the realtor showings were almost every day and then I finally broke down and told her off. Even though I'm a tenant and I'm mentally ill, I'm not gonna be that bitch's doormat. Excuse my language, but yeah... So there's that.

@SlanepropertiesLLC
@SlanepropertiesLLC Ай бұрын
Completing paperwork is indeed part of the process, but charging legal fees solely for paperwork might not be standard practice. It's essential for landlords to be transparent about any fees and ensure they comply with local rental laws. If you have concerns about fees, I recommend discussing them directly with your landlord and seeking clarification on what they cover.

Hello my name is John. please help me understand my situation. I am a tenant and have been living in my apartment for 8 years. When I rent the apartment the landlord orally agreed to let us stay in the apartment without raising rent if we don’t bother her. We have paid rent every month and landlord was very happy with us and we were like family but all of a sudden in March she came and said the house is being sold and you have to start looking for apartment but we have 5-6 months to move as this was the agreement when we first rented the apartment. Then she has a realtor she the house and kept telling us that they going to find an investor as a buyer. I cooperated all the time but then they realtor said they quickly had a buy and that the house was going to close in 60 days and we have to go. I called the landlord and she said oh I had no idea that the house is going to be sold so fast and so if you want some money I’ll give you. I told her my credit debt is very big now because I don’t work in the winter and I have no money to move very fast to very expensive apartment for rent these days. On top of that my daughter has depression and OCD who lives with me and I cannot force her to move. Where will I go? Everything is so expensive right now. Can you please tell me what to do. I am a good person and never want to bother anybody. The landlord now tells me that she is not the owner but a manager for the house. I am stuck. I have borrowed some money from my friends and paid some bills but it takes time for credit to go up. The realtor who is selling the house also promised me to find an apartment for me is not helping. I appreciate if you tell me what are my options I really need help. I am in NY

I’ve been living in this house for six years and for the last 4 1/2 years we have had a lease, but for the last 18 months or so there has been no lease. I live in New York State. What problems as a tenant will I run into? Do I have any rights? I don’t see an eviction coming in the future, because we are always on time with our rent, but I’m kind of concerned that my landlord has not given me another lease. Do you have any input on this, that could help me? Thank you very much.

Without a lease, you're likely month-to-month, offering flexibility but also potential changes with proper notice. You still have rights regarding habitability and notice. Discussing a new lease with your landlord could provide clarity and protection for both parties. Communication is key. Best of luck!

Lease expired? Doesn't it go month to month?
@SlanepropertiesLLC
@SlanepropertiesLLC 3 ай бұрын
It depends on the terms of the lease agreement. Some leases automatically convert to month-to-month after the initial term expires, while others require a new lease to be signed or may have specific renewal conditions. It's always a good idea to check the lease agreement or consult with the landlord to clarify the situation.

My land lord owes me $9000.00 and wants me to move out in 3 months. I told him I need my money before leaving so I can rent another place but they said they don’t have the money. I don’t want to escalate things because I have 15 years living here but what can I do living in NYC?
@SlanepropertiesLLC
@SlanepropertiesLLC 3 ай бұрын
Wow, that's a tough situation. $9000 on top of finding a new place is a lot to handle. Luckily, there are some resources available in NYC to help! The NYC Bar Association has a free Housing Hotline www.nyc.gov/site/hra/help/legal-services-for-tenants.pagethat can give you advice on your rights and options, like potentially withholding rent or taking your landlord to small claims court. You could also try negotiating a payment plan with your landlord so you can get some money while staying put. Remember, 15 years of tenancy gives you some leverage. Be sure to document everything with emails, texts, or dated notes from conversations. Stay calm, be firm.
