The "Realtor" monoploly caused this 100% - so if you're not a Realtor - but still FL licensed - these cumbersome disclosures are not mandatory?

Honestly there is no point of being a Buyer’s agent. Yes there is a contract but I dont see this going well and you can agree with the listing agent, but it is not guarantee. I personally will not be a buyer’s agent with these new laws

My buyer signed an exclusive brokerage agreement with me but decided to go visit a new construction townhouse by himself a few days later. The builder refuses to pay me because he came in alone. Our agreement has not expired. Am I entitled to a compensation?

(I do not have hotline access being a non-NAR broker) Can we add an addendum to the buyer's agreement stating that "All offers submitted to sellers will have a contingency in the additional notes section of the offer contract of: " __% commission is to be paid to the buyer's agent out of seller proceeds at closing"??? That might take the fear out of signing the buyer's agreement. I don't believe offer contingencies can be governed by NAR or the DOJ. Am I wrong? But would the addendum or separate agreement be allowed?

Great video! Did you figure out how to insert that one sentence into the pre-showing agreement? Cause that was MY favorite form as well. And for me, its always been about talking and explaining ALL these things. Ill bet if more Realtors explained compensation, commissions etc to their seller's before they sign a listing agreement AND if more Realtors explained the entire transaction process to their clients in general, a lawsuit and "New Rules" would not have happened. Communicate!

Smart buyers will go directly to a listing agent. Why pay 2 or 3% to a buyer broker when you can save it and go directly. Have a lawyer review contract for a few hundred. The listing agent can be a transaction broker and represent both as per law. Buyer brokers will be out of business in 6 months

So many reasons. #1 is that listing agents aren’t going to double their workloads for free and they are not going to represent the buyer.

You do realize this is something you could have always done, there’s nothing about this agreement that changes that. Buyers could always go to the listing broker, they don’t do so, because buyer brokers act as a fiduciary for the buyer. In addition, in my experience, it’s pretty rare for the buyer just to like the first house that they see. And just give you an idea of some of the value that buyer brokers can bring, in my last transaction we were able to negotiate the list price down $22,000 in addition, I picked the buyer up from the airport took them to lunch, showed them several properties talked in depth about each area ran comparative market analysis on each home gave advice under negotiation for homes. They were interested in. Talk them through financing, talk through. Their emotions, was a sounding board in addition to setting up all the maintenance work and actually going to the properties since the buyer is out of town while we were getting estimates, talking through estimates and repairs that might have needed to be done. All I probably spent over 120 hours on it. And also let me tell you listing agents can be difficult to get a hold of, in addition they ain’t gonna do any of that work for free either and since they represent the seller, they are going to be less than willing to negotiate with a buyer. They’re not even sure is qualified..

Didn't the listing agreement always have the buyer signed with the broker compensation and was specified within the listing agreement already? So whatever the seller signed the listing agreement with the broker compensation will not count? That's the reason to sign a separate disclosure?

Hi, Juana, thank you for all the time you are taking to explain these changes. I'm beginning to understand the relationship between Section 8 and Section 10 - however, I still have some questions. A) Is the Listing Agent responsible for filling out the Seller's Broker to Buyer's Broker Agreement or the Seller to Buyer's Broker Agreement when taking the listing? If so, who else gets copies and when? Also, if seller asks advice as to whether they should choose (a) or (b) under Section 10 - what would be the main difference, other than how the compensation is being disbursed? This will be a process for everyone - so any clarification will be welcome. :)

This would be a perfect time for Florida to go back to Mandatory Agency Disclosures like they had years ago. Florida is the only state that I know of where an agent does not have to tell the buyer who they really work for. Buyers should be aware if the agent is working as a transaction broker and/or working for the best interest of the seller...before they sign anything. TB offer buyers no loyalty, limited confidential and limited disclosure. Calling these agreements "Exclusive Buyer Agreements" is grossly misleading as a consumer will THINK they are being represented by someone who will work for their best interest, when in fact they are on their own. Florida should be more worried about the consumer...

It just doesn't make sense..Confusing on options of compensation as a buyer broker. I am hoping that like most large changes it will settle down and become easier. In all industries there are always bad agents but the majority do.a great job and all parties benefit.

So we can, or cannot write in the offer the condition that sellers are to pay buyers agents commission? Maybe Im misunderstanding but at roughly 30 minutes it seemed like it was eluded to that you COULD write in in the offer, when earlier it was noted that you COULD NOT...
