No. Randy’s claim of self defense is untenable. Under Article 11 of RPC, the elements of self defense are: Unlawful aggression on the part of the victim The need to repeal or prevent an attack Lack of sufficient provocation on the person who is claiming self defense In the instant case, Randy killed someone in the presence of a police officer named John. He is the one who did unlawful aggression. Even though John shot at him first, it is because John is doing a lawful act of trying to stop him in his tracks. So claiming the second requisite in favor of him is not valid. There is also sufficient provocation on his part as he did kill someone. With all the 3 elements of self defense missing, Randy’s claim for self-defense is untenable.
