It takes 9 months. Like birthing a little baby that lasts a lifetime for $250. A trademark is the most valuable asset for a new business.

Been closer to 12 months recently. At least 6 months before the app is even assigned to an examining attorney! And much like a baby, it costs money to maintain the trademark. There are fees beyond just the $250 application fee to keep the trademark registration active.

This entire video sounds like bad advice. This comment states the obvious. On a high-level trademarking is like getting that website domain. Imagine putting together this whole website for this whole idea with this theme and brand and you never registered the website. So you build this website and then when you’re ready to ship it you can’t because you did all the work before you got the domain. So now you have to pay some Neckbeard an additional fee plus a commission to buy out the domain name. When it really should’ve been the first step you took. Pencil paper and a little forethought is virtually free. Yes for a new business there is a very strong element of the chicken or the egg. But none of these reasons suggest a reason to not trademark. Just because you can’t do something immediately doesn’t mean you shouldn’t take the time to perform it. Especially when it comes to protecting you your brand your very new infant business. 🤦‍♂️

I would never trademark a small business, such as a Plumbing outfit. or, a bakery. However, if it's an organization or something, I would trademark it just to prevent from getting sued or forced to remove it. Meaning, I'd be more interested in preventing myself from infringing on someone else's trademark. That would be the main purpose behind registering a trademark.

Very intersting! In Germany it's totally different. For 300€ you register a TM that will be granted within 3 months (normally). So if I were starting a business, you normally register the trademark 'just in case'. Better to have, and not need, than to need, and not have (Kafka). Not being '100% sure' or not being sure if you will be able to enforce it ... that's not a reason NOT to register it. 'Cause perhaps you're able in a few years when you really need the trademark.

It's important to add that you may not need to register your trademark if you're willing to bet someone else won't enforce it against you. If you put time and money into a trademark and a subsequently registered owner sends you a a cease and desist letter, you must either find a new trademark or be willing to fight a (losing) battle to keep using it.

As you evolve, the logos will change with the times. If, at some time in the future, you can trademark the new logo. One example is NBC in the 60's there was the peacock then the red and white an blue letters; now how long does a trademark last because once the trademark expires, its time to get a new one. If you are not sure about the logo, there will be businesses who will use it, trademark it and what is your defense if you have a similar logo because now the competitor starts to have a stream of income, then what will you do. if you do the trademark yourself, it will be cheaper. The only expensive part of the trademark lawyer fees is the research.

I completed TEAS couple months ago, two classes. If I get denied (due to weak tm) wondering whether to just go ahead and use the name in business anyway, unprotected, or change name completely. That’s tough because you have to prove on your specimen you’ve been doing business in applied name, so if denied you have to change ALL your packaging, branding, and waste LOTS of time and $$$ 😨. There are people out there like 50 cent who will buy small upcoming artists trademarks to sell it back to them later. Wouldnt that be a good reason to be ready ahead of time?

You’re essentially telling some people to not trademark if they don’t want to battle potential threats to the trademark, but had they trademarked from the beginning they would have eliminated most potential threats. If you don’t trademark, you become the potential threat to another!

When you are looking at who has stronger rights to a particular trademark name, surprisingly it is NOT the first person to register the trademark name. It is the first person to use the trademark name and registration service has proof of your use. It's not the only form of proof that can be provided but it is STRONG proof and it also provides notice to the rest of the world that this is my lane and I own this area of this name in this exact trademarking. People always ask this question without realizing the broader picture. Trademarks are NOT CREATED EQUAL. There are strong trademarks and weak trademarks. Same for trademark applications. You need to use the name you want to eventually trademark if you want to be taken seriously. Don't worry about someone else stealing it or filing it before you do. That's very unlikely to happen, but if you don't' start using your trademark name, it can.

You can do name and logo as a single trademark, the name must be included as text with the logo as part of it. One price to trademark both. Or. You can pay to trademark the name separate and later pay to trademark the logo, or to add the name to the logo.

If you make and sell on Amazon, you are required now to have a trademark registered with the USPTO. I have a logo, but I'm not in love with it. My plan is to just register in standard character format the name of my business. If I change my logo later, no one else should be able to use the same words with the same type of goods.....right?

Barry you missed a important issue and that is protecting your ip property copyrights based on science and technology these are published online as required. The u.s. slipped in innovation from 1 to 4 your ideas are not very correct. I used the Canadian trademark system and happy

I can’t even get past the ID me now they said that I had two accounts because I had two emails that they said it was OK and showed me how to go in and delete my other email, but it still saying that I can’t get past the facial recognition with the Colorado ID it is really ridiculous so I can’t even file for a trademark

She’s not talking about stopping someone from trying to register your trademark. She’s talking about defending your trademark against those who just use it without checking to see if it’s been registered. Oftentimes new business owners choose a business name or logo without doing any research. Those are the folks that you need to defend your registered trademark against.

Man it's just all soo much lol 😩 like if you don't use it, it's like ugh! And then if you register it, you're waiting for almost a year for approval. And you may or may not get denied. So then you're losing money. And still have to start all back over...

registering a trademark isn't always about the name recognition...although branding is great, the real reason you would want to do it is tax reduction. For example, Delaware is where majority of businesses will file because Delaware has no tax on "virtual" aspects of business....which trademarks fall under. So what you do is you file a shell company in Delaware that owns your brand name and trademark, and then you "lease" the brand to your regular company. The regular company now deducts that as business expense, getting a tax write-off....the shell company claims it as income from a virtual sale and pays no tax....bam.

Hi Robert, great analogy btw! So, when you say *Shell* company, are you referring to the *Holding* company that holds the *Operational* business that will lease the ™️ name?👈🏾🤔So, you're basically applying for the trademark thru your *Holding* company THEN leasing it back to your *Operating* company..Ok, so then the (long waiting) process of getting the trademark doesn't change but what's to stop someone else from beating you to the punch?

Check THIS out👉🏾out of curiosity, I wanted to know what is the difference between a ™️ & a ®️ and this lil ditty is what I found: Using the trademark symbols TM, SM, and ® The symbol lets consumers and competitors know you're claiming the trademark as yours. You can *use* “TM” for goods or “SM” for services *even if you haven't filed an application* to register your trademark!🤔imagine THAT!

This was sooo helpful! I am considering filing a trademark for a new preworkout flavor (I work in sports nutrition). After that, I want to pitch my idea to a bigger preworkout company for them to produce it, so that they’d then need to pay me royalties, rather than just using my idea for free. I don’t have a huge budget but would still love to do it. Would really appreciate advice!

What about a food business called “tAp quality” would that be registrable? Since the O’ is being substituted by an A’? Can play on words be used to register names that are descriptive?

I’m just starting a distillery and just starting my trade mark in Mexico it’s two hundred dollars more here then in the US quote of eight hundred and fifty dollars . I’m told that with out it I can not sell on Amazon mx by a company in Miami eccompetesolutions what do you suggest?

Nice info video. Just talked to a lawyer, who tried to talk me into a trademark. And everything else I didn't need to start manufacturing and selling my product. You just can't trust a greedy money hungry lawyer. If a lawyer can see you the same day you call them , they are too hungry . Don't trust them , they are used car salesman.

What if I T.M. a logo under my business Divine Path LLC? But then decide I don’t want to trademark Divine Path LLC but rather I want to TM my name? If I dissolve the LLC What happens to the trademark I created under that LLC? Can I transfer it to myself to the next business?

Hi, I have a pen name a created on Amazon KDP for a brand name. I kind of created a word that is not trademark nor copyrighted. If I continue to use that as my brand name with my website etc... Could someone later on file for a trademark and say it is theirs... I mean it is a great name I created :). But all of this is all very confusing to me. Thank you

Hello, Can you trademark a typeface? I have a client who request a logo icon and typeface she wants to trademark both logo icon and typeface the thing is I only tweak super small changes in the typeface can it be trademark??

I've come up with my trademark name, but my actual logo design is from Canva. I'm trying to figure out whether or not I can use Canva designs with my trademark name without being sued. Only the name will be trademarked, not the images in the logo/label.

You’re better off just trademarking the name, that usually takes priority since many business, especially new ones, will change their logo over time anyways. Unless it’s starting to take off big time, and your logo is a major key of the branding, like Apple for example, then I wouldn’t worry too much about the logo trademark for now.

Thank you for your info on this! What if I wanted to trademark a business that I have in mind and that I am committed to, but do know that in the future I want to branch the name out to add on services. Example, I start with ABC Cosmetics but know that I will want to add Hair and Cosmetics later to be names ABC Hair and ABC Permanent Makeup. Do I need to just trademark ABC only or do I still need to start with ABC Cosmetics? I hope that made sense? 😅

Ok I love the way you said the channel name! 😂 I’m looking to acquire a small liquor company, but I just want the brand name. They ran the company horrible. But I’m finding out others are trying to brand the name after this company had already started. There are other companies that have a similar word for clothing, etc… Now I’m finding out it may be hard to even give out free t-shirts because it could encroach on their trademark?

I've never heard of someone telling a business not to trademark. That's one of the first things shark tank ask lol. Is your product or company trademarked?
