UPDATE TO RULE #4: THE BAMBUSER APP IS NO LONGER AVAILABLE. Apps change by the minute, so we no longer recommend specific police recording apps. Streaming apps are best. But the native app on your smartphone is more than good enough to do the job. Long story short, it doesn't matter what app you use to record, just do it!

Any police officer who does not wish to be recorded is either committing a crime or contemplating doing so. That applies to courts as well. When any public servant refuses to be recorded while performing public service should be removed from service immediately. The first thing any criminal will do is try to avoid accountability.

@@leeroberts4850 but we are talking about public service here, why should privacy be expected in the tax funded profession that owns all use of force? Any citizen a public official ever encountrs is essentially an employer.

I bet if the cops had to pay out of thier own pockets if they were taken to court. They wouldn't be so inclined to arrest people that are exercising their constitutional rights.

They would also be less apt to harass people for minor (petty) infractions, knowing they're putting themselves in a position to make mistakes.

They SHOULD have to pay out of pocket. If I do something while I'm working that is OUTSIDE THE SCOPE AND THE RULES OF MY EMPLOYMENT, I'm personally liable for the outcome.

Shit.... even @ Mcdonalds, if you come up short on your register.... it comes out of their paycheck. Are we to assume that a Cop is more Uneducated & Moronic about his Job and the basics that his whole Job is about.... THE LAW... that a McDonalds Employee is more responsible and educated as someone who Flips Burgers or makes Change than a Cop??? Who is given a GUN ? Or a souped up vehicle and allowed to drive at Totally Dangerous and Fatal rates of high speed . . to chase someone down for blowing a Stop Sign? . . . The best one is the chase scene of 10 cops chasing a guy in a stolen car.... that doesnt have a scratch on it.... Until the Police step in to retrieve the poor victims car from the Criminal... and in the process of the pursuit , 2 people were run over..and 1 died . .. and the Stolen Car??? Well . . that was returned to its rightful owner.... in 37 Milk Crates of Wrecked Parts. . . . YEA ! " We Serve and Protect." . . . The ONE PERCENT ! -----> FUCK Those CRIMINALS with Badges ! They will put me in a Box, before THEY will put Me in a Cage... Like some Animal. Who the Fuck are THEY!? All the Police are... is GANGS with pretty Matching uniforms. john S What constitutional rights? You do not have rights in a democratic system. Also the constitution has been demolished. . All you have now are millions of statutes created by lawyers...Officers of the Court that support Bankruptcy. You are held as surety for the Corporate / Government debt. The Constitution was to place restrictions on the Government. . That has now been removed as the Government is now a foreign owned entity and located in a District of the USA it is NOT a State and a sepatate legal entity with its own laws and its own Police.. The STATES are subsuduaries of the CORPORATE entity of WASHINGTON D.C. ( Better known as the District if Corruption )

It's a right and there are no formal rules, but there are some common sense rules to help protect you from people that don't think it's a right.

There are laws though you must follow. You cannot interfere with a police investigation or an arrest. Filming isn't interfering per se, but if you are asked to step back (and are actually too close), stay put, or provide ID while operating a vehicle and don't comply, they can arrest you. The fact that you are recording doesn't excuse you from that lawful order.

constitutional rights to liberty, life and happiness. Prohibition of hemp,pot and alcohol is unconstitutional, technically any unconstitutional laws that violate the constriction/bill of rights ARE NULL AND VOID!!!!!!!!!! which basically means the government/politicians law enforcement that enforcement said laws are to be considered a domestic enemy

ballnutz or mine in Texas. I shot this guy in self defense and have. A concealed carry permit. Cop arrested me and lied said I shot this guy with a rifle and he seen me with the rifle. I really shot the guy with a handgun not a rifle and the cop didn’t see me with any rifle at any point. The cops refuse to give up the dash cam and body cam showing he lied to arrest me.

I have been told to stop filming police in Ohio and Kentucky. When I kept filming in Ky, the officer grabbed my phone, threw it down and then grabbed my arm and demanded ID. I did complain to his supervisor at the station

Had a cop try to grab me once, and illegally attempt to detain me. Then tried charging me with Battery on a LEO - didn't work and never went to court, he was just butthurt because he could not bully me, and I put him on his ass! Then to top it, he pulled his service pistol, so I pulled mine! At some point citizens will stop allowing themselves to be harassed and/or kidnapped by these badge toters and defend themselves as they would have if any other person did the same.

Ash Green he may be white. And he said service pistol as if he was also a cop. That wouldn't matter anyway because the working cop would have still shot him as he was in fear of his life so Dave is trying to sound cool. But sounds stupid. 404 Error Not Found Haha! I saw 404 error not found and thought my phone was messed up. I feel so dumb. Anyway can you sue for stuff like that because the cop will just lie and nowadays cops trump victims. This is a sad time even for good cops because they are becoming a minority.

Police misconduct is when police don't act as they ought to act, they way that they are trained to act, the way we want them to act on the job.On the job we give them permission to use more force and violence AS A COUNTERING move that we wold permit off that job. When off the job if they don't behave according to societal norms, , its just misconduct. A policeman who meets neither criteria when on the job exhibits two different level of misconduct. Part of the problem stems from expecting policemen to always be "on the job" even when "off duty". That creates a mindset and a culture alien to real civil life. That's not an excuse for acing like thug repelling invaders, just a partial explanation for how it can happen.

Rule #6: if you anticipate recording the police, for whatever reason, practice! In a rapidly unfolding situation, you want to be immediately familiar with how to do everything described in this video from starting your recording/streaming application, to locking your phone. This should all be muscle memory.

Thank you. Herein lies the true value of the internet, informing the citizens on the law and other such important matters that may have wonderful or grave consequences to all. Just knowing what you may or may not be required to do in the presence of police , when anything you may do has the chance of undermining your freedoms, can be of immense value, especially in such times as now, when the police stretch the rules when interrogating. And nothing short of having a personal attorney on scene is more vital than having and using a camera to record ALL contact. When you are able to add streaming video to your arsenal, you begin to level the field with those officers that would break the law, and in fact, you may come to overwhelm them. Use your freedoms or lose them, but be prepared to fight for them at all costs and be the true patriot, as those of Concord and Lexington, and Valley Forge and Yorktown, and all the points that defined our nation's birthplace, who committed more than just words to secure our freedoms for generations to come. It would be far more than a travesty to let their sacrifices go to waste simply because we had become too complacent, too wrapped up in our material world to continue the struggle they commenced to secure and maintain our right to be free. Freedom, that which is not physical in nature, with no taste or smell, silent and unseen, and given little thought until it is missing, or taken from us, like love, is worthy of all efforts to cultivate and nourish, to protect and to fight for, least it be gone.

I would ad 6, sue the police officers personally when they violate your rights, because when the police illegally arrest you, they don't have the law on their side, so they are acting on their own.

+crunch9876, ignorance of the law is not an excuse. If you didn't know the speed limit, you're still getting a ticket and there's really no defense unless there was no reasonable way for you to know the speed limit. Believing that what they are doing is legal is COMPLETELY irrelevant.

If you are using a lawyer that is suing for a percentage of the award (as opposed to charging you for the hour), he is probably not going to be interested in suing the policeman personally. Why? Because these guys make about enough money to pay their bills, and that's about it. Suing someone that essentially has no money makes no sense.

"Officer, if you are working within the law and your department policies then this video will provide evidence to that and would be an asset to you. If on the other hand you are violating the law or department policy then this video would be a liability. Are you violating any laws or department policies at this time?" The cops only choice at this point is to arrest you, seize your camera and attempt to destroy any evidence, or leave you be.

+Eric Taylor Do you think a cop is going to stand there quietly while you orate such a speech? Give them too much to think about and they'll arrest you just to simplify things. "I'm recording this for your protection and mine" will prolly do just fine :)

+dcs002 when someone tries to become a cop, one of the tests they have to take is a iq test. if they score too high on the test then they do not get the job. they say this is because people with a high iq would get bored with the job too easily and so by eliminating high iq applicants the turnover rate for employment is lessened which saves the department money.. long story short, you are absolutely right.. keep it simple lol.

Agreed also 110 P/C my comment was some what generalised as to how many yanks appear to have little /no regard /respect for a persons ethnic minority. If a squaddy exibits racism in the british forces it is up to their officers to sanction & clamp down hard. Most cops however, the world over are RACIST ( & THUGS)

This video should be shown to every officer around the country, and it should especially be shown in every training program for every new officer. I know it's frustrating now, but smart phones are still a relatively new thing, and a lot of older police officers haven't acclimated to the fact that almost anyone has a camera in their pocket ready to film at any time. Give it about 5-10 years and the majority of police should be educated about the laws pertaining to recording in public.

It's good to stream them, but they can still beat you up for "resisting arrest" if they feel like it. They can claim that you're interfering. Anything can be construed as interference.

#6: If you're finding yourself recording the police often, buy a phone case AND camera bag that isn't black or aggressive like the color or a gun or weapon. I've seen plenty of examples of cops that flip out when surprised by someone, last thing you want is someone with a lot of stress and a deadly weapon misidentifying your motives.

When a police officer steps outside the law, he/she loses the protection of that law. Many jurisdictions protect police from lawsuits, but only if they are acting within the law.

the Beaverton Police Department pulled me over they asked if they could search my car I told them no they Lolly gagged for five minutes wouldn't let me leave then another car pulled up with a police dog in the car they have the dog go around the car and said the dog hit on your car now we have the right to search your vehicle there was nothing in my car they kept me for 2 hours searching my car this happens to everyone in my area there is no way to tell them no because they'll say their dog hit on your car and that gives them the right to search your car

They train these dogs to react to a tap on any part of the car. Once the dog barks or does whatever they train it to do once the officer taps a part of the car then they say they have probable cause to search your car. Best thing to do in my humble opinion is to comply if you have nothing illegal in the car just to get on with your life with the least amount of hassle. Being polite and agreeable goes a long way with these folks.

One thing to remember is that when you are recording you may be recording a crime. This makes your phone and all of it's contents subject to subpoena in court and everything on your phone could be presented in public in open court.

Also, never use fingerprint scans or facial recognition as your phone's security password. The courts have ruled that law enforcement can compel you to unlock your phone using these methods, but not using an actual password.

@@---cr8nw install Tasker and set a profile for any time the phone is unlocked by fingerprint to trigger an action to relock the phone unless a gesture is swiped on the screen or you open a certain app within an x amount of seconds. That way, if they force your finger on the scanner, you unlock it and watch as it relocks because they don't know the gesture or which app will disable the action.

#5... You may be released, after due-process has taken place. That means, detainment, finger printed, ID'd, visiting the Magistrate (if its not the weekend, you may have a comfortable overnight stay and Cement Hilton if its the weekend), and agreeing to post a 2500 bail (10% usually). Either the way the state wins... Money you out your pocket, and your time wasted.

Exactly. In California it's 72 hours (3 days) to see a judge until then you stay with general population unless, as you mentioned, you have the poor luck of going in Thursday (or was it Friday) so you stay an extra day inside at your expense (no court on Sunday). That's not to mention most likely staying in the holding tanks for 24 hours or more quite literally like sardines before getting processed upstairs. Then even after getting your jail attire and going to gen population you still might sleep in the middle of the day room because of the incredible and constant overpopulation problem. One time they had also ran out of blankets so my group had to sleep in the middle of the day room and use the towels we had for bathing (4ft x 3ft) as blankets. Not fun when you're freezing your ass off on the hard concrete floor.

@@dsandoval9396 this won't always work but an acquaintance of mine has at least once in the past lied during processing about his state of health; they'll ask you questions to avoid having a room full of people become sick because they weren't quarantined or isolated. So he says he has tuberculosis or something and according to him, his stay is long but he's alone and peaceful. And this guy is no stranger to jail so I take his word for it.

I've only been to jail like 6 times, 2 were actual crimes (non-violent), the rest were bench warrants cause I was living on the street at the time and didn't find out about court dates in time. But yeah, I remember learning about that my last time going to jail. This one guy had cancer and I never saw him go upstairs with general population, either got kicked out (O.R.) or got his own room in medical. Then the last time I went I was sick as a dog seeing as I was already dope sick BEFORE getting arrested, so when they finally processed me my blood pressure was like 220 over 180 not to mention you could just look at me and think something was wrong. So they kept me in medical and boy was that sweet! Not freezing cold, your own room, no asshole CO's, day room ALL day... It was nice. But that was the last time I went and I don't plan on going back just for the hospitality in the med ward. Thanks for reminding me though... just in case.

akilla214u2c That means you were arrested. If you were arrested without probable cause or detained without reasonable, articulate, suspicion then your rights were violated and you have basis for a strong civil rights case. Checkout first amendment audits. They'll show you the way.

There are software apps that you can easily download and use to not only protect your recording, but also to keep your data from being deleted by the police. Streaming is great but not all phones support that kind of instantly continuously records your information. The offsite server/cloud is a secure recording system is absolutely necessary to keep cops in line because your data is precious and shouldn't be in the hands of police. There are apps per state that allows you to upload and send data to your lawyers office.

Always record them. That is why Derek Chauvin is in jail today, because citizens filmed him. When any police interaction is going on, everyone nearby should consider filming. They can't bully everyone.

If the police impedes your movement in any way, to investigate you with questions, and commands, you are technically already under arrest, but they don't want you to know that. You should make the agent for the bench aware that you know that, so he can read your maranda rights so that you do not have to answer any questions as they may be used against you in a court of law, be it kangaroo, statutory, or maritime military.

It's also nice to have your mobile as a collar, so you don't have to hold it --- and the police doesn't force you to drop it during an arrest so you can have more audio recorded. Bonus points for not triggering nervous policeman who think of the little mobile device as a potential weapon to bonk people on the head or be a hidden gun (to be frank, fake mobiles that can shoot bullets DO EXIST but are very rare --- but cops will mention them to judges all the time)

I have learned a great deal from watching thousands upon thousands of first amenendment auditors here on KZfaq and boy I never knew how corrupt they truly are, they know the law but hope you don't know your rights.this should be taught in highschool so the young people know off the bat their rights early in life....I guess the police are our enemy.,teach your children, they beat you up with their verbal judo and directives but I love how these auditors throw the same authoritive energy back at them and the police end up doing the walk of shame at the end lol...love it.

Any public servant can be openly filmed. Police, Fireman, EMTs, FBI, CIA, Court Officers. Anyone who's salary comes from your taxes, you may openly record/film them.

One of the biggest issues I see when I watch 1a auditors etc is when they state that they are going to remain silent.. the cops Always have a way of getting them to talk..! Every time. I’m like “Dude, shut the hell up..”. Silent means silence.

Great vid, just wished there the other side of the discussion was presented. I would like to know how they justify asking us to turn off our cameras and whether they actually believe that it's better somehow if we do not record. I work in long term care, nursing. A few years ago, coworkers were all upset over a private camera being used in a private room. I volunteered to do tasks in that room, because it didn't intimidate me. Do I do every single thing right 100% of the time? I'm sure not. But I think the family's sense of well being trumped my comfort level with the situation. And that's what I think of filming the cops as well. Public accountability trumps the small increase in stress over being filmed and scrutinized. Thanks to the prevalence of cameras these days, I don't even have to ask what they are doing wrong that they need to feel worried.

LEOs refused me recording claiming I was not allowed as I was the subject of an investigation (driver in a pretext traffic stop). But I guess that's what rule 5 is for. Covertly audio recorded, including the 8 minutes of the dog being pulled up by the leash going around my vehicle (isn''t there either a smell or not a smell) and them saying I was slurring my speech, my asking, "Am I slurring my speech now?" and their reply "Yes".

+Cookinitmax Not trying to make up their own laws, not understanding or knowing current law. Look how quickly law changes (everyday the courts decide on something which changes current law). There is no way for anyone, even the lawyers defending the public to know all the laws, ordinances and rules for their city, county or state. This is not a huge deal, it's understandable. You likely don't know every aspect and rule governing your job regardless of how good you are at it. If laws were easily understood, you wouldn't need the courts to interpret them. You are right, education is the key. The biggest problem in society today is an "us against them" mentality. If you want real change then constructively go about it. +Radly Badly said his/her friends are at odds with the positions they are in. Knowing a few cops myself, I know that these guys go to work with the best intentions and are tired of the idiots who make them look bad, but the general public wants to do exactly what they tell the cops they can't...PROFILE. Don't paint everyone with the same brush.

damn youtube i watch one video titled something like "dont talk to the cops" and my whole recomendation feed is filled with videos of lawyers and retired police saying the same thing.
