General Patton Dude, this company valued that one load of meat more than an employee's actual survival. He literally did not have the freedom to leave in their mind, hence the court case. Why do some American's have such battered wife syndrome?

+Vanguard Hard cases make bad law. This Trucker should have prepared for a winter breakdown. Also the Trucker has knowledge of his social contract with the company, meaning he knows the code of conduct & he knows what he should not violate. "Why do some Americans have such battered wife syndrome". So now I am misogynistic, chauvnistic, man-splaning, victim blaming, patriarchal man because I rule out empathy in my judical philosophy? Gorsuch valued the law then and continues to do so today.

Omar Pizarro That's right, and they don't care, they'll have someone else in the position in a New York heartbeat while your in the grave yard, and they'll still be saying that you were wrong and they were right, and a guy like this judge will act like they feel so much sympathy for you but will still throw you under the bus, who cares how sympathetic he pretends to be if he's never gonna help you even though you weren't wrong and everyone knows it, where can you turn to if not the supreme Court?

John Butts I was trying to give an anaolgy with the Truckers case by implying that candy company had no empathy for me because I was starving. It is not out of context. My overall statement is that hard cases make bad law, a legal maxim that is used often in law school. Totatlly applicable.

After being in the trucking industry for 38 years (now retired since 2015) I can assure you, in most cases, it's the dispatcher who makes the decision, like in THIS situation, and, not the company itself at the time. The dispatcher is so afraid of disciplinary actions if a load is not covered completely that they care less about human needs or human life period, as, in this situation so completely revealed. Even without climatic situations being faced by the employee most dispatchers are so over zealous to make things very hard on drivers regardless of whether they are right or wrong...and, unfortunately the company sides with the dispatcher, as, he is considered 'lower management'. The company will put some 22 year old kid in a dispatcher position and all of a sudden he apparently knows more than 20+ year driver veteran of the road....REALLY?...needless to say, I am SOOOO happy I'm retired now. That's my two cents worth for whatever it counts as!

Let me see if I understand the nuance captured in conservative thought. If a police officer fears for their life, it's perfectly fine to kill someone as a response to that fear. If a truck driver fears for his life when he's in an actual deadly situation, it's not okay for him to take actions to save his own life. Here you have the hypocrisy of conservative thought laid bare. You'll notice in both situations the conservative sides with the authority figure. In the first scenario, that's the "infallible" police officer. In the second scenario, that's the "infallible" corporation. Conservatives aren't pro-life. They're pro-authority.

no similarity at all, this truck driver situation is not a criminal situation. work is "at will" in this country. truck drivers can go anywhere and get a job, the company did what they had a legal right to do. i have driven commercial vehicles in that kind of weather. you plan and have proper clothing and safety gear to deal with those conditions. imo the failure here is the truck driver's poor planning and failure to follow procedures to keep brakes from icing.

David Anewman sometimes when your extremely tired, it's hard to stay awake., and it's hard to stay warm when fatigued. So it does happen, I've pulled over took a nap, it's an indicator of being fatigued, you start to get cold

I'm a truck driver for 11 years. I stay my ass in the southeast. I spent the night in Menasha, Wisconsin. It was 7 degrees above 0 and my 2004 Freightliner would just make enough heat for me to live. I probably would not have made it in 27 degree below 0.

I worked for trans am for 2 years and I hate that company. Questions: why was the driver not prepared for cold weather? I’ve been in a truck that would not provide heat in -27 degree weather. I slept comfortably in my sleeping bag. Not saying I was happy, but just saying been there done that. Trans am rules is the trailer loaded or empty are to remained locked at all times. Why was it necessary for him to lock the trailer? Failed to do his job that’s why. All trans am trucks are equipped with bunk heaters and apu units. Granted they have a 5 minute idle shut off on the main engine, but the apu kicks on automatically. The bunk heater burns diesel in a metal box and a fan blows the heat pretty effectively. You can make a bunk hotter than fuck with them. He abandoned a load, big no no, no matter who you work for. Service calls always take hours. Your lucky if someone shows up in 2 hours, especially at night. Improper maintenance of the trailer air supply. He didn’t drain the air tanks like he was supposed to. He created the issue.

Profesional driver or not. He did the best descision to survive and not to die on hipotermia. Plus he come back to finish the job! This idiot judge; companies that fired him, brokers, dispatchers, costumers waiting for their product to be delivery on time no matter what, cause they don't take not excuses, mecanics that take all the time of the world to came and fix the truck or trailer broke down, tow truck that also arrive and start questioning like dome idiots. THEY DONT KNOW WHAT A TRUCK DRIVER SUFFER TO COMPLETE A HARD STRESSFULL JOB TO TAKE THE FOOD TO THEIR LOCAL STORES SO WE CAN HAVE FOOD ON OUR TABLE EVERY DAY. WE NEED TO APPRETIATE MORE THE TRUCK DRIVERS THAT MOVE THE COMPLETE WORLD WITH THEIR HARD WORK. HE FOUGHT FOR HIS LIFE!!! WELL DONE DRIVER!👍

Been driving for 17 years for many different companies. Companies do not care about their drivers and all they care about is their freight. This driver made the right decision because freight isn't worth dying over. The trucking industry isn't 600,000 drivers short for no reason now

As a former soldier I find the drivers comments on his situation disgusting. I’ve slept in that weather...in the wind. He was out of the elements and had he had proper gear, that all drivers bring in their trucks, he would’ve been fine. Layers, Kids

Nothing you haul on a truck is worth ANYONE'S life. As a Driver, YOU are the Captain of the ship and ultimately responsible. Dispatchers and Supervisors sit behind computer screens because they don't have what it takes to drive. They are nothing but advisors. He secured his load, informed his Dispatcher and made an informed Decision. Trans-Am owes HIM. And that "Judge".......well, stick him in a cold truck and let's just see what he would do. I would like to point out that if required, you can place a wheel chock under your tires(which you should have on the truck) release your brakes and the tractor just thinks you are at a long traffic light, and will idle. I learned to do this at night so my brakes wouldn't freeze because you can't very well avoid driving though slush coming into the truck stop

NOW THAT WE KNOW THE REST OF THE STORY.... I have a CDL with tanker and hazmat (yes, I can read and write). The driver abandons equipment - unlawful. The driver does not remain in the cab with the engine running & heater on - _PERMITTED IN ILLINOIS WHEN TEMP IS BELOW FREEZING._ All we have is a 'he said - she said' story. I'd also like to know why the driver did not have air line antifreeze, why he set the trailer brakes (against operating procedure) in that extreme cold AND what he hoped to gain by driving away? I am a professional driver and I support Judge Gorsuch.

Sounds like the guy needed some retraining at best. Now sure the company can fire him. And without cause. But most companies try to avoid this. Cost a lot of money to hire and train a new guy. Better to attract and keep good workers.

Perhaps he should have called 911 for an ambulance to take him to the nearest hospital to recover. When he was able to work again and after he recovered he could have got a taxi back to his truck and completed his assignment.

My beef with the trucking industry is that they don't train people adequately. I spent six months in a vo-tech truck driver training course where we learned what to do in various situations A piece of cardboard, big enough to cover the radiator would have possibly helped with the heater performance. A three pound hammer could have been instrumental in freeing up the frozen brakes, if he knew the procedure. It's not that difficult, I've done it myself on occasion. Or having proper winter clothes and or bedding to survive the cold like just about anyone who lives in a cold climate would bring along to survive a trip into the ditch.The thing is, that the trucking companies are hiring people, who don't have a record so they can save on insurance and just take chances with our safety and the safety of the drivers they hire

Gorsuch has been referred to as an "originalist," like the deceased Antonin Scalia, meaning he seeks to interpret the Constitution as written, and as he perceives its writers as wishing it to be interpreted. In the "Frozen Trucker" case, Gorsuch said the law did not protect Maddin because he chose to operate his truck in a way the company forbids. Gorsuch wrote that whether TransAm was good to Maddin is irrelevant with respect to whether or not the company broke the law. "It might be fair to ask whether TransAm’s decision was a wise or kind one," Gorsuch wrote. "But it’s not our job to answer questions like that. Our only task is to decide whether the decision was an illegal one."

I am completely on the side of the driver here. But if you're going to haul in extreme weather. You better be prepared for a break down. Lots of water in the heat, plenty of layers and a darn good blanket / sleeping bag to keep you warm while waiting for help.

There are many questions that this video does not have! As a retired over the road truck driver of 33 yrs, this video is unreliable as to exactly what happened! Did his airlines freeze or was it the road spray freezing up brake chambers, or road spray freezing the brakes to the brake drums from driving on snow/icy/freezing rain! Was he just idling the truck which will not maintain engine heat in that type of weather!(-27degrees)! And so many more questions! Sounds like a quick judgment was made on this one because it really didn’t want to be dealt with!!

That company obviously had no concern for this mans life. We need more judges that place life over laws in this country. There are far more laws than any lawyer can possibly know at the present time. If lawyers are not able to know the law, how are common people going to know the law, laws against robbery, murder, and such things that protect life are but a small amount of the laws today that are used to put people in prison.

For all of you that feel safe on the road. My first day as a trainee truck driver they made me drive through a blizzard. I had never even seen snow. While my trainer was asleep in the back. I didnt even know what a jake brake was. I just came out of school. These companies dont care about drivers, the safety of people on the road or the safety of their personnel.

There are a few questions left unanswered here and quite a few discrepancies. Where was he parked when he stopped to call his employer about fuel locations when his trailer brakes froze? Obviously if it was 27 below at his location, he had been driving in cold weather for quite some time. So when did his heater quit working? If the heater didn't work when he picked up his load or quit working at some point before or after he picked his load up, why didn't he stop to have his heater fixed? He said he stopped to ask his employer about where to get fuel but he never said that he mentioned anything to his employer about his heater not working in -27 weather. The heater not working would have been the FIRST thing I would have discussed b/c it would be even colder driving at -27 than sitting still at -27. In fact, he never mentions at ANY time about telling his employer that his heater wasn't working even though he claims he contacted them several times. So was he driving all this time with no heat (in -27 temp) or did his heater just go out at the same time he stopped to call dispatch to ask about fuel locations? Something tells me we are not hearing the whole story here.

I worked for trans am in 09. Had the same problem , brand new truck heater didn't work. Freezing my ass off. Had to quit .

There is not much information as to what really happened. I was a truck driver But I'm with Gorsuch on this one. If you are a truck driver then you probably heard of how Arrow Trucking fell. When Arrow Trucking stopped it's operations, they told all the drivers to find a truck stop, park, get their stuff out because the truck and trailer is going to get towed. So you had thousands and thousands of drivers, stranded, didn't even get their last 2 weeks of paycheck because Arrow went bankrupt and had to pay penalty for Fraud. Now Imagine if this Truck driver (who was making it a Civil rights and Human rights issue) gets favored by the court? Sure of course. How much will he be awarded with? 50m? 100m? What about his fellow truck driver co workers? Will they prevented 2 weeks worth of pay because because justice rewarded 1 person? That's not equal justice. The mega carriers, the usual suspects will lobby and may even try to bribe judges in favoring for the victim; So that the mega carriers can kill the competition.

His mistake was not prying clutch or gas pedal, stating I'm cold beyond measure and will lock trailer up and move ASAP firmly to a safe location, and for not starting the truck and sticking with it till it warmed up. I have been in this situation with no start and its a minimum 3 wait in those conditions for aid and he could start his truck and stick an old shirt balled up to lodge gas pedal and retreat to a close business for shelter as a TRUCKER. As a company I'd say, " your just after our money and you didn't get any of it and try harder. " What would he have done as a owner of a company and a driver sent him to court with his case? He would of kindly said you had over 5 options you could have chose as a TRUCKER aka human so don't be suing us for your negligence.

This is lame. The truck driver did not prepare for cold weather. He did not have adequate emergency apparel. He did not follow company policy on preparing for cold weather. He did not do due diligence on parking a trailer in cold weather. He failed to properly park without using the trailer brakes. He was negligent in his duties to secure the load in a secure location. AND IF YOU ARE NOT DOING YOUR JOB, THE TERMINATION IS WARRANTED. PERIOD.

I would have just sat in the driver's seat with the truck idling and the cab heat cranked. He said the bunk heat didn't work, but that's different than the cab hear. New trucks do have "idle shut down" features, but those are supposed to automatically disable in cold weather. In fact, a driver who knew what they're doing wouldn't have ever shut the truck off to begin with, because there's a chance it won't start again because of gelled fuel. People say it was life or death, but there were other, simple options that were not discussed.

So the tractor would start and run and he is cold. Even though the bunk heater failed the engine has a heater, RUN THE HEATER! If he was as cold as he says he should have called 911 and taken away to the hospital. He lost his job because he did not want to follow orders and the company was correct in firing him. I have had hyperthermia and this guy is lying about his condition and circumstances.

The judge and people involved in his firing for the company should be forced to sleep in a truck with no heat at -7 degrees and see if they survive then maybe their pathetic little brains will understand what they did wrong

I'm glad he's gone, but I have to agree with former Senator Franken this time. I'm embarrassed by this decision of Judge Gorsuch. This shows the disconnect of the upper class white collars and the blue collars who provide the products that they take for granted.

I have some questions before making judgement. Most rest areas have rest rooms with heat, did this one? If no heat, raising RPMs or/ and covering front of vehicle will get heat. Since he said he drove it, which would raise heat. If brakes were frozen. Just hitting the brake pads with object will break them lose. So I wonder. More details needed.

Cannon Express had no engine brakes on the trucks. The owner's wife said they make too mush noise. I knew 3 drivers killed by the trucks.

I had the same issue with Roehl Transport of Marshfield WI it was -28 the bunk heater would not work and the truck would not idle longer than 3 minutes. I was told I would just have to deal with it for a few days until I could get to the yard. I ended up driving past my hours of service to find a hotel and then I sent the company the bill. Granted I wasnt sick or anything yet! But I very well could have frozen to death that night. And they decided to fire me.

Brakes freeze all the time on semi's. You get out and hit the brakes with a hammer. No heat from your truck? He's a liar and lazy. Typical type out for free money. I'd have ruled against him too.

Ok if he was able to drive his truck as a bobtail then why was the heater not working? I think he was referring to his espar heater that comes on when the truck is not running because companies dont wont the truck to idle. But you can start the truck

The judge ruled right as a trucker myself that driver should have stayed with the trailer,after all where did he drive too a truck stop a few miles up the road where he spent the night in his truck...He just didnt like sitting on the side of the road waiting on a service truck to get his brakes broke free a seasoned trucker knows how to do that without any help a hammer would have done the trick .Also trans am trucking has apu,s that provide heat and air for winter and summer,direct tv,and xm radio on all trucks.I guess they should give there drivers winter boots, wool socks,and a winter coat too.

I have a apu with espar bunk heater . They don't work the slowest certain temperature I know this her fact I've been driving for 35 years maybe use a good until they get down below 19 degrees they don't keep the truck warm inside the Apu will run to keep the oil the antifreeze and if you want them but I won't keep the truck warm that that little bunk heater only can do so much you got to idle your truck in order to keep the inside of the truck running. My company has it set where you cannot idle that truck unless it hits 19 degrees so maybe that truck set it cannot be titled don't blame the truck driver blame people like you and the government

Did not dress appropriately for weather conditions. Knows nothing about moving to keep warm. Not responsible or knowledgeable enough to work for me either. Company has right to fire him for whatever reason. Seems they did the right thing.

I'm a truck driver if the truck was running had enough fuel he would have been fine... With the heater on.. sitting on the side of the road like a Sitting Duck was a lot more dangerous... I would have left the load... but not because I was going to freeze to death.. I would have expected to get fired..

Miguel Robb didn't he say his bunk heater..?. if the bunk heater wasn't working just let the truck idle and if he didn't have a bunk heater he should have got a ticket.. for faulty equipment... I'm not saying I wouldn't have done the same as him.. And Frozen brakes on trailers happens all the time you got to not turn your air brakes on your trailer in extreme cold weather.. ...

Fastjoe Corrigan I think he is full of Shit though. Because if his bunk heater isn't working, then he could use the cab heater instead. It'll take a little longer to heat up the truck, but it will work. My bunk heater doesn't work either. It just blows out cold air. But I leave the cab heater on and it works just fine.

Myself and co driver had the same issue we were making deliveries and while at a stop our air compressor quit working it was winter it started snowing so I called the company to let them know our dalima I called road service and after a few minutes they called back saying they had help on the way but the mechanic called saying they couldn't get a air compressor until the following day, we couldn't drop the trailer and the heat wouldn't work so I called the company back telling them our issue and a supervisor told us we had to stay with the truck with no heat the wind blowing wildly but they all but told me I was lying I hung up called the mechanic ask if he would come take us to a motel it was dark by now no heat and the supervisor told us we couldn't leave the truck I told them we were not staying in the cold that the truck wasn't going any where the trailer doors were locked the following morning the mechanic picked us up had our truck towed to his shop it took all day to find a compressor and install it but for a company to tell you can't leave the truck doesn't deserve to be in business

Truck not idle? I’ve never known it to be 27 below zero in IL either. I’m a driver and would love to have his back but I’m seeing some read flags or issues with his story. Also as a driver your expected to be prepared for bad weather like thermals andjackets.
