The plaintiff parked her car in front of the defendant’s house and claims the defendant’s wife gave her permission to park there. She claims the defendant got her car towed and then called the cops on her, so she’s suing for the tow and impound fees and the loss of a real estate commission. The defendant argues he said he would let the plaintiff park there only for a few minutes, but then she started bullying him. She’s countersuing for slander.

The judge should have awarded the defendant the 500 dollars because the plaintiff had no right to put papers all over the neighborhood saying he’s a liar with his address on it .

The neighborhood seemed to have gotten a kick out of it, according to the defendant. It didn't help that the flyers were poorly printed when they were distributed. The effect should've been more negative in order for the judge to consider his counterclaim.

She still doesn't understand, all the defendant did was speak to a policeman. The policeman is the one who made the decision she was illegally parked and called the tow. She'd have to sue the policeman, which won't go anywhere. And rather than making garbage quality fliers which not only misspell his name, cuts off her argument of "lia[r is cut off]," instead she could have contacted the regulatory body that determines if a driveway is legal. If it's not legal, then the city can go after the defendant. Of course, that doesn't reimburse her for the tow, but the defendant would then either lose his driveway, be fined, or have to bring it up to legal status.

Driveways have a very specific requirement in NY. It isn’t a legal driveway.

the defendant had no right to have her car towed . the cops would have never towed her car if the defendant did not tell the cops that she was blocking his driveway . ultimately it was the defendats fault because the court already determined it was NOT part of his driveway and it was in fact public parking and she was legally parked according to the court so she should not be out the money . @@user-rm1br3sw7x but that should not matter , because the fact is that it is not a legal driveway so the plaintiff has every right to seek damages for what the defendant helped to cause happen to her vehicle . he had no legal grounds to ask the cops to tow her vehicle . so this tv judge got it wrong .

She was right. The prior case in the "real courtroom" threw her citation out because it was not a legal driveway. The defendant painted it himself and did not have approval from city. He effectively took street space away from open public parking and he "allows" people to park there under the conditions that they are going to the bodega and will only be there for a few minutes like he owns a part of the public street. This is a recurring problem with homeowners in large cities creating their own private driveway and then other people having a difficult time finding available parking.

@@sunnysunshine1448 Even the defendant's own daughter stated to the judge her dad went up to a traffic cop and told the cop he wanted the plaintiff's car towed. From a driveway that was not legal so he had no right to ask for that car to be towed.

Defamation is when someone says something about another person(s) and it has a negative effect on their life. What she did was put a piece of paper that probably got some giggles and a bit of confusion from the neighbors. But it didn’t impact him in a negative way that would’ve cost him a trip to the hospital, or lost wages, or made him depressed, etc. Defamation lawsuits are mostly thrown out because people don’t really understand what the causes are about. She plastered flyers about her opinion of him. Nothing more. If we all could go and sue someone for an unwanted opinion that someone has of us then let me tell you, everyone in the world makes opinions about someone at some point throughout all of social media. The courts would be flooded with people getting their feelings hurt over someone else’s opinions.

He may have had a case if he could prove he lost business because of her accusations, or that people in the neighborhood started mistreating him over it. But you don't get money just because someone said something bad about you. It happens online all the time, lol.

The Plaintiff is a Broker?!? Who would want to do business with her after seeing this? She parks in front of the Defendant’s driveway, he says something to her, she flips him off, he has her car towed, and she plasters derogatory flyers around the neighborhood calling the Defendant a liar. Oh and SHE’S the liar because the Defendant’s wife said she NEVER spoke to her. Let’s not forget she called the Judge “Nuts.” I think it’s pretty evident who’s NUTS!

Though she should have lost, that is not a legal driveway and the defendant knows it. But it wasn't he who got her car towed, and that's the fault of the police for thinking it's a legal driveway when it isn't. She does have the right to park there.

I understand her reasoning for wanting to sue him because he called the police over. Had he not done that then her car would not have been towed. That said, the plaintiff sued the wrong party. She should have sued the city as their cops are supposed to know what a LEGAL driveway is before they had her car towed and ticketed. Since the city threw out the ticket then they are liable for her towing bill since their cops weren't adequately trained in this regard. But good luck winning that battle. LOL.

The plaintiff wasn't wrong for parking there. The defendant basically created a spot by his front door and unofficially declared the street space a driveway so he could get out. Another judge declared it was illegal. Just think if his neighbors all did the same thing.. there wouldn't be any street parking. I think the plaintiff would've won if she could prove he had a history of calling the cops knowing the driveway wasn't legal

@@JohnnyEnrico His driveway is not legal and therefore he cannot tell people to not park on the "public street", in front of it. The public street is NOT his property. He knew that already. He is the one that painted the lines. Per his daughter he is just being "nice" and "letting people park there" if they are going to the bodega just for a "few minutes". Total BS. That is not his call like some public street-owning tyrant. Now that he has been on national television, he cannot claim he does not know it is not a legal driveway anymore. They brought up the prior court case with the plaintiff where it was determined his driveway is not legal and the plaintiff's parking ticket was dismissed. If he calls the police in the future the taping from this episode should be used as evidence for a lawsuit against him.

The defendant absolutely should have gotten at the very least punitive damages from the plaintiff. Her behavior is absolutely insane, and I'm surprised her anger only resulted in those tacky, tastless fliers. I may be the odd person out but if it's unclear to me if I can legally park someplace I park where I know its legal. I'm not chancing getting a ticket and/or tow plus impound fees. I may be overly cautious/unwilling to chance spending money I can't afford to float until I'm proven "right".

The entitlement of the plaintiff is simply stunning!!! She called her own foolishness! Just because something is a "release" for her doesn't mean it's a wise thing to do. Can you imagine living with her? I think she's My Cousin Vinny's cousin (if you know what I mean). The people outside Harvey interviews are nuts! Either they don't listen or they aren't very smart. JM is correct, this is NUTS! I REALLY wish the judge had awarded the defendant some money. That would have really made this wretched woman angry 🤣🤣🤣

The defendant knows he did not get permission from the city to create his own driveway and therefore take street space away from open public parking. He even painted it himself but acts as though he is being "nice" and doing people a big favor by allowing them to park there, IF, they are only going to the nearby bodega and will only be there for a few minutes. What a kind man. Yeah right. I guess most people commenting here in favor of the defendant would likely "tip" the defendant for doing them such a big favor.

WHAT? If the judge found in favour of the defendant, which means that he was telling the truth, then the plaintiff distributing flyers with his name and address saying he is a liar, is defamatory, therefore he should have been awarded the $500, but in dismissing his counter-suit means that the judge upholds her flyers claiming he is a liar, in which case, the plaintiff should have won her case, since he lied to the tow company. Either way the judge can't say to the plaintiff that he wasn't lying and then turn to the defendant and say, she hasn't said anything wrong. The judge doesn't seem to follow the law as much as she goes by how she feels on that day. She is NOT CONSISTENT in her rulings...

The defendants seem like an absolutely adorable family 😊. Too bad they ran into this true narcissist. I know that word gets thrown out a lot, but the truth is when you slowly lose your humanity that’s what you become. So yeah we see them a lot more lol. Granted I love several of them lol. I work for a building maintenance company. When tenants make off-the-wall request I always say no even though they say it’s a one time deal. When the tenant goes over my head to my supervisor to get permission to do something, they shouldn’t be doing that day. Weeks later that same tenant will come up and ask or do what they did before and then when I confront them about it, they always say. They let me do it before. He should never let anyone park there and he's needs to go to the city and get all that carp straighten out.

After this case judge ended up finding out that these drive way are illegal and the people aren’t supposed to have them and the cops are just TOWING cars away cause they think it was. She starts ruling for the plaintiff and getting onto the defendants she was wrong in this case

the plaintiff needs to PROPERLY Explain her case - 1st off it was ruled the CURB WAS ILLEGAL - the homeowner cut the curb to create an illegal driveway entry, he also painted the curb yellow - so yes to the officer it LOOKS like a driveway, but after the city researched, they found this was an illegal driveway and is why the court DISMISSED her ticket.

This berm/driveway issue is a HUGE problem in New York. Where the defendant parked his car is NOT a driveway nor is it a legal parking space. A LOT of people buy houses with "driveways" and are later pissed to find that the driveways are not actually considered driveways. It is INCREDIBLY rare to find a home with a driveway on that sort of city block in NYC. Police are NOT good indicators of parking laws because they don't care. They're looking and making a personal judgement just like any other person with no knowledge of parking enforcement rules. That's why her ticket eventually got thrown out, because someone with actual knowledge of the street there knew that she was right. That said, her beef is with the police, not with the defendant. He did what any normal person would do who believed he had a driveway, called the police, and the police had her car towed. After that, she should have gotten surveys of the area, made both the defendant AND the police aware of the fact that he does not legally have a driveway and therefore does not dictate who can and cannot park there, and then if the defendant took any action against her after that, it would be on him. Right now, he's just a man who thinks he has a driveway. I understand Judge Milian's reasoning for not ruling for the countersuit for defamation, but I don't agree with it. Just to distribute someone's full name and personal address on flyers alone is worth some sort of punitive damages. Right now, she believes that doing that was okay. She needed to have been punished for doing that.

The police towed the car ONLY BECAUSE HE CALLED! Cops were in the area and didn't tow until he called for them to do the ILLEGAL TOW! SO YES HE SHOULD PAY! SEVERAL BAD JUDGEMENTS WHEN IT COMES TO THESE KIND OF CASES. GUESS THAT'S WHY SHE HAS A NEW AWFUL SHOW INSTEAD OF PC!

Glad to see that the plaintiff lost. She’s definitely very narcissistic, entitled, and lacks insight regarding her behavior. Judge Milan was right on target (as usual) when she pointed out the plaintiff’s significant rage issues towards other people

He created his own driveway. The Court dismissed her citation. She felt vindicated, and reacted improperly. He was just mad she said "F You", and he's petty so he stopped a traffic cop to tow the car from his (probably illegal) driveway. She should've gotten a copy of the street layout from the City to find out if there is a documented driveway, before she filed her suit.
