@@Mikeprocurator Accepting partial payment isn't settling for less. A settlement requires both parties to agree beforehand to settle. If I owe you $500 and send you $300, I can't unilaterally claim that you settled for only that $300.

Her whole story was like that, so I don’t know why the judge kept believing her. Like with the plates, she admitted that she saw them and decided to buy them, which was not something the defendant asked her to do. So I don’t know why the judge let her her throw that charge on when it wasn’t even in the plaintiff’s original invoice.

Story time: My mother owned a hair salon for 23 years and this lady would come in my moms salon with her own broom and start sweeping, cleaning the windows and collecting the trash, she was always okay with just $10. Until one day she demand $50 and wouldn't leave until she got paid...my mom paid then got a restraining order 🤣🤣🤣🤣 anyways I feel like the plaintiff did the same thing to the defendant.

The plaintiff is a weirdo for not opening her mail. And the defendant is ridiculous saying “she didn’t work for the company, there’s a protocol…”. There is such thing as contract work. If you ask for a service and agree to pay, then thats a contract.

I think what the defendant is saying is the service she asked for was staging. Anything after that, like sitting behind the booth and arranging lights occasionally, was not agreed 'work' that she actually contracted. Because if she wanted work, she wouldn't have done it by contracting it, she would have gone through with the protocol she mentioned.

I don’t know why the judge kept being nasty to the defendant, she would barely let her explain at all, and she was right about trying to pay her. Also, its totally believable that the plaintiff kept inserting herself at the booth. That’s a lot to charge for one event, and those farmer’s market style booths/product vendors only make so much per event.

The plaintiff's attitude shows this is not the first time she has strong armed her way into a paycheck. The defendant should've never let her get comfortable in her business enough to state her wages like that.

They’re both insane. Something about the Plaintiff is off. Why would you refuse the package thinking she would “put something in it”? That sound paranoid and delusional. Maybe she refused the original check too, and that’s why it wasn’t delivered. Something isn’t going to the top floor for her. The Plaintiff seems a bit deranged. The Defendant also needs to learn how to run her business: sign contracts even for freelancers, agree to a payment before contracting anybody, and follow the contract. You can’t change the amount of a payment just because you’re mad. These two need to find something else to do with their time beside play games.

Nah in a weird way I get her. If I'm having problems with this lady after thinking she's shafting me and then a weird looking box shows up on my door I aint taking it either. What is the lady going to do put a check alone in a big ass box? Nah so I would think its weird too " like what's in there she's trying to send me"

I think her problem was that the box wasn’t sealed. If she accepted the open box and it didn’t contain a cheque, then the defendant could claim the cheque was in the box and the plaintiff had accepted it. The plaintiff just didn’t want to risk accepting an opened box when she was expecting a cheque.

She should definitely get paid for her staging but the whole “I worked in her booth at an hourly wage” seems off to me. I’m willing to bet she just fondled around in the booth being overzealous instead of staying in her lane and now wants to run the defendants pockets for a bit more cash

Yeah, that’s what I do when I want money. Go waste my whole day at an event serving at a particular booth and then hope they pay me. So much easier than actually finding a paying job 🙃

The condition that the box showed up in could have had everything to do with how it was handled by the postal staff, and nothing at all to do with the condition that it was in when it left the defendant’s home. The plaintiff is definitely an odd bird.

Honestly, this is all I’m thinking. I am always wary of people coming under the guise of “help”, then suddenly getting chummy. Who sent you? The plaintiff knew what she was doing and she probably did it before. The defendant needs to wisen up and not engage any individuals or companies without serious thought and an airtight contract. That lady could’ve come for her entire business in court!

I absolutely hate when Judge Milian asked who's going to pay her for her wasted time or her troubles! It's like are you kidding me? you most definitely are being paid for wasted time and your troubles, and she gets paid a lot of money for the show! tbh, everyone that has ever worked customer service has thought exactly like the Judge. At some point, a customer is just using up more than their fair share of your time. I work in the Emergency room and can usually address patient complaints. HOWEVER, when a patient insists on keeping me to complain about something that is unreasonable or beyond my control even after I've explained it once to them, they prevent me from moving to my next patient and thus are wasting my time. So when a patient like this says "you guys are wasting my time" I too am thinking, I dont get paid enough for your bull.

The plaintiff used the words payroll closed not the defendant and was sent a check for her services but claimed she never received it....she is setting stuff up in a booth so $100 sounds right after hearing the work she did and I believe the defendant sent more money than she agreed to just to get rid of that woman and since she was paying more than agreed she can take off $50 because Karen will not shut up!.....she's dressing up a tent not performing life saving surgery.

You are not an employee if you do not complete an I-9 Form. If you are a 1099 employee, you need a W-9. Plaintiff should have shown companies operation manual. Along with proof she follows practice for all hiring transaction. I think the woman assumed she was working for her. This has happened to me on more than one occasion. I removed them from the event.

If she didn't hire the plaintiff to work the booth b/c she's not an employee, but she took it upon herself to work the booth anyway, then she just volunteered... I'm not paying someone to do work I never agreed for them to do. Sounds like she should've only been paid for the staging they agreed to, and it's nonsensical that neither of them thought it was worth putting in writing what they agreed to.

The plaintiff is an opportunist and the defendant needs to make things very plain . I don’t play games with people , literally send a text to confirm stuff a forehand . Maybe it’s because I’m a graduate in law , or maybe it’s because I have Anxiety. Either way I just operate differently ❤

Plaintiff is a weirdo and I believe 100% inserted herself into the business of that day. Those farmers markets don’t make much money so it wouldn’t make sense to offer to pay someone to hang around when u already have 3 other people working. Defendant didn’t set boundaries and should have sent that lady about her business. Judge was being a real b… to the defendant for no reason and would not let her speak to explain herself. She can be extremely rude and unfair at times. Judge picks and chooses when she wants to enforce unconfirmed contracts and agreements.

The judge is biased against blacks and that is in every court system but the defendant screwed herself with showing a check made out for 210 even if it was extortion. What the defendant should have said, is brought the proof that she had three people at the event working and then ask what purpose would it serve hiring someone who was there to do staging as one of her crew at an event that is not super busy and someone without proper knowledge of the product who was again there for providing staging. She is a swindler ie a hustler and jack of whatever trade and that is how the defendant should have described her. She should have made it clear that at what point do some random woman approach her about staging then it goes from her doing a staging to becoming someone who is working in the business which is bongos ... I have seen this is other places where people show up to do a specific job then volunteer to do something else they see, then after they finish want to be paid for what they volunteered to do claiming they were being nice

Curious if JM committed a felony on live TV. She opened someone's mail without consent. (If the letter is return to sender, and it made it back to the defendant, then she should have gotten consent from the defendant.)
