The plaintiff ordered bathroom and kitchen tiles from the defendant’s store, but they were the wrong color, so she’s suing for a refund. The defendant claims he was with the plaintiff when she confirmed the color, and he told her they were nonrefundable.

The plaintiff’s English isn’t bad AT ALL; she just has a strong accent. It is VERY hard to represent yourself in court in another language, especially one that isn’t your native tongue. I mean, we hear plenty of people across these court shows who ONLY speak English and can’t articulate themselves!

I briefly worked for a stone tile distributor in sales and something I quickly learned was that different places had different names for the same stone. Not only that, natural stone can be very inconsistent by its nature. You have to be really careful and take the time to get current samples, but even then there can be complications. Imo it's more trouble than it's worth.

Just went looking for someone saying this as I did. If that natural stone is not mind from the exact area, it can vary in color a lot. My husband has been laying tile over 25 years now And he always recommends that they purchase All the tile at once, because if you go back due to a crack or issue, you may not get the same coloration/pattern aka dye lot.

I’m glad the plaintiff won because I can see how she reallyyyy tried to get her point across with her English not being great. The fact is she knew the name of the tile she wanted, the defendant placed the incorrect one on the invoice which she quickly noticed and went back the following day to point out and she still didn’t get the right one.

The defendant's argument was that the plantiff wanted one tile, but went with the another because of the significant price difference. He also said that it was ordered online and everyone agreed that tile is cheaper online. What got him was that there was no price difference between the two online (where he ordered it). He lied. I really believe that woman went to the store to point out the name difference on the receipt, but the defendant didn't think there was a difference or ordered whatever he could get her by Friday.

One of them could have been on sale at the time and not on sale at the time of the case. The judge may have been looking at wholesale pricing rather than small-batch pricing. Any number of things may have impacted that. Bottom line is that neither litigant brought any evidence about it one way or the other, and the judge's quick Google search shouldn't outweigh the only bit of evidence entered by an actual litigant (the receipt which clearly listed the tile that was ordered). Judge got this one wrong.

I'm surprised she won. She should have gotten a partial refund at best. If there's no proof of what the plaintiff ordered then how can she prove that they ordered the wrong color?

Seems to me that there’s sufficient proof that they ordered the wrong one. She knew the name of the tile she wanted, and she came back the next day because the name on the receipt was wrong. They both agree on those facts.

@ @BREEZYM6015…..conversely, the tile company can’t disprove her statements either. The tile shop needed to put the correct name and sku on the receipt. The onus is more on them than the client in my opinion. They are the ones who have store policy and should therefore be responsible for making everything clear.

@@valmunguia5761 No they don't. He said that she came back the next day to take another look at the discount tile. Not only are the stories different, but they both have an air of believability (ie: buyer's remorse on her part and questioning whether she should have gone with the better tile). There's no real reason why he would choose to sell her a cheaper tile if she wanted a more expensive version.

​@scooneil she came back because the name was wrong, client took advantage of her lack of understanding knowing it was the same tile in a different colour so tried to convince her it was the same hoping she wouldn't make a fuss. When he came he thought he could claim she chose a different one as it would be cheaper - except the judge found that it's NOT cheaper. That gave her props to doubt that she ever wanted that colour and that he made a mistake and ordered the wrong tile. The tile shop guy tried to play the judge by saying it was a cheaper item.

@@kimmccormack9905 I get it. You believed her completely and discounted everything he said. But when two sides have two very different stories and the only evidence is the receipt? You have to legally rule based on the evidence. The judge Googling for a few minutes isn't evidence (and doesn't actually prove anything. One of the tiles could have been on sale then or now. She could be looking at a different product. The tile might be at the end of a product cycle now, etc). Ultimately, the price difference is irrelevant, as her receipt had the name of the product that she ordered. She has no evidence that the return visit was about correcting the receipt (and the fact that the receipt WASN'T corrected looks bad on her story). I have no idea which side is telling the truth (and frankly, nobody else does either). Either she had buyer's remorse or he tried to pull a fast one on her. One of the two is clearly not telling the truth and both stories are pretty plausible. In that kind of case, you have to go by the evidence, and the only evidence is the receipt.

Yea 80% of the time judge says “write a receipt on a piece of tissue, and then we people do a one she enforces it, i don’t think he should have been held 100% liable for this, questionable decision

Preponderance of evidence; is it more likely than not. She doesn't need rock-solid, unequivocal proof. The judge uses her discretion on a case by case basis.

He had one story. She had another story. He didn't have a price sheet to back up the price difference he was talking about. She not only didn't have a sample or even a picture of the tile she supposedly ordered, but in court she couldn't even say with certainty whether the tile brought in by the defendant was the one she wanted or not. The two stories were very different and neither side had any evidence. There was just one piece of evidence in the case--a receipt that backed up the defendant's story. The judge got this one wrong.

The color is called giallo antico (pronounced like jiallo not glario) and it means antique yellow, so I'm not surprised it was too yellow.

I'm surprised the plaintiff won, tiles can be a bit picky with shade and tone, and look different under different light - natural light, or in the store, and the name on the receipt didn't match -- but I am very happy the plaintiff won, it is clear that plaintiff did not receive the product that she believed she was buying, and the resolution is good.

I believe her. He such a lousy liar that he just assumed he would win. I knew he was a liar when he couldn't even produce a way to show the price differences. He had plenty of time to even make up a list to help his testimony and he still arrogant enough to think he would still get over.

It’s the fact that was showed the one she wanted and she said that wasn’t it then when he showed what he actually brought her, she went back and said the first one was PROBABLY the one.. 😂

I believe her, altho it was subtle there was indication that she was telling the truth. The big thing was the defendant trying to inflate his motive, for her buying fantazio. If he said they were the same price, it would become really clear that he made a mistake, but the difference in price was a subtle lil change to his motive, making it look like she wanted something cheaper. But once you realize its the same price and that she DID in fact come in again to verify the tile, to which he had no real response, its clear he probably didn't have the one she wanted in stock (or available ordering) and got her a similar tile just so he could get an easy sale.

If they were the same price it wouldn’t change anything, because someone can buy one color item and then rethink that once they have it and go “that’s not what I ordered”. “But she went in the day after!” Which could also be her rethinking the color choice she picked and trying to back out 🤪

No two reasons why this might be unlikely. For one, she claimed she went back in with her witness, moments after leaving with the receipt and reading it. This could be a lie, but the judge asked him, did she come back and he confirmed it. This means she went back for a reason. And 2nd, imported tile, you gotta know that just cause they can order something doesn't mean its always in stock. If you go to a home dec shop and try to get extravagant expensive tile or materials sometimes they're out of stock, but the salesman makes commission on sold material. He would have a motive to try and get a sale by ordering a similar tile to the one she wanted hoping she wouldn't notice it. She asked for one, he wanted to make a sale and most likely hoped she wouldn't notice if he picked out a really similar one, rather than tell her its out of stock when her mind was so set on the one she wanted.

This is the first time I've been genuinely shocked by a JM judgement. This is essentially just a he said/she said. The only hard evidence is the receipt, which said she got what she ordered and there were no refunds. I can't believe JM ruled in her favor.

a couple of points. 1) you can't tell colour from a computer picture. 2) the colour and pattern of granite is so variable that it makes no sense to be that picky about it. Even the same style from the same slab can vary. What that means is that even if you have a showroom sample, there's a good chance that what you receive is not going to look exactly the same. 3)granite stains so its going to change colour anyways.

He was lying. He said the one she couldn’t afford was $12. The judge finds the tile for $7-$8. So it wasn’t more expensive than the one she didn’t want

Or prices change over time. From the time of purchase to the time of the case who knows what could have happened to supply and demand. The judge didn't check the price of the cheaper tile only the more expensive one, the cheaper one could have been $5 at this time.

I'm not even sure on this one. I would think enforcing the "restocking fee" would be based on her changing her mind and cancelling the order, not on the wrong tile being ordered. Correct verdict, I think. Hard to agree there was a meeting of the minds when there was a communication barrier because English is not her primary language.

That was the right ruling, in my opinion, because if anything, he can still sell that product and profit, while she would have to either settle for that tile or buy again. By the way, his restocking fee is a ridiculous amount!

HONESTLY I BELIEVED THE PLAINTIFF & AS THE JUDGE POINTED OUT THERE'S SEVERAL DIFFERENT COLORS W/ THE NAME SAME PRICE BASICALLY / 30% DIFFERENCE. THAT WAS THE REASON SHE WENT BK TO CK. The defendant did not want to refund what he should have for the wrong color tile, his mistake. Glad the Plaintiff won. He was wrong for not having learn customer service skills. He was taking advantage of the lady with the language barrier so he could keep the money no matter what, which is a bad business practice.

Problem with natural stone is you have to purchase all from same dye lot or it won’t match.

Natural stone will come in different shades due to it's natural state. There would be no guarantee of shade when ordering so you really need to buy what you see. I prefer natural stone and understand there may be some shade differences if I have to order it.

What? If there is a language barrier then the contract can be cancelled without consequences??? You can't be serious? That's nuts! You need to be held accountable and she should have been held accountable. She should have brought her friend with her on Day 1! That judgement was not right. So, can I just buy a house and after 2 years change my mind and day "oh, language barrier".

Floor stores!!!! I ordered tile, had someone come out qnd measure, i talked to thexguycwho measured qndxthe sales person about one propblwm i thought they might have. I pointed out to the guy who measured. Twice to the salesman. It came, they went to install, nope . Wouldnt work. Theyvtried really hard to give me crap and charge me restocking fee. Even though i was still ordering from them. I didntv ust chwnge my mind.

So she gets a refund because she has an accent? Really, so whenever I want an order and I have buyers remorse, all I have to do is make sure I order it with an accent. She understood what she was buying. She's cheap, and then she wants another $600 off? Even the guy that was with her said, "Give her the money cause she's old and has an accent." SMH! I usually agree with the judge, but not on this one. She gets a pass when the rest of us mear mortals have to abide by the contracts we sign.

It’s pretty clear what happened. - She said I want tile Fab A. - He said that costs X. - She said I can’t afford X. - He said well I can do tile Fab B for Y. - She said oh, like this one? - He said yeah yeah. It’s a Fab tile. She’s not understanding that it’s a whole different one. And he’s thinking they’re like the same thing and she probably understands. I can’t say for sure he was malicious, but he probably just saw her as a simple old lady and didn’t think she would be as picky. So he wants to keep 1/2 the cost of the item because he’s probably like “oh… I guess she really wasn’t understanding me..” and then he can sell it for half off or 25% off and make a profit. They’re not more expensive than the other. It’s just he only stocks the one he marks up higher and the other he can order online for a tinier profit. Probably just thought, “eh whatever I can order this stuff I don’t stock online for her and just charge her a bit more” but whether intentionally or not she wasn’t understanding.
