The plaintiff purchased a car from the defendant. She claims he sold her a faulty car because the check engine light went on the next day, so she’s suing for her money back. The defendant argues the plaintiff test drove the car and liked it, so he doesn’t owe her.

Even beyond the "As Is" issue, she doesn't even have the car anymore!! So even if she could prove he did something wrong, she screwed herself by getting rid of the car.

I honestly think the dealership saw her as a gullible woman a mile away and told her all those things were wrong with the car in order to get her to trade into a newer vehicle. I'm sure some of the listed repairs were legitimate, BUT I'm also sure a lot of what needed to be done wasn't really urgent or things that would prevent the car from driving. So, now they sold a (likely) new vehicle to her, and get to sell her car for probably twice as much as what they gave her for it. SMDH.

The thing that really got me is that she disposed of the car. For her to be able to get any money back from him, she would most likely have been ordered to return the car (undo the deal). This would not have been possible.

I think the plaintiff thinks she is the plaintiff and is trying to present her case and the judge keeps running roughshod over not only her case, but doesn't allow the plaintiff to answer her questions before she opens her fat mouth and vomits out more nonesense.

Yea they do that to make you spend money on things they believe you should replace. I was told by firestone that I needed 4k worth of work to my front end suspension to make the car ride like new lol. I said no im fine and declined their offer, and my car still rides like new lol.

They can troubleshoot to a degree. I had an actual mechanic come out and test a battery for me. He said it was okay, though the dealership told me I needed a new one for several hundred dollars. Two years later, the battery is still good. I have NO skills when it comes to car engines and problems and rely on honesty---which seems to be in short supply.

"Anything worth learning can't be taught in a school." I think that the young lady may be book-smart but she's a long way from street-smart. Having a Check Engine light on is not necessarily a deal breaker because simple things can cause the Check Engine light to illuminate, such as a gas tank lid not being on properly, which happened to me. I think that the plaintiff wasn't aware that any vehicle bought from a private citizen, as opposed to a car dealership, automatically comes with an implied, "As Is" status. The plaintiff is young & this is just one of many life lessons she's gonna encounter. She really got lucky with this case as she really didn't lose anything financially.

the men in her life proved to be of no help when it comes to used cars . all they needed to know is never buy a vehicle from a person who has not owned the vehicle for 3-5 years . anyone who owns a vehicle for a few months or less is a huge red flag . the men in her life should have known that and told her so .

There was some lying going on both sides of this case. But in the end, it was the plaintiff's responsibility to exercise due diligence by getting an independent 2nd opinion by a certified mechanic, before handing over any money.

The judge's summary advice about second opinion really rang a bell with me. Thirty years ago I set out from Seattle, Washington to near SanFrancisco when my car started "missing" with small jerks. I had NO idea what was causing it. While it seemed to correct itself, I was uneasy as I was a woman traveling alone with one young teenager and a 10 year old son. When I called home, my husband said to have it checked out at the first auto shop I came to. The 50-something year old mechanic looked me in the eye and told me the clutch was going out and it would cost $80 to fix it. I had to say okay because I knew nothing about cars, though the guy had an untrustworthy look. At the last moment he said I would have to wait 3 days as he had to order the clutch. It would take 2 hours to install once it arrived. I moved on down the road and was told I needed a new carburetor; then a whole new electrical system (the car was 2 years old); the brakes needed replacing; on and on it went ALL the way down to Auburn,California where, finally, a young 18 year-old kid listened to my frustration and the long list of very expensive and lengthy solutions to correct the problem, and he smiled sheepishly, and said, "Somebody's trying to cheat you, ma'am. If it's a clutch they're replacing, that's a BIG job. They have to lift the engine and it's really involved and will take a few days to do. It also will cost hundreds of dollars (at the time), not just $80." He went through every false diagnosis given and educated me why it wasn't any of those things. He was a nice kid; honest and of all the long-time adult mechanics I dealt with, he recognized I was a woman far away from home with two kids in the car who needed help. He's the only one who actually lifted the hood and spent some time looking for the problem, revving the engine. In the end he diagnosed the fuel pump needed replacing for $15. When he did so (quickly), he showed me on the old one where the problem was. I hope the young man stayed honest. I was disgusted by how many dishonest men there are in this world who are so calloused it means nothing to them when a mother comes in for help they cheat and lie just because they can. Why can't people just be honest? We all depend on honesty in many things of life. Nobody knows everything there is to know about building, dentistry, furnaces or any other profession. There's not a single line of work that can't rip people off, including all those dishonest mechanics who looked me in the eye and tried to scam me. When I would call my husband with the latest fake diagnosis, he'd tell me they were lying and move on. Over a thousand miles and at least 8 stops that I remember, and only ONE actually took the time----a kid---to check out the car. It's better to find a young guy who hasn't learned to be corrupt than to go to somebody with decades of experience but rips you off just because they can. I take my car to a dealership for service, but I'm smarter now and there's only one mechanic I will listen to and let work on my car after several different ones telling me work needed to be done that didn't. I think it's the way the dealership is run, but it no longer works with me.

What a dealership charges a customer is a lot different than what they pay to fix the vehicle themselves. Most dealers charge close to $200 an hour in labor alone.

As soon as she started talking I knew exactly where this case was going. But besides that, a lot of people in this world have to understand when you make a dumb decision you can't point the finger at someone else. Especially when you didn't do any research, take your time, and make the right decisions.

Maybe it’s because I have a lot of experience with used cars but a check engine light does not equate to the car being a lemon. You can need something as simple as a sensor or a fuse, and the check engine light will come on.

From some of the comments, I expected Judge Milian to be in rare form(extra "hangry"). However, she really only interrupted when she needed clarification or she was irritated that the Plaintiff was clueless. She missed a lot of red flags that even a 16 year old would have noticed. The car wasn't properly inspected, the check engine light immediately went on, she didn't even start the car before purchase, and the only estimate she got was from a Dealership. Everyone knows Dealerships overcharge and try to fix EVERY little thing in order to bloat the estimate. Also, the only thing she mentioned to the Dealership was the Check Engine light, not a noise. End of the day, the Plaintiff didn't do her due diligence and it was an as is sale.

These kinds of Plaintiffs tick me off. Her dad is with her when she looks at the car- sees the check engine light- goes to AutoZone with her and the Defendant, and STILL lets her buy the car. If AutoZone told me it was just a $45 part, wouldn't the check engine light go off? And her lurch of a boyfriend- could he not have gone with her as well, and warned her? The Plaintiff came across as an entitled spoiled brat- and a complete idiot. She sold the car to the dealership who clearly inflated the work that needed to be done- how does one get to be that age and not understand how car sales work?

The people in the group outside are clueless about cars. The check engine light will come on for simple issues like a loose gas cap or bad fuse,! It does not mean that the car "is a lemon". It less about the engine but more about other parts of the car that may affect the engine. She got had by the dealership! Once I took my car in for a simple problem. While fixing the issue they "inspected" the car and came up with $3000 worth of "suggested repairs". I never did anything on their list. It's often just a way to make more money.

That poor girl makes a lot of bad decisions. Not getting a car checked out before she buys it, taking a car to Auto Zone to get it checked out, taking it to a dealer for any kind of diagnosis, letting the dealer talk her into getting a new or newer car without getting a second opinion on the problems with the car, that boyfriend. This poor girl is going to be a single mom in a shelter with no transportation by the time she's 30 if she keep this up.

Is she that stupid that she thought she could sue him to get her money back yet she has already traded in (sold) the car, so what exactly would she be giving back to him? She got screwed by the Nissan dealer who gave her an estimate of nearly $6000 to fix it up like new again, NOT for essential repairs. And then got screwed when she took it for a trade in who only gave her $4000 knowing they could fix it up for a few hundred and then probably resold it for its value of $8000. She was a fool not once, but three times, I hope she has learned her lesson. Also, it was an AS IS sale, these basic things should be taught in school, it's amazing how many people are this dumb...

I think the dealer overstated the repairs needed because he wanted to put doubt in her mind and sell her a newer car. If the new part needed was as simple as a o2 sensor the dealer knew it. she should have taken it to a mec. who would have nothing to gain reading the OBDII results.

Wow I almost fell for her story. But the the dealership in their notes said "customer states check engine light on". But she knew he bought the car 3 months before, check engine light came on while driving it, she didn't get it checked before buying it and none of that made her stop and think before getting it?! People can use their phone to research any and everything but don't look up what to do buying a used car from a private party

@@crystalshaw8744please do. I had a girl her age call the police on me and had me arrested, they later conspired together and said I ran over her pinky toe...not kidding, she even looks like her. The case was so made up that the mayor fired the cop and I took the case to court where the judge told the prosecutor that the case was so absurd that it wasn't worth the court's time. And yes, it was because she thought I was rude to her, which I may have been, but to make up criminal charges...I no longer trust any woman and luckily I'm gay so I don't have to end up with one.

Shes misunderstanding vehicle diagnostics. Autozone has the capability to pull the trouble codes to see why the light is on. The misunderstanding is that those trouble codes tell you what errors it is seeing and thats it. Just because you get a code for an evaporative emissions leak for example, that leak could be because of numerous things ranging from a loose fuel cap to a broken vacuum hose to a fuel tank evap solenoid. Thats why you start with the trouble codes and that gives you a place to start looking

SMH. Her boyfriend AND dad are useless!!!!! One of them should have taken the lead. That's the first thing. Second thing is that a dealership will ALWAYS milk the customer for as much money as humanly possible. I bought a 19-year-old Volvo almost 3 years ago and took it to a Volvo dealership for an oil change. They told me I needed a little more than $4K worth of repairs. It was nitpicking stuff. My response: "I just want you to change the oil." Still driving the car with absolutely no problems. It currently has 248K miles on it. At the time, it had 225K miles on it.

Don't trust people at Autozone to diagnose your car. These people are not mechanics. They are parts jockeys and are only telling you what the scanner is reporting. If you really want to know, do your own research on the codes but if you know nothing about cars, leave it to actual mechanics.

NOTE: The check engine light is USUALLY ONE OF THE CHEAPEST REPAIRS! The judge and Harvey are being ridiculous, and unrealistic. In three different cars that light has come on, and the repairs were cheap. Half the time, it’s just a sensor. I drove for months with that light on before when I was struggling. Months. It’s usually not anything serious.

The defendant is a really bad person. He sells her the car for $7400, and then, shortly after, takes it back in for only 4000? Are you kidding me pass? I can see her being out the $600, but, you need to give her the full amount, but she paid for that car towards another car. I hope people see this guy I never do business with him. He’s unscrupulous, and he is trying to take advantage of people.

Another problem this woman had was ,even if she was able to get her money back, she would have to return the car to the seller. She can't have it both ways. I'm surprised that the Judge didn't mention that when the plaintiff told her that she no longer had the car.

😮 How could this happen with Google at everybody's fingertips? 1. Tips on buying a used car in (state) 2. Check KBB for pricing by condition for the year/make/model by private owner/dealer 3. Test drive for city traffic, AND on an Interstate to check propulsion to 60 mph 4. Check brakes on clear Interstate for pulling / stopping You don't have to go it alone... ( I always had to pay more if my boyfriend tried to fix it, but I always ended up having to call a repairman on everything.)

Check engine light B.S. My check engine light has been on for YEARS!!! I've owned it since 2012, Every light on the dash is lit up. Just drove from Fl to Wi and back to N.C. in 2 weeks. It's a Pontiac Gran Prix 2006.
