If we have a receipt Date of January 10 from Nebraska service center and 3 US born kids. Would we be closer to the 12 months or the 27.5 months? Please, please inform me. I we are almost out of hope..

My fiancee is abroad and he was inadmissible under 212(a)(2)(A)(ii) for Marijuana use under 28 grams he was convicted paying a fine of about $1.00usd in 1996. We submitted the i-601 waiver but should he apply for something else? He's trying to come on a K-1 visa.

That would be the proper waiver. However, just submitting the proper wavering, and having it approved or too completely different things. A waiver is discretionary, and it must be approved based on all the hardships and evidence that is presented in in order to move forward.

Thank Sir for all these useful informations, now everyone is worried that processing time may be more than a year, especially when uscis changed the processing time from 12 months into 27 months, can you please explain this?

Hello. There is of course a difference between processing time and visa waiting time. There’s nothing that can be done with the visa waiting time as if it backlogs it backlogs and you must wait till the visa number becomes current. As for processing time, if it extends unreasonably, you can always file a writ of mandamus to sue them.

Unfortunately we got divorced before hearing from USCIS. I wonder if one day I can travel to the USA or I should forget about it
