Both things can happen. Allowing them to 'resign' just saves the City the effort of having to do an investigation to terminate them. They can still be prosecuted, and in states where it is allowed they can still lose access to any taxpayer funded retirements based on the outcome of that prosecution.

Police unions are a huge part of the issue. They protect "bad apples" by requiring tedious administrative hoops be jumped through before a cop can be punished or fired. District Attorney's drop anything pending the officer was involved in automatically because they are instantly useless in court. Once that happens lawyers of anyone convicted with him as a witness in similar cases can get them overturned or new trials. I remember a prosecutor who had hundreds of cases tossed for tampering and withholding evidence. The idea is that nobody in law enforcement is caught the first time or for their worst crime so their entire record is suspect. Remember "better 10 guilty men go free than one innocent punished"? Crimes by anyone in the justice system should receive mandatory maximum sentences
