From what I know, you can still detain someone if you reasonably believe a crime was committed. However, you had better be positive, or else you can be charged with false imprisonment or some other crime, depending on state law. The whole issue will end up coming down to self-defense, and I know that at least in Wisconsin, even provocation does not forfeit the right to use deadly force if you believe your life is in danger, which could very possibly apply here as well.
@mobetta20922 жыл бұрын
@@thegamsta7133 Your last sentence implies that a pedestrian could abruptly cross in front of a moving vehicle and legally shoot the driver with a self-defense claim because he felt the vehicle was a threat to his life. (A person can't instigate a situation then play victim). This is no different than Travis testifying that he aggressively chased Arbery down, including changing paths of direction in order to interfere with Arbrey's attempt to avoid him. Gets out of the vehicle with shotgun without announcing who he was or what his concerns with Arbery were, while blocking Arbery....then say "self-defense" when Arbery fights the deadly shotgun threat that he (McMichael) chose to pose. If a vehicle was chasing you and you feel the occupants are gonna rob or kill you, will you think it's justifiable for them to kill if you choose to fight your way out of the situation? And their justification is that you defending yourself from their aggressively unknown intentions made you the threat that needed to be killed.

Looking back on this I caught where he messed up, She asked if he had met Ahmaud or encountered him before which he replied no he didn't and didn't know what the black man from 12 or whatever days ago looked like (1:05) and (1:59) . But then he's asked to confirm that he'd seen him 2 other times (2:43) and then say's "oh he's been there 2 other times (2:51) and said he did have an encounter with Ahmaud on Feb. 11th (2:55). uh sir you said you never met this man or encountered him before which is it he couldn't keep his stories right.

It pains me to say this but the whole defense case is based on a citizen's arrest law. Under that law if the factors are correct they can and are arguing they had a right to detain him. I don't believe them and I don't think the jury will believe them but that is the defense.

It's was a smart move, leaving the jury to think about how much Travis has changed his story over night and she gets to come in pick him apart in the morning.
