From what I know, you can still detain someone if you reasonably believe a crime was committed. However, you had better be positive, or else you can be charged with false imprisonment or some other crime, depending on state law. The whole issue will end up coming down to self-defense, and I know that at least in Wisconsin, even provocation does not forfeit the right to use deadly force if you believe your life is in danger, which could very possibly apply here as well.
@mobetta2092
@mobetta2092 2 жыл бұрын
@@thegamsta7133 Your last sentence implies that a pedestrian could abruptly cross in front of a moving vehicle and legally shoot the driver with a self-defense claim because he felt the vehicle was a threat to his life. (A person can't instigate a situation then play victim). This is no different than Travis testifying that he aggressively chased Arbery down, including changing paths of direction in order to interfere with Arbrey's attempt to avoid him. Gets out of the vehicle with shotgun without announcing who he was or what his concerns with Arbery were, while blocking Arbery....then say "self-defense" when Arbery fights the deadly shotgun threat that he (McMichael) chose to pose. If a vehicle was chasing you and you feel the occupants are gonna rob or kill you, will you think it's justifiable for them to kill if you choose to fight your way out of the situation? And their justification is that you defending yourself from their aggressively unknown intentions made you the threat that needed to be killed.

Strange that the 3 stooges and neighbors claim that there was so much crime in their neighborhood yet they leave guns and purses laying around in their UNLOCKED vehicles, who does that even in a safe neighborhood? That alone tells me that they are exaggerating crime in their neighborhood or they’re just careless or dumb or both, seem as though they care more about the property under construction than their own property. Btw who leaves a gun in an unlocked vehicle on New Years Eve or any eve? Prosecutor need to stop letting Travis get away with saying Arbery was breaking into that house especially since it was open and under construction without any No Trespassing signs posted

Not really when the defendants are dumb asses who didn’t know a damn thing about lethal use of force, self defense for citizens and when it’s authorized or legal. Which is far, few and between in most cases but it’s there. And the only time one can really shoot a fleeing suspect is one, the trigger puller had to have witnessed a heinous act and the suspect positively identified and they better be a imminent threat to everyone and anything if they’re not stopped on top of, you better make it known you’re the good guy before you shoot. And that’s just one aspect in a very complex topic. A lot easier when you’re law enforcement because it’s expected of you to get into physical altercations and stop dangerous people who might be bigger, heavier and stronger than you more often than not.

Thank you Noel. You know this, I know this, we all know this. I don't know why they're trying to redefine self defense. I had a childhood friend who's dad got into a fight outside of a bar and shot and killed a man. He went to jail, because he could have avoided the situation. Had he not been armed he would have probably gone the other way. I'm not saying it'd the gun's fault but the gun gave him courage to put himself in a dangerous situation. Just like the McMichaels.

Travis. Since you honestly think this was perfectly okay for you to do, let me give you a little scenario that might change your opinion: According to you, it is perfectly acceptable if 3 guys in prison corner YOU to a spot you can't escape. They THINK you MIGHT HAVE stolen their soups. They are screaming threats to you. One of them hits you. Your fight or flight instinct kicks in, and you try to fight them off. They Stab you. They don't get in trouble cause they said they were just acting self-defense against you. If you think what you did to Ahmaud was okay, you should be okay with this if it happens to you in prison.

It pains me to say this but the whole defense case is based on a citizen's arrest law. Under that law if the factors are correct they can and are arguing they had a right to detain him. I don't believe them and I don't think the jury will believe them but that is the defense.
