@@malachiwalsh1641 Actually police are encouraged to lie in order to make people talk, which often leads to people digging their own graves. Be polite, but you don't need to answer questions and you can deny consent to search. Police dogs can only hit on cars for a search, not your persons.

You can only be searched if you're being arrested on a charge or if you clearly have something illegal in your car or on your persons. I. E. Weed pipe on your dashboard or a joint in your ear.

Dylan Peterson he had warrant's under his real name. So now he will have some new charges. For giving false information. My question is, how can you not have any proof of your name? School ID, DL, bank card, CC, library card, CCW, military ID, Sam's club card, fishing license and a bunch of receipts. That's all what I found in my wallet.

It doesn’t matter if he was doing anything you don’t have to provide identification unless you are suspected of committing a crime thus far he can’t be detained. Technically the cops are wrong in this for heckling and using their means to “protect the constitution” which they don’t do in the first place.

Notpureftw Are you in any Criminal Justice and Law classes? No, okay then, so don't tell me Suspicious Activity isn't a crime, which is actually true, but detaining someone for S.A. can either lead to the labeled suspect being set free OR get asked questioned and possibly be arrested and sent off. Billy Smith he’s loitering on private property with a backpack and has a hood on in a high theft area. The police are already patrolling to keep people away from closed businesses and approaching anyone planning to rob is already a deterrent. Then when he’s trying to hide his identity when the cops always have to identify who they contact in every instance,there was something wrong. Then they found his warrant and it all came together. Police work 101 keeping scumbags from causing more trouble.

Justin Gibson private property ? It's a public store. For all they know he could have just bought something and was walking home. They have no right to stop him for simply walking. He hadn't committed any crime and just because a cop is 'suspicious' of you, that does not give them a right to question and search you, unless you've committed a crime

When I was a correctional deputy, I would occasionally have to cover the intake/booking control center. The patrol deputies loved when I was in there. They would text me asking if I could search the penal code book for codes they knew existed but they didn’t know what the code numbers were (the penal code book was over 500 pages). I would google California penal codes and find them immediately. By the time the deputies arrived in booking, I’d have the booking sheet filled out for them already. I would also search social media and go through booking photos whenever we would get someone in using a false name. Once I would find the correct name, I’d text the arresting officer(s) with the info. They would then come back to the jail and add more charges on the arrestee. None of the other correctional deputies or technicians would help them out that way. After I was medically retired out, I found out that a few of the patrol deputies had started a band but didn’t have anywhere to practice. I offered my studio to them and eventually I ran sound for them when they played a few shows. They would tell everyone how easy I made their jobs when I was covering booking. I found it to be fun sleuthing around and finding the correct code or name for them. It’s crazy how many we actually caught just by searching facebook. Not many had private accounts so it was easy to play connect the dots when looking for them. There were a few times I even found people with warrants who were posting public pics of them with drugs and guns. I’d send the info to the detectives and usually they would find them right where they posted they were. Edit: Spacing

I doubt that's an illegal technique but I could be wrong. I mean they're allowed to lie when interrogating you at the station, they're allowed to say that your buddy snitched on you even if he didn't in order to try to get you to snitch on HIM. And they'll do the same thing with him in regards to you as well. Using deceit and lies to get more information towards the truth I just have a feeling isn't illegal but then again I am not a lawyer or a criminal justice major either. Because it's legal in other interrogative fashions though I think it's fair game. And yeah it was pretty smart I agree ... especially if it is a legal, fair move after all.

they never claimed that him not having a facebook was suspicious. they were just going to use it to see if he was lying about his name. the fact that he saw a police car and ran the other way, hesitated when saying his "own name", continued to lie about who he was even with contradicting photos being shown to him and lying about the date he was "already arrested" was the suspicious part.

You also have a right to be sent to jail for impeding an investigation. The fifth amendment only applies to court cases, it doesn’t apply to those questions. You have a right to remain silent when asked but police officers have the authority to arrest you for impeding an investigation if you’re suspected of a crime and decide that you’re not going to talk. They’ll find out who you are either way. Cooperating is easiest because at least then the police will give you some leniency. Don’t encourage people to make bad decisions. Easiest thing to do: don’t break the law and don’t act like you’re guilty of breaking the law. If police ask you for a name, give them your proper name. Lying to them will only add another charge to your docket once they find out you’re lying.

They can't use "being suspicious" as cause for a stop. The courts have ruled that whats suspicious is different for each person. Whats suspicious to some is not for others. So the courts ruled that to prevent each person opinions, preferences or biases to be the basis for a stop.

"Yes I am detaining you for suspicion of vehicle prowling, the businesses in these areas have been burglarized and they're closed right now so I'm detaining you while I investigate why you're on this property." If the police see suspicious behavior that they can articulate they are allowed to detain the suspect and pat down the individual for weapons(See Terry v. Ohio) and conduct a brief investigation. This guy could have avoided ID'ing himself and getting in any trouble if he didn't lie, but since he lied it opened up a new can of worms. The second he gave a false name to the police he committed a crime.

Another trick I would use is to ask for their DOB and then later in the conversation I would ask how old they were. 9 times out of 10 it would catch them off guard and you can see them calculating in their head or they would just be wrong.
