Happy New Year DyReck! I struck gold when I found your channel this year. The laughs and topical information have been top notch. As far as this video, my personal goal is to take any sound I use, paint it, and make it my own. A sound from a library, an old record, the sounds that come with the unit I buy, etc... That’s where the magic happens and where the fun is for me! Gotta be careful if I'm using it professionally (clearance and due diligence are the way), but for a mix to share with a friend or personal entertainment, all bets are off lol! One thing I am doing is for every project I do, I make a note of the samples I use just in case. That little extra effort can save time and money if in the future someone may be interested. Anyway lol...See you next year Dyreck!!! Best of wishes and I'm looking forward to the next upload! Big Up Yourself Brother.

I have sample-based keyboards and modules with a lot of presets on them, like the Fantom-0, Integra-7, and Nautilus. So yeah, I don't mind using presets at all to build a composition. However, if I want to create synth sounds from scratch, I also have plenty of analog synths to do that too. Now as far as using copyrighted sounds illegally taken from hatdware I don't own, well, that's no different than sampling without clearance. I'd steer clear of that if was working on something planned for commercial release.

Presets are there for you to use in your music. They're just sounds. It's when you use "Product Demo Songs" like Swizz beats did and try to claim it as your own work or try to copy and sell those Presets patches as a manufacturer on your own gear. You have stock presets from Roland all over commercially released Albums from Grammy winning artists that have sold millions of records. Like Michael Jackson's BAD album. Roland D05 presets all over that album. Using the stock sounds to make original work is what they're there for there's no problem with that. It's the idea of taking the sounds off one piece of gear and using it on your own gear or software that your company develops and reselling it to make money. Now that will get you into trouble. On a side note about the Swizz beats thing the whole rumor was he got sued by Casio for making songs using their demos. The truth is those sounds didn't come from a Casio. They were from the Roland Boss Dr. Groove. DR 202. I brought one of those back in the day and it had a lot of songs that he straight jacked from the Demo Songs on there. I never looked at him the same. Neptunes also. The didn't steal anything but they sure did jack all the Korg Triton stock sounds like a mofo.
@kvmoore1
@kvmoore1 Жыл бұрын
@Ameretsu Shidori Interesting read. Wow, I used to own a Boss DR202 Dr. Groove as well years ago. The sounds in it were nice. And yeah I agree, producers who jack demo "songs" (which are copyrighted) from hardware synths and claiming the work as their own are just as guilty as sampling from a record without clearance. They should be sued.
@DodgaOfficial
@DodgaOfficial Жыл бұрын
It's actually much different, you cannot copyright a timbre. You can copyright melody and other aspects of music, but timbre is not copyrightable, so sounds from hardware you don't own are able to be used without worry, as this lawsuit has nothing to do with having a copyright on the actual sounds like cymbals and drum sounds, it's the technology behind how they are generated that is being infringed. Akai is using technology in their products that is patented by Roland, that's what the issue is. If akai had their own unique technology that wasn't patented by Roland, they could literally have a machine that produces sounds identical to Roland and Roland would not be able to say anything, you can't copyright aspects of sound such as timbre, attack or release times, pitch modulation, etc, those are too vague and general. Somebody being able to own a specific combination of saw and square waves would be the same as owning something like the c major chord, or owning the sound from a particular violin, you can own the method used to produce that specific violin, but you cannot own the sound it makes.
@kvmoore1
@kvmoore1 Жыл бұрын
@Daniel Mihalko Yeah, that does make perfect sense. I mean, how can you copyright a "drum sound" such as a kick, snare, or hihat? Musical compositions, yes, I can see that, but drum hit? What if someone else created a similar drum sound from a completely different source using different tools and the end result sounds exactly like your product. How could you prove that person stole the sound from your samplepack? Nawh, I don't see how you can copyright a drum sound. Then again, who knows? There is so much red tape involving sample-based sounds in addition to sample-based music these days. Everyone's after that buck, and they always will be.

I had an MPC live, Force, and have used Yamaha Motif and Korg instruments and they always seem to lack some of that soul that the Roland comes through with. It's hard to think of the modern InMusic Akai to be the same company as the Akai we know and love from the 80s and 90s. There are still echoes of the old company there to be sure, but we've got corporate heavyweights playing rock 'em sock 'em lawyer battles now. These aren't the companies of old who resolved conflicts during NAMM in a third-party's corporate lounge. Even Roland is now in full mobile suit armor mode. Makes me wonder what Yamaha is up to

These companies now are pushing out more products than they've ever been. They have to protect their products more so now than ever because of all the clones and copy cats just stealing from them with no shame. That money they got is from damages. But if you find a good sound and it wasn't yours, you should at least get permission etc... i think that if Roland WASN'T making their old sounds easily available in different ways, it would be ok, But Roland is still trying to sell them, so i like to do it by the book and buy the sounds

So this has nothing to do with sounds per se, but rather, the technology used to generate those sounds. You cannot copyright a cymbal sound, timbre is not copyrightable, you can however get a patent for generating those sounds, and that's what this lawsuit is over. Akai is using technology in their devices that Roland owns a patent on. If akai was using their own unique technology and it just happened to produce sounds identical to Roland products, that wouldn't be an issue, again, you cannot copyright a timbre, it's too general.

No surprise from Numark/InMusic, Jack O'Donnell is a no good CEO. He blocked Rodger Linn from receiving Royalty payments of his own original patent designs from the original AKAI company prior to buying out AKAI. Also sampling Rompler hardware is illegal as I stll see people selling MOTIF, Fantom, Triton and JV sample packs all over ebay.
