The fact is the previous Sulu Sultan didn't want that piece of land, he only want money, and accepted a small token sum as lease. Now the descendents are complaining that 5,300 riggit is not enough to share among 9 families. These so-called heirs of Sulu Sultanate are behaving like beggars.

The money was not for "lease". There was no proof that showed the payment was for "lease". And there was no "lease" agreement document that the name of the country "Malaysia" written in it.

Philippines claim on North Borneo based solely on historical and legal rights is very dubious without any evidence. First, Sultan Sulu claimed Sultan Brunei give North Borneo to Sulu as a gift in assisting Brunei’s civil war is without any proof. Earliest historian like Sir Stamford Raffles (History of Java) in 1830 said it was a claim. The agreement between Sultan Brunei and BNBC on 29 December 1877 which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC show that North Borneo was still belongs to Brunei. The onus is on Philippines to disown the claim make by Brunei that North Borneo is not given to Sultanate of Sulu. Second, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain. On the same day, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the agreement (22 January 1878 agreement) between Sulu Sultanate and British North Borneo Company (BNBC). The agreement between Sultan Sulu and BNBC on 22nd January 1878 is null and void. The issues whether it is a rent or cessation and translation in English or Tausug is legit is no more valid. On 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. The issue was later raised by Spain with the British Government. Finally, the issue on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. Again, on the 25th November 1957, the latter Sultanate of Sulu declared termination of the lease between Sulu and BNBC effective on 22 January 1958. Thus, the agreement is null and void twice. Third, there is no such agreement between Malaysia with the Sultan Sulu nor Philippines on renting and payment on North Borneo. The 22nd January 1878 agreement is only between Sultan Sulu and British North Borneo Company or BNBC. Any dispute between parties need to refer to the Majesty’s Consul General in Brunei as in the agreement but there is nothing in the record. Earlier the British (before formation of Malaysia) also do not have such an agreement. You pay when there is an agreement. It was only a gift from Malaysia after the Manila Accord meeting 1963 as requested by Philippines Government to cool down the situation. That is why the amount is ridiculously small in Malaysian dollar and not Mexican Gold Dollar used during that era (1878). Fourth, on 17th December 2002, in the case of ownership of the islands of Sipadan and Ligitan between Malaysia and Indonesia, ICJ make a decision rejecting Philippines intervention in the court case (historical and legal rights on North Borneo) on the ground that there is non-existence of an interest of legal nature. Attesting that the Bases of Peace and Capitulation agreement in 1878 between Spain and Sulu is definitive as Sultan of Sulu has definitively relinquished Archipelago of Sulu and its dependencies to Spain thus include North Borneo. Fifth, since 1946 till 1962, Philippines Government has remained silent on 4 occasions since its independence to prevent the development of a prescriptive tittle by British. Firstly, it took no action when British purported to annex North Borneo on 15th July 1946 by virtue of North Borneo Cession Order. Secondly, no steps to amend or otherwise dissent Article 1 of its constitution. Thirdly, did not until December 1962 enter a reservation against the submission by United Kingdom to the Secretary General of the UN of information on North Borneo required under Article 73e of the Charter. PH was one of the members of the ad hoc committee set up to examine the information supplied. Fourthly, as late as 17 June 1961, a Philippines law was passed which in delineating of the Philippines territorial sea, made no mention of any extension of Philippines sovereignty to North Borneo. And Sixth, on 4th August 1977 during the ASEAN Summit Meeting in Kuala Lumpur, President Marcos declared he will take steps to drop Philippines claim on Sabah. An agreement or undertaking made orally between two states is as valid as a written treaty with reference to Article 67 of the Vienna Convention on Law of Treaties 1969 because at that point of time, President Marcos was the Head of a State.

@@angeloqt7628 Read history chronologically. Many events happened and changed the history. Do not cherry picked when reading it. ICJ already acknowledge it in 2002 that the Madrid Protocol in 1885 is valid thus North Borneo belongs to the British. Earlier, in 1878, Sulu had relinquished its territories to Spain. The rest is history. Argument should be based on fact.

@@angeloqt7628 As I said earlier, many events happened that changed the history of all these kingdoms. Study it chronologically as every event has an effect much later. As for now, ICJ in 2002 in a court case pertaining the ownership of Sipadan and Ligitan Islands recognize the Madrid Protocol 1885 that North Borneo belongs to the British. Later the British give it to Malaysia.

sabah was rented by Britain from the sulu sultanate then they handed it to malaysia along with the rent. sabah did not join malaysia, they were simply handed by the British that's why malaysia is paying rent to the sulu sultanate.

On 22 July 1878, the then Sultan of Sulu had relinquished all his possessions and the sovereignty of Sulu and it's territories including North Borneo (which Sulu only claimed) to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory. Then in 1885, to resolve overlapping issue on North Borneo and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered North Borneo to Britain. What ever happened to North Borneo after that was under British jurisdiction.

Aquino (and to some degree, past Presidents as well) is reluctant to pursue the claim because he knows that it is weak and unlikely to succeed. No President wants to be known in history as the one who pursued and lost the claim forever. Instead, it is in the Philippines’s best interest to let the claim remain dormant or outstanding so that it can be used repeatedly as leverage or bargaining chip in negotiations with Malaysia on other matters.

The Philippines made it clear that its position on the inclusion of North Borneo in the Federation of Malaysia is subject to the final outcome of the Philippine claim to North Borneo. The Ministers took note of the Philippine claim and the right of the Philippines to continue to pursue it in accordance with international law and the principle of the pacific settlement of disputes. They agreed that the inclusion of North Borneo in the Federation of Malaysia would not prejudice either the claim or any right thereunder. Moreover, in the context of their close association, the three countries agreed to exert their best endeavours to bring the claim to a just and expeditious solution by peaceful means, such as negotiation, conciliation, arbitration, or judicial settlement as well as other peaceful means of the parties’ own choice, in conformity with the Charter of the United Nations and the Bandung Declaration. 13. In particular, considering the close historical ties between the peoples of the Philippines and North Borneo as well as their geographical propinquity, the Ministers agreed that in the event of North Borneo joining the proposed Federation of Malaysia the Government of the latter and the Government of the Philippines should maintain and promote the harmony and the friendly relations subsisting in their region to ensure the security and stability of the area.

Manila Accord dated 31st July 1963 is not all are binding as the word used is not in accordance with words normally used in treaties. Such example is on Article 12 which is peculiar to PH only states PH position (“…its position…) on the issue and Malaysia and Indonesia “take note” of PH claim. The statement that is binding is Article 10 of the Manila Accord 1963 stated that the ministers (Indonesia, Malaysia and Philippines) “agreed to the adherence the principle of self-determination for the peoples of non-self-governing territories” which in accordance to UN. Also, in Article 10 statement such as “… would welcome the formation of Malaysia…”.

The easiest way to get this right is UN/PBB/ICJ need to ask all SABAHAN if they want to be part of Malaysia or Philipines.. but then u will know the answer.. as ICJ said historical issues are historic nuff said~

I just hope that the people who says that Sabah belongs to Sulu knows that Sabah was under the British that has gain their own independence through their own ways. If Sabah wants to be under Sulu they will go for it long ago. Claiming the land that has become the land of the Sabahan is like taking someone else wife that once used to be his wife which is totally unlawful and disgusting.

The lady speaker @ 28.34 - 28.36 had take off her earphone and she is seem to be a bit piss off because she was interfered during the interview. Overall she's is doing pretty good job in bringing out the issue of debate...interesting.

No, the earphone was making her uncomfortable all the way from the beginning. But she had to put it on to get instructions from the producer. Then at 28++ min, the producer informed her that the time was up and she has got to end the conversation.

Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate. But what they will not revealed are those that can refute their claim. You meant to say "to basically own it as an international property" like Sultan of Brunei owning hotels, mansion, malls in UK, then you need to have documents of ownership. Sulu claimed that Sabah was given by Brunei to Sulu. Sulu has to produce document of transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans.

I think if the Datu bring there case to ICC with their documents and historic evidence ,instead that they depend on the republic for the case which had a dramatic effect,then the president would be more willing to cooperate without the intervention of the US. REPLY

The people living in Sabah have two options to choose from: 1. They can relocate to Sarawak or return to peninsular Malaysia and retain their Malaysian citizenship, 2. They can remain in Sabah and be affiliated with the Sultanate of Sulo and choose Philippine citizenship.

so the sultanate of brunei gifted sabah to the sultanate of sulu, without the government of the philippines knowing causing them to not claim it, then the british crown started paying the sultanate of sulu so that they could stay in sabah, then the british gave sabah to the malaysian government, causing malaysia to keep paying until 2010?

Sulu only claimed that Sabah was given by Brunei to Sulu as a gift for purportedly helping Brunei fight rebels. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both sultans.

@@hmmmm4446 Why? Legal documents are signed between British and Sultan of Sulu. The document also called as ''padjak" contains "lease" or "rent" for the land of Sabah. But after giving independence to Malaysians, British illegaly give Sabah to Malaysia without consulting Sulu Sultanate. So our claim is strong! We are not giving any part of our land to Malaysia.

It is clear. I could understand what he is trying to explain. It could be both Malaysia's and the family of the sultan's property. The family can own properties outside the Phlippines. The Philippine government should just give up their claim to it. True you are giving natural resources away but it wasn't the property of the government historically anyway. Only the family has claims to it.

Please read the history about that and until now the Malaysian pay the lease to the sultan of Sulu ( Philippines). Why not talk about the problem in Sabah ? We know the Malaysian and some Filipinos are muslim. I know in my mind the government of Malaysia was scared the Sabah was gone so the minister was use the force. @@samjone478 yes that was a joke for Malaysia Parliament before, but this time, it's became a head ache for them. When Malaysia Parliament stopped paying the lease since 2013, that breached the contract. Paying the lease is a strong evidence that the property has not been sold or taken. There's a receipt of payment as evidence. That's why the ruling of court was in favor to the Sulu Heirs. Malaysia can pay $14.9 Billion or return Sabah to the heirs of Sulu Sultanate and the Philippines..

Don’t conflate ethnicity with the concepts of nation-states. During the middle of the 20th century, the Philippines was prosperous and ahead of the rest of Asia, surpassed only by Japan. Don’t forget that your precious ex-British Experian subjects were not the prosperous nation they are now. The empires that used to control the various nations of south east Asia are not the determining factor on who will develop into a prosperous nation.

I am from Mindanao and the people that you just said who are messing up are no other than the rebels and the terrorist who killed and kidnapped people and these group wants to gain independence but the majority of the citizens who live there only wants to live a peaceful life, so why would the government gave up Mindanao? that is owned by the Philippines and all the Filipino citizens... that is the reason why the Philippine Army has to fight back with them. I agree with u seeing those intruders especially claming the land they did not own gives me more hate againts them. Why our government not taking a stand here. I see the potential of these claimed island as Philippines solution to poverty. In a way our government should take a stand in bringing this to the international court where they can see to them selves who have the better claim. Its common sense why Malaysian government paying lease to sultan of sulu? Meaning they just rented it and they didn't own it. So I wanna challenge the sultan to perhaps show to the public all the testified document to prove the legitimacy of the issue and let our kabayan stay to land where they have permanent residency. Its a leap of faith to brought this to the proper judicial process and see who will lead victorious.

i don't agree with you! because your coment become nonsense! yes its true that sabah or north borneo was given to the sultan of sulu by the sultan of brunei in 1704 as a military gitf. but anfortunately sultan of sulu had pawn sabah to the austrian developer.and both of them agreed for annual rent of 5300 mexican dollar. now! when the philippines established as a state and the 1935 constitution came about the philippine state and the 1935 constitution itself are the very reasons why the historical nobility or outhority and thats included the sultanate of sulu is not recognise allready. because according to international court of justice states can react only between the state. and the issue to sabah claim, the claimant is only one person and that is the sultan of sulu. thats is why the international court of justice did not recognise him as a sole actor regarding that claim.and furthermore! sabah is now one of the three major states of malaysia that is why it is not simple as according to ur opinion. and we filipinos and the republic of the philippines had signed to the asean agreement that every country included the philippines, to promote peace to every member of asean. and the problem in regards to sabah claim is based on the international treaties and agreement. because sultanate of sulu is no longer a political entyties. and those are the reasons why there are dificulties on sabah claim.

That was why he couldn't answer because the payment was not for "rent", it was just a token consolation for the heirs of the former Sultan. On 4 August 1977 during the ASEAN Summit Meeting in Kuala Lumpur, President Marcos declared he will take steps to drop the claim on Sabah. An agreement or undertaking made orally between two states is as valid as a written treaty with reference to Article 67 of the Vienna Convention on Law of Treaties 1969 as at that point of time President Marcos was the Head of a State.

Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. This information will easily be cherry picked in any of their discussion or debate. But what they will not revealed are those that can refute their claim. The followings are few of the information that had been kept secret: Firstly, the agreement between Sultan Brunei and BNBC on 29 December 1877 over North Borneo which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei. Secondly, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement). Thirdly, on the same day, 22 July 1878, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void. Fourthly, on 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. Sulu for Sulu's Sultan Sabah for Sabah's Sultan..two entities..The old Palace in Sabah belong To Sabah ..Why Sulu claim that The Sultan Palace in Sabah is not belong to Sultan Sulu..Historically Sulu was part of North Borneo ,under the Domain of North Borneo's Sultanate ..The relation of Sulu and Sabah was only thru married , The Deeds known as Pajak was only between Sulu and British sign and agreed after the Death of Sultan of North Borneo..The Claimant arise from Sulu should not be arised Koz The Estate belong to his brother inlaw ( Sultan of North Borneo )..the claimants from sulu heirs should be Deny..Koz ..He ,Sulu cannot Inherit that Estate ..on whom He/ she were not Entitle to It...That was also Tbe British mistaking and wrong doing ..let to Sign that Contract by paying annually 5k Ringgit to Sulu ( Sultan )..

Sabah became independent nation on 31 August 1963 prior to establisment of Malaysia in 16 Sept 1963. The sabah people agree to join federation of malaysia along with Malaya, sarawak and singapore The fact in here is the Sabahan people have liberated themselves from British and Sulu Sultanate so Kiram and Philippine claim on sabah is no basis

People are free to choose what country they want to join but what about in land it was a private property that is a different story hahah do you think sabah is the only country sold or rent in British even the Philippine was sold also in US government including Guam and Puerto Rico under treaty of Paris but we are able to buy it by using srivijaya and majapahit wealth that is many people dint not know

No matter how much research done, the point is Sabah is owned by the people of Sabah. Let them say what they think. In 1963, they join Malaysia, now 'maybe' different. However, it is part of Malaysia and no matter what, the Sulu king army is an armed invaders not representing Philippine - hence, terrorist. Bring it to the International Court first. Doing Leroy Jenkins style dont work.

The Philippines must RECLAIM Sabah at all cost...Not just for the sake of Sultanate Zulu but for the common good of the Filipino people. MALAYSIA was only created as an Independent Country in 1962, infact Singapore was supposed to be part of Malaysia; but she decided to separate from Malaysia in 1963 and form its own as a City State. It was not Malaysia which ALLEGEDLY, KICK OUT SINGAPORE from the Federation; but it was Singapore which decided to separate instead. (Reference: Circling the Globe printed in the US in 1996). Sabah by RIGHTS and History was part of the Philippine Archipelago even before its Liberation or Independence from the Hands of Spain in 1898. So, the PRIOR RIGHTS over Sabah is none other but the Philippines.

As sabahan natives myself, we have the self-determination to hold on. Sabah has far developed within Malaysia far greater than the Philippines themselves. Then why give our land to someone that weak and unable to develop the southern Philipines that share boundary with Sabah. We are not stupid enough about that fact.

fairly in depth researches....20 years is a long time...at the the time when sulu sultan ceded in perpetuity or leased until "kiamat" or doomsday, he had no choice...imagine being bombed and died or signed the treaty...

it was a mistake of previous sultan of sulu. north borneo was not important for sultan, that why the land was sold to british company. why now they want to take it back? why sulu warriors don't try to protect (at lease support) sabah during japanese occupation if they said sabah is their "home". im sabahan and we are very disappointed about it.. that why we choose to join malaysia. now is 2013, it is impossible to take sabah back

Waaa... this man try to twist the history which is documented or what?! When the 1st Sulu Sultanate give away which he called a chunk of Sabah; 1st~ it is known as Borneo before, 2nd~ that chunk is Kalimantan, Indonesia part, 3rd~ He gave North Borneo to British & we independence.
