Sabah was a gift by the sultan of brunei to the sultan of sulu even before malaysia became a country. It was rented by the British oil company and then handed to malaysia to continue the rent. However, Malaysia stopped the rent in 2013.

They are not rebels, they are claiming what is rightfully theirs (Sultanate of Sulu). Malaysia is now defeated through an arbitration ruling of the court awarding Sabah to the Sultanate.

Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate give North Borneo to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to BNBC. These agreements exist and keep in the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned Sabah into British Charter (1881), Protectorate (1888), Colony (1946) and finally incorporate into Malaysia in 1963. Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish its territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement 1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing. Rebut with facts and references. Not hearsay.

And Historical Records can prove it. The lease of Sabah from Sulu Sultanate by Baron Overbeck in 1878 was transferred to British Prospector Alfred Dent. He then turned Sabah over to the British North Borneo Company who later turned Sabah over to the Royal Crown of Britain which was vehemently protested by then US Governor General to the Philippines F.B. Harrison. The British colonizer then included Sabah in the newly formed Malaya Federation with total disregard to the rightful owners.. The Sulu Sultanate "Our claim is mainly based on the following propositions: that Overbeck and Dent, not being sovereign entities nor representing sovereign entities, could not and did not acquire dominion and sovereignty over North Borneo; that on the basis of authoritative British and Spanish documents, the British North Borneo Company, a private trading concern to whom Dent transferred his rights, did not and could not acquire dominion and sovereignty over North Borneo; that their rights were as those indicated in the basic contract, namely, that of a lessee and a mere delegate; that in accordance with established precedents in International Law, the assertion of sovereign rights by the British Crown in 1946, in complete disregard of the contract of 1878 and their solemn commitments, did not and cannot produce legal results in the form of a new tide." Malaysia did not brought about PEACE in but played a major role in instigating unrest and division among the people of Mindanao and still continue doing so up to this day and age which by the way has been admitted by the federal government on the record and international media itself, thus ultimately prove that if the Philippine government take back Sabah and bring Malaysia to court , whole of Mindanao will flourished bringing the whole country in collective progress growth. You must remember the federal government of Malaysia played the biggest blunder in the history of the Philippines when they instigated rebellion in Mindanao and supported a Traitor who killed himself to be proclaimed hero and to oust then President Marcos who has all intension to reunite Sabah to it's mother land. By doing so The federal government of Malaysia is by all means accountable to the injustice done to the Filipino people and continually support terror groups up to now thus keeping the Philippines in developing to the fullest. Core basis of the arguments are facts and the owners of the land has been so lenient in asserting of the claims to avoid war simply because the Sabahans are blood related to the Filipinos of Mindanao. The treachery, intimidation, inhumane acts, atrocities, and illegal land grabbing of the Colonial powers has come to full cycle. Panahon na Pilipinas para magising sa katotohanan at bumangon upang lumaban para sa kinabukasan ng ating bayan. Hinde lang lupa ang ninanakaw ng Malaysia sa mga Pilipino kundi pati ang mabuhay ng mapaya at magkaroon ng patas na pagkakataon upang mabigyan ng magandang buhay at kinabukasan ng ating bagong generasyon.

In my view, if the Philippine government recognizes the Sulu government as a sovereign government, logically, the Sulu government has the right to claim and establish its own government in the south of the Philippines. Therefore, the philippines had to hand over their land in the south of the philippines to the sulu kingdom as a new country. From Malaysia's point of view, Malaysia does not recognize the Sulu kingdom and its heirs because in the original agreement the Sulu sultanate had surrendered all its sovereignty in Sabah to the British before the existence of Malaysia. In the agreement, sultan sulu will not claim and absolutely hand over power to Sabah with the promised compensation. Even the term 'lease' has been dropped and in total Sulu has no rights over Sabah. However, in 2013, Sulu heirs violated the agreement by claiming Sabah and started a military attack on Sabah. Therefore, the Malaysian government has the right to stop the payment because Sulu has violated the agreement. This military action has challenged the agreement and violated Malaysia's sovereign boundaries. Malaysia still adheres to ASEAN principles and can still be diplomatic. But when it comes to sovereignty, Malaysia will not compromise. Don't let Malaysia take the approach of treating the Philippines as 'persona non grata'

Sabah people are whoever people they are.. because Philippines let Malaysians rent that land so Malaysians can put any people they want over there, doesn't mean that renters can say... ohhhh we own this building now because we are the people who live in this building... Malaysia doesnt make sense at all.. it was never sold to Malaysia, it was rented and id you say Sabahans want to join Malaysia, then they can go, but that has nothing to do with the land. Sabah was given to the Sultan of Sulu as a thankful gift from the Sultan of Brunei because Sultan of Sulu helped them to defeat the rebellion to their country then how can Malaysia own that state? it is malaysia's the brunei already agreeded to the british. Also brunei is the original owner of sabah but after the britieh agreement sabah was malaysia's. And the fact that sulu watched the battle and didn't assist brunei, brunei held of the war itself after that sulu stole the loot and resource. this is According to brunei's history if you do not believe me please seek for a historian also read the history of brunei and what i said earlier there was also no document regarding of brunei giving sabah to sulu, they lied to the sultan so the sultan wouldn't be mad, the sulu that said it was their's was fake do not believe this fake history, please seek an expert of brunei history, there was really no documents about it giving to them please stop claiming "sabah, philippines!" They are not yours, the whole sabah is not yours the sulu maybe owns a little bit of sabah but the full owner is malaysia. The people in sabah stays in malaysia as they already agreed to stay in malaysia it is confirmed that sabah will stay in malaysia, if the philippines wish to provoke this request and start an invasion of sabah they are having a war with australia, new zealand, british and the native people that are already agreeing to stay in malaysia but even if US joins they would have to face the UK and australia and new zealand they will either choose to fight with philippines or they fight the philippines or be forced to leave the battle. If the batte continues the UN (United Nations) will be forced to stop the battle.

We do not believed or accept that argument..Sabah is a soverign state ruled by its own Sultan ..Brunei is not so Stupid to hand a golden State of Sabah with rich natural resources to Dato from island of Sulu by whom was appointed the title of Dato from Sultan of North- Borneo.

British North Borneo Company (BNBC) signed 2 agreements with the Sultan of Brunei and Sultan of Sulu on 29 December 1877 and 22 January 1878 over the territory of North Borneo respectively. Thus, Sulu claims on North Borneo was given by Brunei as a gift is unfounded. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain in Bases of Peace and Capitulation Agreement. The agreement by Sulu with BNBC on 22 January 1878 is null and void based on his majesty termination letters also dated 22 July 1878 to the Governor of Sulu and Governor General of Philippines who later forwarded it to BNBC (24/7/1878) and Spanish government (20/8/1878) in Madrid respectively. Later this whole episode is override by the Madrid Protocol 1885 that North Borneo belongs to the British. Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken to court in Philippines, Malaysia or ICJ until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars have a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full. The above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation.

The original Lease contract between Sulu Sultanate & Baron Overbeck which he later transferred to Alfred Dent then transferred to the British North Borneo company.. The BNB Company ceding Sabah to British Crown does not terminate the binding contract of the leased property Sabah.. It must still be honored by whosoever succeeds the property.. And the very reason why Malaysia continued to pay the Rent of Lease obligation until 2013...

@@dannybarcenas9701I think you were confused and misunderstood. Madrid Court didn't rule in favour of Sulu, it ruled in favour of Malaysia and Sulu lost. Then Sulu and the gang including their Arbitrator Gonzalo Stampa ran to Paris and put up their case in Paris Court. If Sulu was sincere, they should pursue their case further in Madrid court of appeal. It was Paris Court that ruled in favour of Sulu and they won easily became Malaysia didn't participate in the proceeding. Why Malaysia didn't participate? Because Malaysia has already won in Madrid Court. Stampa's action of going to Paris and put up their case in Paris Court when Madrid Court had already gave its ruling was seen by Spanish Judicial Authority as "contempt of court" and "professional intrusiveness". Followin this Stampa's appointment as an Arbritrator was revoked or annulled by Spanish Judicial Authority and his arbitration was also annulled. Criminal proceeding was also taken against him. Malaysia applied for stays of enforcement and annulment of Paris Court ruling in Paris Court of Appeal and in various other Court of Appeal in Luxembourg and Netherlands for other related claims put up by Sulu. And finally Malaysia won and Sulu lost in various Courts of Appeal. Latest as in June 2023: 1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court ruling awarding the defunct Sulu Sultanate. 2. June 27th - Dutch Court of Appeal in The Hegue had dismissed a bid by eight heirs of former Sultan of Sulu to enforce Paris Court ruling, and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision. 3. Paris Court of Appeal also imposed on Sulu €100,000.00 to be paid to Malaysia as legal cost. 4. In Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision. Now is already November 2023, no news about Sulu's claim proceeding in Luxembourg Court. It looked like they withdrew their case after they acknowledged the Paris Court of Appeal decision. Malaysia had spent upto RM32m (USD6. 6m) to deal with these Sulu's claim cases in various European courts in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m (USD6.6m) spent.

Simple logic must be applied: if Malaysia still paying its rent up to now, does that mean he owns what he was renting? There are reports prior to the standoff, that the Malaysian ambassador to the Philippines went to see the Sultan and negotiate to extend the lease for another 100 years with 360,000 ringgit annually. If your gov't really confident that own sabah, why would they do such thing?

It was the British who manipulated ownership of North Borneo, utilizing these lands as their plantation. Another example of how power and greed when combined they turn the world upside down. Sad to say I don't think that piece of land will be returned to the rightful owner "Sultanate of Sulu" during my lifetime. I just hope Filipinos will not forget this claim of our Muslim brothers, hopefully in future they'll succeed. Who knows if Sulu-Mindanaoans prosper then a long lasting peace might come next.

Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate. But what they will not revealed are those that can refute their claim. The followings are few of the information that had been kept secret: Firstly, the agreement between Sultan Brunei and BNBC on 29 December 1877 over North Borneo which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei. Secondly, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement). Thirdly, on the same day, 22 July 1878, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void. Fourthly, on 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. Fifthly, Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. Sixthly, finally, the issues on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. The above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation. In addition, during the US colonization of PH, 2 agreements (Carter 1899 and Carpenter 1915) were signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies. Later, the 1930 Anglo-US border agreement acknowledge the boundary delimitation between PH and North Borneo that belongs to the British.

The fact that Malaysia recognized the agreement by paying lease to the Sultan of Sulu, it's enough proof that they still have the proprietary rights of the territory. If Malaysia is not willing to return the land to its rightful owner they should at least compensate the family of Sultan. Otherwise, you can call it land grabbing or occupation like what Israel did to the Palestinian land or the Chinese occupying Tibet.

I'm a tausug from Sulu, but my fellow man can't accept the fact that Sultanate of Sulu is already a Conquered Land. they Forgot that in 1900's, Americans Conquered Sulu by massacring the fighters in Bud Bagsak / Bud Dajo.

The truth is the former bruneian sultanate/king never said to give the northern land of borneo to sultanate of sulu but clearly said in the agreement that the land is loan or "pajak" in malay language as writte.... Then its conclude that the claim of the Northern borneo land as theirs by sultanate of sulu is non-valid...... The real reason why sulu sultanate raises that claim is because the Northern borneo land is more prosperous than his island land that he is in dire need of money as his expenditure use he is so broke that even his medical expenditure is sponsored by The Philippines Government

Sabah belongs to the Sultanate of Sulu but because of the British which in previous history it divides ancient territory and nation like India, Pakistan and Bangladesh, also here in Malaysia, the British give the territory to Malaysia but it really belongs to Islamic peoplw of southern Philippines.

That's the reason why the Madrid arbitration ruled in favor of the Sulu Sultanate.. The original Lease contract between Sulu Sultanate & Baron Overbeck which he later transferred to Alfred Dent then transferred to the British North Borneo company.. The BNB Company ceding Sabah to British Crown does not terminate the binding contract of the leased property Sabah.. It must still be honored by whosoever succeeds the property.. And the very reason why Malaysia continued to pay the Rent of Lease obligation until 2013...

Sabah needs to go back to the owner- Sultanate of Sulu- under the Philippine Government, if Malaysia stops their rent payment of the property that they rented since 2013. So to avoid disputes, let the United Nations put the issue under consideration to solve the problem in due time. International Law of ownership must be followed.

Do not forget Sabahan voted to join Malaysia, what the people want is what matter the most, no Sabahan want to be ruled by a long gone kingdom. The Sultanate no longer exist and they themselves do not know who is the current Sultan of Sulu. None of them bother to protect Sabahan during Japanese invasion. None come even to visit after WWII. They are no photo or documents showing Sulu Sultanate ever govern Sabah. No representative of the Sultan ever appointed to Sabahan. No record of tax ever been paid to the Sultanate. During the reign of the Sultan and current modern time none of them able to take care the welfare of Sabahan, now their princess have ordinary job and go to work by public bus. Malaysia govern Sabah together with Sabahan for Sabahan since 1963 and bring prosperity and security.

The British has a hand on this. When the British left the proper way to do was to gave back North Borneo (Sabah) to its rightful owner the Sultanate of Sulu. What right had the British to gave it to their poodle, Malaya! The land was only leased to the British (BNBC) by the Sultanate of Sulu.

I am a Filipino and this Sabah claim has been going on since the 60 ‘ s , my question is their any documents exist that it was truly indeed a gift from the Sultan of Brunei ( the Bolkiah Family) and also being a Spanish or Spains province for 300 years there should also be a documents or maps that it was part of the Philippines archipelago and why does Malaysia pays the sultanate of sulu family every year if they ( Malaysia ) does not recognized the lease which was actually instigated by the British , and also why is the Sultan of Brunei ( Bolkiah Family) stayed TIMID on this Issue at least they have records about the Padiak between the sultanate of Sulu and the Sultanate of Brunei. The British Should Be One to be Blamed for all of these Chaos, like what they did in the Middle East and Africa it’s all about Oil , gas and the natural resources in which the British Government is so Hungry to possess and control.

1) There is no proof to show that the Philippines have legal claims over Sabah as Sabah was handed to the BNBC by Brunei. Brunei also denied any claims that they have gave Sabah to Sulu as a gift. 2) The payment that is given to the self-proclaimed Sulu heirs annually by the Malaysian government is not rent money but cession money. There is no proof of a rent, neither the 1878 agreement nor the official receipts ever state of a rent.
