I was held on remand for 6 months in the UK for GBH. I didn't receive al the evidence against me until 30 days before trial from prosecution. So none of this is unusual.

Hello. I feel the need to make some clarifications regarding the legal system in Romania: 1. Andrew Tate is not in prison. The measure of preventive arrest was taken against him, due to the fact that there is a risk of influencing the victims or of leaving the country during the criminal prosecution. 2. In Romania, the measure of preventive arrest can be taken against suspects against whom there are "reasonable suspicions" regarding the commission of some crimes; 3. The measure of preventive arrest is almost always ordered by a judge when it comes to crimes such as human trafficking. In such situations there is an increased risk of influencing the victims, who are already deeply traumatized; 4. As the invited lawyer said, the measure of preventive arrest can be taken for a period of 30 days and can be extended by 30 days, without exceeding the maximum of 180 days; 5. Pre-trial detention is not punitive but preventive in nature (as the name suggests) and is a preliminary measure to the trial. 6.Preventive measures (including preventive arrest) can be ordered if there is evidence or solid indications from which there is a reasonable suspicion that a person has committed a crime and if they are necessary for the purpose of ensuring the proper conduct of the criminal process, of preventing the suspect or defendant from evading the criminal investigation or from judgment or the prevention of the commission of another crime. 7. Andrew Tate is currently a suspect. Only if he is convicted will acquire the status of a defendant. I hope this will be helpfull for you în order to understand better this case.

This is all true But there needs to be some form of reasonable grounds to hold them for that long Or am I wrong? Would victim impact statements count as reasonable grounds? So far there doesn't seem to be any hard evidence (DNA, video, etc) The prosecutors even refused to use the Cctv footage from the Tate residence Not to mention, they haven't even pressed charges over a 10 month period

In some countries you will be locked up all the way to trial if the judge thinks that you will flee if you get out. So it isn’t that weird that they are locked up still if the prosecutor have given the judge enough evidence.

Objective consideration should take European law in consideration:). For example, in Europe law is allowed to put a person in custody if there is reasonable suspicion that they are involved in serious criminal activity just to gather evidence. I think this is not allowed in the USA. In America you need proof.

@@xvi1128 If 6 women in Europe say that you are using them for trafficking, you will get arrested, in America that does not mean nothing (I think). Understand the difference. So they will then put you in 30-day prison, and while you are in prison they will search for evidence. That is the reason why they say they are in 30-day prison so police is allowed to search for evidence, this does not exist in America, I think. If they found something you will get another 30 days and so on up to 6 months.

Very interesting. In the U.S. it seems the courts give a lot of liberties to an accused criminal which could possibly endanger a victim but it falls in line with innocent until proven guilty. In Romania it appears it's more about protecting the victims which falls in line with detaining the accused to finish an investigation. Both systems need work but in this case, the ironic thing is that Andrew Tate moved to Romania because of their supposed corruption but is now crying for help because of their justice system.

It sounds like one of the girls wanted to change the agreement that they had or got jealous of the other girls. Most the victims went on video and said that they dont know why they are on the victim list and are ignored when they ask to be taken off of it.

Exactly. What’s unusual? Many people are incarcerated while an investigation is going on, even if initially charged with one single criminal act. Often until they stay in jail until they go to trial. Happens all the time here in America. Bail may be unaffordable or denied. I don’t understand why Jesse thinks it’s unusual. Besides, it’s a different country, so their rules.

Because he's not an attorney in Romania maybe. What this showed me was that he's locked up because of who he is and the influence he has. And while he's locked up they're trying to get evidence on him to keep him locked up. Even after watching this video it clearly shows that. Now is he guilty of money laundering and other crimes who knows but the fact of the matter is he still was locked up for nothing he was locked up because of his social presence. I'm guessing the Romanian government didn't want someone like the Tate brothers in their country with all eyeballs on them so they're getting rid of them. That's just my personal opinion

To my understanding, "flight risk" is enough justification to keep the Tate brothers locked up pending trial. The only way this differs from the United States is that rich and influential people like Andrew Tate would usually be able to finagle release anyway. I'm 100% certain that if Andrew and Tristan got out on bond they *would* use one of their 10+ passparts to flee the country, so I don't have any problem with keeping them incarcerated while awaiting trial. Dr. Todd Grande would call this, "The hazards of bragging about your plans to commit illegal actions on social media." 😉

The problem with our system in NA is that it doesn't protect the victims. A restraining order is a meaningless piece of paper that only protects the victim if the perpetrator is willing to respect it. The number of women that it fails to protect is insane. Men too, to be honest. People end up dead all the time because they're told the police can't help them unless their abuser, stalker or whatever is there. Then they can't respond fast enough; the person ends up dead. Much of the time there's not enough proof that this person actually comitted the murder and they end up with no justice. But we're protecting the rights of the perp. So what's the answer? Who do we need to protect more? And I'm not saying that there aren't false accusations too. People falsely accused also need protection. I'm asking seriously what can be done to balance these needs?

Agreed. I have seen everywhere in Europe victims and witnesses who had to invest in their own security at home while having a police car or police officers at their doors for the time of investigation and trial. Still the danger is outside on the streets from unknown accomplices while perpetrators were going in and out of jail. Shameful sometimes people who only volunteered for keeping the rule of law in their local communities have to talk to a lawyer to make a deal to answer like to a blackmail of the perpetrators to finally put an end to threatening, stalking and damages like stones through their window.

What hasn’t been explained very well is that the Romanian justice system is very different than the one in the US. The Romanian Constitution setting up the Executive, Judiciary & Legislative branches is modeled after France’s. As I understand it, as would be the case in France, the judge-who is not the trial judge-is the ‘investigating judge’ who works with the public prosecutor to develop the ‘dossier’ ie, the case file, which, when fully developed, will be the basis for deciding whether to criminally charge them & send them to trial. The investigating judge can issue warrants, talk to witnesses & decide the issue of detention before criminal charges are filed. This is constitutional & is a system used in a number of countries. I think there is a lot of confusion here because people don’t understand that a judge oversees the investigation in tandem with the prosecutor before any charges are filed.

@@SeedsAndStuff In Finland, you can be detained for months if the police (not even a prosecutor) says that they suspect you having committed a crime. No charges at this point because police will only start the investigation. At this time, police is not required to show any proof to support their suspicion.

There are videos of Andrew Tate explaining how he lured women in under false pretenses with the lover boy method. There's also a video where he says he promises the girls 50% of profit, but only gave 30%. He told the girls it's for taxes, but actually was just stealing the money. Andrew also explains how he hired a bunch of dudes to do the chatting, while making it look like the customers were chatting with girls. Those hired dudes would convince those customers to send hundreds of thousands of dollars to his bank account. Fraud after fraud after human trafficking....... and people think there's no evidence of criminal activity..... LMFAO
