That age of consent law doesn’t tell the entire story, different regions of Japan have different ages of consent and while 13 is the lowest amongst them, the other person has to be below the age of 18 otherwise it’s still illegal. I did research because the whole 13 is age of consent thing gets spread around without context way too commonly.

Most interesting part of the law is of course, who do you punish? If a girl gives consent despite being too young, is she going to get into trouble? Or is it OK for young girls to give consent despite it being illegal, and you only punish those who listen to the voices of little girls? I knew a lot of girls who had sex when they were 13, despite that age of consent is 16 here. I mean, why would kids care about laws? The only purpose of age of consent is really to prevent older men and women from abusing children, when they are like 20+.
@bandiceet
@bandiceet 4 жыл бұрын
@@linusgustafsson2629 1) It usually comes to "Abuse of Power", in most Western Countries. 2) To use Australia as an example, since this is where I am from and knowing the rules: Age of consent is 16, if I at 43 years old, try to pick up a 15 year old for a one night stand, even if they gave consent, in writing, it is seen as Staturory Rape. 3) Stop trying to do the mental gymnastics to try and justify having sex with under age women.

I'm studying laws in Japan. I know these regulations sounds nonsense, but as the society is getting matured, the background of law is also changing. For example, the law concerned about mail box, Japan adopted mail system after mid 19th century, at that time, most of the people didn't understand the mail box and some of them misunderstood it as toilet. Japanese Government, at that time, thought the policy of the network of communication was very important for industrialization, so the government protected the mail box very strictly (even the police couldn't carry guns, but the mailman could carry them for protection). And now, the right to communication is thought to includes the free and secured access to mail system, so the law which introduced in this video exists. Sorry for poor English, but I enjoyed this video very much.

I think that the laws should be periodically modified to fit the modern world better. I've observed that, not only in Japan, but in many other countries too that the laws that are made are never revised for decades, sometimes even over a period of more than a hundred years. This creates such bizzare laws that make no sense in the modern day.

@@vir042yeah it can be quite complicated. As far as I know the german regulation can be read as "sex is legal at age 7 BUT only if it's happening between two 7-years-olds". The german law is not exactly a law about age of "consent" but rather a law of "protecting minors" hence a minor having sex with a minor is fine but a minor having sex with an adult is not so fine... The law is addressing the difference in maturity between the parties involved and therefore the ability to give consent and knowledge about consequences: No difference in maturity = having sex is fine. Little difference = it's fine if the parents give their okay (applies starting the age of 16: if that 16 year old is dating an 18 year old who's legally an adult. Does not apply for younger kids than 16). Big difference in maturity = you're going to jail.

The age of consent law is essentially false. De-facto, it's 18-20 depending on prefecture in accordance with other laws. Under 13 simply is an overlapping law protecting anyone under 13 from statutory rape. For example two consenting 13 year olds aren't immediately sent to juvie. It's often misunderstood.

actually is not wrong, the overal law is indeed 13 and some "old fashioned prefectures have it but as you told each prefecture have they own age and the range ovveral can go from 16 to 18(with some places still being 13) not 18 to 20, but is not that "simple" as get in 13 and you can already go sex, you have to have family authorization and in many cases signate a marriage contract which if you don't follow you can get arrested, then it's not easy to marry or band underaged in japan( you can still have sex with "young looking girls or 18+ which looks like 15 or 16+ but still 18, it's normal for japaneses womans looks young than they real age due to they genetic, japanese woman genetic is more feminine and young than western womans.

@@ericelliott9232 The fact that you ask that clearly shows that you don't understand what he means. 12 is the age of consent limit by federal law, but is not legally accepted anywhere since all states have their age of consent between 16-18. Same as in Japan where on a national level lowest allowed age is 13 but no prefecture (AFAIK) has their age of consent set that low. Technically a US state or Japanese prefecture could set their age of consent as low as 12 or 13 respectively, never mind that it would most likely be political suicide for whoever suggested it. Does the fact that i know this mean i am on some sort of watchlist? Possibly.

In Australia, it recently became legal for persons under 18 to posses pornographic images/videos of persons aged 14 to 18. If a person over 18 possesses this material, they are liable for prosecution. The reason for this was essentially that 14 to 18 year old teenagers would send nudes to each other, and the police had to arrest and prosecute them, even though everything was consensual. Obviously if the material is obtained under coercive circumstances the person possessing it is liable for prosecution.

@@bit0159 Yeah, I don't know the validity of this, but I have heard that most prefectures have implemented their own laws to raise that age. If true this is probably why the federal age is low; they just don't see it as necessary change if everyone i already changing it locally anyway.

Age of consent is 13 only for minors.. this implies that age of consent is 13 for people under 18. And for everyone else it's 16, afaik.

I don't know why they were so surprised by the age of consent. It literally was legal to own child pornography until recently (2015) lel.

I heard somewhere that some of the laws in Japan are intentionally vague. It's so that the police officers can better choose how they deal with a situation based on context, rather then having to go "well you broke the law regardless, so you're getting charged."

One time I was watching the news (in Australia) and they had a story about road laws, one of them was It is illegal for someone driving a car to splash water onto a person (the same sort of "mudding law") waiting for a bus, however if the person is not waiting for the bus it is legal.

6:42 in city there is a lot of sidewalk where it's allowed for everybody to ride your bicycle, but when it's the case there is a sign indicating it. When I went to study in japan the first day a police officer came to explain all the laws about bicycle, and about the trash system (which is pretty complex).

@7:15 In USA most major cities have such laws too. Some cities only apply them to busy areas through and enforce is little to none, depending what city. In Austin, TX there is a special map that shows which sidewalks on which days you can not ride your bike on.
