While the husband was indeed in the garden, there's a possibility that he didn't see the body or even come across it since he was looking at the stars in his telescope and there's an extremely high chance that the garden was huge since it had been implied that mrs smith is extremely priveleged since she had her own chef, buttler, gardener, and maid, increasing the alibi that the husband may not come across the body at that time as it is highly suggested that the garden may be pretty big while the gardener did not have any alabi that can back him up about the statement that he had given to the police that he knew the location of the murder despite the police didn't specify anything about its whereabouts. Besides, who would randomly give away their location if said location was indeed the location of the murder? (which would again increase the husband's alibi). As for what a psychopath would answer, he would answer that the husband was the one who did it, here's my thought on how he would've guessed it : Note : - the gardener was trying to convince the police that he wasn't at the garden (very strongly implying that it was the location mrs smith died) - the husband was in the garden - psycopath is inequal to intelligence, meaning that they might only use clues that are in front of them without looking back past events (psycopath generally wont look back on the consequences they have caused due to lack of emotions and thought for others) How a psycopath would solve the riddle : - the gardener was just strolling to the garden to do his job - he saw the husband killed mrs smith - the husband looks at him, either he's speaking about something or giving out hand gestures clearly telling him to not tell anyone or he'd be done - the gardener was terrified and ran away from the location terrified for his life - when he's interrogated he's nervous and trying to not tell anyone about the murder, desperate for his life. Which is why he's saying that he wasn't in the garden as if he was trying to get himself out of suspicion while simultaneously hiding the husband's hideous act. - the husband straight away give out a horrendous half baked lie and straight away gave out his location at the time as if he doesn't care about getting caught. psychopath wouldn't even look past about the fact that it was evening and it was before dinner or smth like that, he doesn't care, which is why i think this is the best case scenario on how psycopath's mind would work when analyzing these types of riddle.
