Arizona lawmakers could make changes to the special taxing districts that Coyotes owner Alex Meruelo is seeking for his proposed $3 billion arena complex in northeast Phoenix.
The players are relocating to Salt Lake City, but Meruelo will get an expansion team from the NHL if he builds a new arena within five years.
These special taxing districts are exempt from state and local income and property taxes, and they can charge patrons a sales tax - revenue that can be used to help pay for the development.
Under current state law, theme park districts are created by cities. Hoffman’s amendment would allow counties to also create them - and potentially override any objections or input from cities.
Sen. Juan Mendez, a Democrat who represents District 8, said the bill would reduce local control.
“It makes it easier for developers like sports teams, owners, of all people, to get tax money by cutting out our cities from the decision-making process,” he said.
Meruelo has said his arena complex will be privately funded.
"We’re going to fund this 100% on our own when it comes to the land, purchasing the land, when it comes to the building, when it comes to the infrastructure, all that comes on my nickel, my money,” he told ABC15 Arizona earlier this month.

Major difference between this media conference and the one the Smith's had. You have to wonder if the NHL was secretly hopes he doesn't win the land auction, then they can walk away from having him part of the NHL and hope someone better comes along in the future for an expansion team. Bettman covered for him in this conference, which i'm sure he was glad that it was over soon. I'm guessing if he doesn't get an arena built the Coyotes name is owned by the NHL again, which seems to be what the fans in Arizona are hoping for because they want a team but not the owner.

The idea of the themepark district boils down to "those who use the property will pay additional taxes" its no different from having a toll on highways. If anything what the themepark tax does is make it so the fans are helping to support the development costs for it to be built and for it to be repaired/expanded/improved as time goes on.

It's not quite that straight forward. The theme park district takes away tax revenue from the surrounding community the theme park district relies on for customer and employee access infrastructure and transportation, fire and police services, water supply and sewage treatment, etc. and leaves the community with the bill, not the fans, ownership or league.

But a (typical) toll road is not owned by a for-profit corporation or individual (exception being the Indiana Toll Road [I-80/90] that is leased to a private company by the state). As for the tax "helping" fans pay for the development costs: THAT'S WHAT TICKETS DO! You pay a price to attend a game, a concert, or whatever, and those funds are used by the business to pay current operating costs (salaries, water, electricity), licensing or promoter fees, and to pay off capital expenditures.... The tax would just be a way for Meruelo to get his money back and to blame ticket, merchandise, and food prices on the "sales tax"... My wife owns a franchise coffee shop location, and we laid out a lot of money in development costs. The price that customers pay for the items they purchase goes to pay for what the item cost to buy for resale (coffee beans, tea, cups, muffins), operating expenses (labor, water, electricity, sugar packets, paper towels, TP for the bathrooms), federal, state, and local income taxes, AND payment on the loan used to partially fund the development! Eventually (we hope) she'll have generated enough profit to recoup our investment. Believe me, I'm like most people--I hate paying taxes, but I always pay what is due. The thought that those taxes would go directly to a billionaire so that he can grace Pheonix with an NHL team, while excluding the area from income tax is repugnant. It'd be like the city having my wife add a tax to every transaction, then the city allowing her to keep that AND not pay any tax on the income... the city gains nothing from it.. NOTHING! I'm sure you'll come back with "well it'll drive restaurant and hotel revenue in the area" unlike a coffee shop... you may be right, but I've yet to see any of these improvement districts help drive business growth outside of the district. Where we live, a nearby city did a similar system over a decade ago where businesses in the district could keep income taxes as an incentive to move into the area as part of a plan to pay for a minor league hockey arena... it was sold as a way to revitalize all of downtown... so far, only the properties inside the district have been revitalized... go outside those few blocks, and it's the same, rundown s-hole of a town it was before, but where the people going to games drive through as fast as they can, without making eye contact with pedestrians at street lights, just to get into and out of the "green zone"... If the arena and surrounding area development is to be paid for with tax revenue, then it should be owned by the city or county, not the billionaire. The team should pay rent for use of the facility, and the team shouldn't get any income tax breaks.

@@TheMcIke You have it exactly right! Couldn't have said it better. I've yet to see one sports economist show that these "districts" make money for the city / state / whatever which paid for them. They don't!! They just move money from one part of town to another. The old golden rule of business stands as it always has - If it made good business sense to do something / build something, business would do it! They wouldn't wait around for government to get in on the game. Trolling around for public money is nothing more than a way for businessmen to off load the risk and guarantee themselves a return on a questionable venture.

The orginial Tempe Deal that was a 50/50 split of sales tax $ split between the City and the Arena Builder and had entirely local control, however Sen Mendez did oppenly opposed the Tempe Vote last spring. But lets put everything into perspective, the 3 other pro teams all reside in buildings built and owned entriely by tax payers. This would be a first, a sports arena bulit by the private sector.

Thank you Brodie for your coverage on the Coyotes. I went to their games when they were playing at the Gila River Arena in Glendale. I hope that the team, city, county and state could come up with a resolution to help everyone out and be fair to all parties

As sneaky and backhanded as this might seem it's also really smart. If the public, local or state don't want to help fund a building development of this size with possible positive economic impact then it seems like the owner who developed the land on his dime should be the one to reap full benefit. Not to mention it cuts the public out of being on the hook for anything now and forever as it relates to the Coyotes. Then the state can build a regular district around it to help get their cut of taxes and in turn help the Coyotes by building up around it. It can be mutually beneficial. I think Disney is a prime example for all the development that has occurred outside of their district in Florida. This may even be the framework of the future for sports stadium development that governments and the public want no part of. The reuse of that bill is the only thing I disagree with. But that's up to the government to fix.

User fee / tax on site maybe surrounding area is much more equitable then the whole tax base paying for it. Problem is some people are professional grippers and have never accomplished anything themselves. Arizona doesn’t have an [active] team because of local politics not because of fans or potential fans. If you can’t get basic things done politically then you can get them done. That’s why farms are closing down in Arizona, they can’t get the political will to do the obvious and work with the Feds and Mexico to build a desalination plant and pipeline to bring more water. State is thrusting for water but it’s politics is a joke.

Brodie, maybe you could make a video on this! How many privately owned privately funded stadiums are there in the United States that also pay market rate property taxes? I bet there are very few. Even the privately owned ones usually secure tax breaks before building them.

The "strike everything amendment" is usually referred to as a gut-and-amend. It looks kind of dirty from the outside in, but it is kind of functionally necessary in situations like this. Basically legislative sessions happen on a yearly cycle, and the time to author new bills for the year has already come and gone. Unless the governor were to convene an emergency special session (which comes with its own issues, not the least of which is the cost involved), the only way to pass something like this in the time necessary for it to take effect when needed is to take another bill that's already in the process of circulation, gut it and rewrite it to deal with this new issue.

There are a lot of people who don’t think the Coyotes are gonna pull this off so in my opinion I am in favour of anything that can help reactivate the Coyotes sooner rather than later so that we can have the Desert Dogs back as our Sharks conference rivals

This sounds like an idea inspired by Disney in Florida that’s been highly visible thanks to the antics of that state’s governor. If it’s the same thing, then the “theme park district” becomes its own governing entity. Yes, they collect taxes for themselves, but they also provide police and fire protection, schools to any residents, and so on. Why this was introduced to start, and why it was done so as a “strike everything” amendment, sounds like sleazy politics and nothing more.

Former yotes fan here. The first red flag NHL is done in AZ is how "generous" the owner was trying to be. NHL does not want the prescedent set of an owner genrerous to the community. Sadly, I think NHL may be gone from AZ and may never come back.

hmm this is odd as it seems Meruelo from what i understand would also have to fork over all the money to build the roads, water, sewer, highway exits etc. so to me this kind of seems fair. if the city/county is going to put 0 into the building of infrastructure for the place then they shouldn't get a dime of tax money as well.

I’m with you kinda. If he builds it all he should be able to get the tax at a capped amount by dollar or date. Then it goes back to the city to maintain. I feel like that’s a win win with the proper negotiating

Now if the city says ok we will build the roads, run the util lines but you have to build the buildings you want and no we ain't helping with that. then he shouldn't get the break due to city/county forking over tax money for road/utils.

What if another entity makes a lower bid but says they'll pay property and income taxes on the site. Better deal for the city/county/state in the long run. Don't forget, the winner will be the party with the "highest AND BEST" bid, and that other bid might be deemed best long-term.

Nevada has Tourism Improvement Districts (TIDs) and Sales Tax Anticipated Revenue (STAR) bonds that serve a similar purpose. Three examples up in the Reno area: Cabela’s in Verdi, Legends (Outlet Mall) at Sparks, Greater Nevada Field, home of the Reno Aces.

The argument is that sports stadia traditionally don't bring back more than what governments pay to build them. That person who'll move into the luxury apartment in 15 years will probably have their choice from almost anywhere in Phoenix or along the 101. They won't all of a sudden choose to raise their standard of living just to live next to an arena. Same idea with it won't magically create restaurateurs or cause people in Greater Phoenix to eat more at restaurants; it just makes it more likely that they'll choose that location to open up or eat.

Meruelo should focus on the arena itself..... And worry about the "theme park district" later........ Provided he wins the land auction..... Worst case is the arena gets built, a rejection of the "theme park district" becomes a problem for a future owner, who may be able to pay the taxes afterall.

I'm glad you showed ABC15's take on the story, Brodie. I was trying to figure out what the hell theme parks had to do with all this. Apparently a "theme park district" is Arizonese for something that is referred to in the real world (and used often) as a TIF, or tax incremental financing district. The area of the development is fenced off, the taxes collected within are used on that site specifically to retire debt, for maintenance, infrastructure, etc. - thereby separating out the debt liability for the project from the public's general fund. The bond underwriters have the project itself as collateral, and nothing in the way of guarantees from the public. It flies or it sinks. This is exactly the kind of thing that you want done to insulate the public from the financial fallout of project failure. The millionaires buying the revenue bonds eat the loss if it fails...But in Tempe's case you had NIMBY queens inciting daft legions of TikTokers that wouldn't know which brand of toilet paper to buy for their assets to defend a LANDFILL - of all things - in Tempe. This grandstanding Mendez rant is an extension of the same kind of hive mind insurrection. So happy to know that AZ has such educated and financially literate legislators defending the public purse.... 😒...I understand and concur with the view of most that billionaires should not receive millions from the public coffers to build stadia for their privately owned teams. But to those who think that billionaires are pre-disposed to paying for these projects cash on the barrel may as well just go back to their crack pipes and leave the rest of us alone. Billionaires can get a thing started, but they aren't Santa Clauses with buckets of cash to spend on a product that is intended for someone else's amusement. In the end, the customers - in this case the fan - MUST pay for it, but the asnwer becomes whether the public at-large pays for it through direct taxes, or fans pay for it through their patronage of the team or whatever facility gets built. This is the only way to facilitate that latter scenario...Now to the point of the legislation. This is why people hate politics - particularly in Arizona. A bill starts off as a bill for firefighters and paramedics, and ends up as procedural change. Riders and amendments get added to routine bills that trojan horse unpopular things through without notice...Fun fact. Amusement parks have never worked in Arizona. The season is too countercyclical. Kids are in school during the mild winter, and out during the months it would burn your tuchus to sit on a ferris wheel. And parents would be understandably averse to an all night amusement park...

The funny thing is this bill was proposed a few weeks ago and has been being pushed by a group that wants to build a Soccer Stadium at the gravel pit site in Mesa, not by the Coyotes. But it will benefit the Coyotes Arena anyway, or at least that's what they say. See the story from Arizona Sports about it from April 1st.

Public funding refers to the development of the project. Them getting a voluntary tax after investing billions isn’t them receiving public funding for the project. I know I’m splitting hairs but there is a massive difference between receiving public funds to build the project and a voluntary tax after the fact.

Question: if nothing happens and the Coyotes never return, will the past records, including the OG Jets just disappears? Or would they revert to the current Jets and or Utah?

Player records , team win -loss records championships stay with a franchise. Even when they move and change the name. That’s why they call them “franchise records”. Even when they move and change the team name that franchise owns the right to the previous name when they no longer use it unless it’s dictated in the sale that the city or in the coyotes case the previous owner retains the rights. Like the city of cleavland did with the browns so when they were given an expansion team they were able to be the browns. That franchise records everything start from scratch it’s a new franchise. The coyotes owner as part of the sale retains the right to the team name but when and if they ever exists again it will be a brand new franchise. If retaining the rights to that team name like the case with the hornets leaving charlotte. They owned the rights to the hornets name so when charlotte got an expansion team they were named the bob cats. Years later when the New Orleans hornets decided to change the name to the pelicans Michael Jordan’s as the owner of the bob cats still had to buy the rights to the hornets name from the pelicans to change the bobcats name to the hornets even though the original hornets were no longer using the name He had to buy the rights from them to do so

So while I don't agree with the request, let's speculate on the position of the nhl. I believe that they would say that the current land generates zero real estate taxes and no sales tax revenue for anyone. They would say, it is open desert and has no value to anyone. They would say it is only because of this development planned that the land will all of a sudden create value. They would say that because of the development creating value, the developer need not share that value with the local government. BUT if he is paying for all the infrastructure, buildings, etc out of his own pocket...why should the State, etc benefit from it if ZERO money was contributed to the project by the government. He owns the land, its a private project. What he does with the monies is his business. The government isnt helping with maintenance on the project or other issues....its like Disney in Florida...

Maybe I'm in the minority, but this doesn't sound all that bad. It's charging people visiting the site that's not coming in currently and the owner has to build the theme park for people to come to that site, right? Try having your city institute a hike on ALL sales tax PLUS a hotel tax across the whole city to pay for your stadiums. Doesn't sound all that bad to me.

The only thing bad about it is that the county will have more power than the local authority. There's nothing inherently wrong with the district having its own tax. It's common in other states. But it's up to the locals to decide if they want to give away that power and money.

It's not quite that straight forward. It definitely costs a lot more people than just team supporters. The theme park district takes away tax revenue from the surrounding community the theme park district relies on for customer and employee access infrastructure and transportation, fire and police services, water supply and sewage treatment, etc. and leaves the community with the bill, not the fans, ownership or league.

Meruelo's operation says they're going to build a new 10K arena in Reno on land right by the GSR casino, -- which he now owns. The U of Nevada hoops team would then move in, ( with a minor league hockey team). Is that just cheap talk? A lot of us up here in Reno think it is a bunch of baloney.

Will there be lots of rides for kids as well as adults? Will mascots and animals will be seen in this district? I thought Meruelo was going to build condo buildings, shops, restaurants, etc. on the land? How does that qualify as a theme park? The auction winner is supposed to be the "highest AND BEST" bid, so if another party says they'll develop the land and pay their taxes, that may end up being seen as the "best" bid even if it's for less money up front.

I don’t see why that would be a bad idea if it’s capped by a date or an amount - then the tax roles back to the city. If the man is gonna be paying for everything it makes sense he would he would wanna get something back for that type of investment. I don’t think it should be a forever thing, but can easily be negotiated to be reasonable. People should want to encourage new building and continued business as long as it doesn’t hurt the tax payers in the long run within reason.

Also the special tax could/would be applied to the 400,000 sqft of retail and 500,000 sqft of office space that is going to be built (just not the hotel). So the public would be in essence funding not just the arena but all the other development he wants as well. Being designated as a special district allows him to use the city's credit to take out the laons (which would be a much better rate than he could get on his own). Meanwhile Muerleo drones on about how it is all privately financed. Which is at best a half truth and realistically a lie. He either doesn't understand how the taxing works or he is being dishonest about it. Neither is a good.

The 12news report isn't completely accurate in how it portrays the situation, and is slanted to favor the proposal's opponents, IMHO. The "entertainment district" financing is similar to how State Farm Stadium was financed. I pay an added fee on my Cardinals season tickets that goes to pay off the bonds that financed the construction of what is now known as State Farm Stadium. To amplify that point, it's important to keep in mind that any "tax" or "fee" charged for admission to the new arena is only going to be paid by those who actually **use** the facility. It's not unlike gas taxes that fund roads and streets, or greens fees that fund public golf courses. If an Arizona taxpayer doesn't go to a Coyotes game, he or she won't pay a penny to fund the facility. It's also important to keep in mind that the public money invested in the project through this fee/tax is money the state or city wouldn't otherwise see, because the Coyotes won't be In Arizona. Non-existent businesses don't pay people or taxes.

While it would help the coyotes they have denied being involved in the legislation. The main guy who is pushing for it is a guy that is trying to build a Pro Soccer stadium and bring an MLS team here in Mesa. The rising have been very successful and Phoenix is a very good market for soccer. The news story is a little disingenuous, Arizonas politics in general are garbage and Alex Muerelo has done a terrible job at navigating it. I don’t think he will be able to bring them back so I hope at some point the rights are sold to someone that really wants to own it and have them do well.

Alex Murelo has 5 years to build an arena or the team is officially defunct. If an arena is built, then the Arizona Coyotes will be the 33rd team in the NHL and they will have an expansion draft to put a roster together.

I give it about a 20% chance that Muruelo gets everything passed and built within the 5 years. It pretty much all comes down to the June 27th land auction but after that we’ll know what happens. I would be fuming about this if it was in my town. A huge development like this still has repercussions for the community including added cost for infrastructure, fire protection, police, etc. if they’re not paying tax, they’re a burden on the community. Destination attractions can’t be touted as helping the greater community if guests don’t have to go out into the surrounding community for anything.

Open your perspective. It creates jobs and boosts the economy not to mention improves the quality of life for the general public regardless if you are a fan of hockey or not. Furthermore the patrons of the facilities contribute to the funding of the complex via the sales tax directly versus the public being taxed against their will. In other words the fans and patrons get taxed evertime they show up and buy tickets food drinks merchandise, etc. I agree the location isnt the best but its sure a whole lot better that driving half way to California to watch a game.

ENOUGH with this "district" kurapp; its about needed in a place like Phoenix as they need TWO hockey teams. No, ALL they need is a downtown arena and they are back in business. Downtown Phoenix is already a "district". Thats it. Build downtown, build it with a steep seating grade (like Vegas, Montreal, and Detroit), don't make the seats too close, and starting counting your money.

Phoenix has is castles n coasters and let’s be honest pales in comparison to the big amusement parks. I always felt that Universal Studios Hollywood and Disneyland would better fit in Arizona instead of California, because Phoenix has so much land for amusement park resorts. Also it wouldn’t be far for residents in Los Angeles(4.5 hours), San Diego(3.5 Hours) or San Francisco(8 Hours) as most Californians travel to Arizona daily anyway.

I think Bettman was pretty clever in persuading Meruelo to sell the team to Smith in exchange for a 5 year window to finish building an NHL arena. If Meruelo succeeds, he get another crack at a team.
