Neither pose nor composition can be copyrighted. So, getting worked up over it is a waste of emotional effort.

I ran into an elderly, jazz musician on the bus many years ago. I asked him some musical question even though I don’t really know music theory. He said something very interesting: “If the audience could hear with a professional musician hears ,they would be on stage.” Applying that to the visual arts, you have to be an artist to even notice a swipe. Every great comic book artist has done a swipe, or a homage. Neil Adams, George Perez, Gil, Kane, Russ Heath, Frank Franzetta,everyone.

Personally, I'm motivated by the thought that my work might get swiped. It's what inspired me to learn even more about anatomy and perspective, imagining a newer artist trying to redraw from what I've done (and wanting to create good examples to learn from). But there are a few individuals who use the issue as an excuse to make a quick buck or create controversy... I heard about one guy who got his photograph of a cow (of all things!) onto one of the first pages on Google Images... And now searches for artists who have drawn from it to demand royalties! Which of course scares people off of even considering a reference... Great topic 😊👍 (Big fan of the channel!)

Thanks! That’s a very healthy attitude. I tend to agree with you although I would understand if an artist is upset when their work is swiped. The cow story is crazy. It reminds me of trademark squatters how register tons of trademarks on things they don’t even have products for so they can go after people who already have products without a trademark or they try to trademark things like common phrases that everyone already uses that they didn’t come up with.

As someone who has written and read lots of story I never understood why people have such a big problem with swiping. So many forms of art get inspiration by writing storylines that are other stories but different characters. I don’t know why poses are different.

I’m not sure ether I know a lot of manga artist use possible models and references because they are on such a time crunch. Models are even built into software like Clip Studio Paint.

Some poses are pretty standard and classic throughout comics and all artists use them, e.g superheroes perched on rooftops. Is this swiping ? It's a tough one, I think Greg Land actually made his reputation on doing it the way it shouldn't be done but I may be wrong there. These days though with mobiles, 3D models, real models, Google Earth and even a mirror we've got so many more options if time is short. Well I guess mirrors aren't all that new, but you get my point hopefully

Imitation is the highest form of flattery. And, you're right, unless you are NEVER using any original content, the art puritians are overreacting. Good topic for discussion!

I don’t have any issue with “swiping” a pose. The human body isn’t anyone’s IP. But one thing I can’t stand is tracing with almost no alterations to the original image like Greg Land?

I agree, I don’t know to what extent Greg Land traces, I’ve heard it’s a lot. But it’s my understanding that he can actually draw so it may be one of these cases of him being a professional and working with crazy deadlines, again I’m not supper familiar with his work.

I think there are a lot of grey areas. If someone bought a pose book which granted them the rights to use the characters in the book they haven't done anything wrong. They paid for the rights to use that work. If someone is exact copying scenes and characters while only changing the clothes and colors that's another matter. Nobody remembers because it was years ago but Nick Simmons(son of Gene Simmons from Kiss) came out with a book, Incarnate, in 2009. From what I read he pretty much traced out a number of scenes from the manga Bleach. Production of his comic was halted over accusations of plagiarism. As far as I know, Nick Simmons never made another comic. I think that's too bad. People should be allowed to learn from their mistakes and move on.

Fair enough, it’s sounds like the Nick Simmons case was excessive, but I agree we should be able to learn from them especially mistakes we made when we were young.

It's like music how every band has all played songs that some how sound similar or parts that sound like another song ... we eventually all draw something similar to another artist it's just how it goes, we're all influenced by so many, hell even greats like Jack Kirby swipped in his day...and the ones gate keeping you never see any of there artwork any place or if you do ...well let's just say they probably could use some actual art lessons and have no place giving criticism to other artists.

I think most people who are upset about the occasional swipe probably should spend less time complaining and focus on creating. Folks like Kirby are too busy being productive to worry about such things.

Like you I take a sorta neutral approach to it - especially when it comes to professionals who are under absurd time pressures (worth pointing out that many examples of swipes are one of the "big two" swiping from themselves, e.g. a DC artist swiping from another DC artist). In a perfect world I'd prefer an acknowledgement when it's not an obvious homage but honestly it doesn't really matter to me. When indies do it it can bug me a LITTLE more, but again: acknowledging it feels like enough.

For me personally I like to do homages and would give credit. Im not sure I would ever do a blatant swipe, like in the middle of an issue. But I not up against the same deadlines so because of that I understand and would give them a pass.

All still life and portraits are swiping from nature. All of nature is made up of patterns of particles and pseudo particles that can be expressed as assets that scale up to the size of the observable universe. The universe is infinite but assets no matter how large are bound by physics that limit the number of patterns possible. For the universe to be infinite all assets must be reused an infinite number of times. It's just like how in a video game programmers only have so much room to code so they will reuse assets over and over. The universe is the same just much larger. Therefore what we humans produce and think is original, from Calvin and Hobbes to the Mona Lisa, the universe has produced those very images through natural processes somewhere else in the universe an infinite number of times. There is nothing that we as humans can create then that is truly original. We are but conduits for the natural process of creation for which only the universe may take full credit for.

There’s nothing truly original, I agree, but here are infinite was we as artists can use the inspiration out the and leave our own unique mark.
