As Arizona Reinstates 1864 Abortion Ban, Doctors & Organizers Fight Back to Preserve Access

In Arizona, Republican lawmakers have blocked efforts by Democrats to repeal an 1864 law - first written before women had the right to vote and recently revived by the state’s Supreme Court - that bans nearly all abortions under threat of criminal penalties including jail time. To respond, we host a trio of reproductive justice advocates in Arizona. Dr. DeShawn Taylor, an OB-GYN physician, abortion provider and the CEO of the only Black woman-operated abortion clinic in Arizona, emphasizes that her practice "will continue to provide abortions until we are made to stop," but warns that in the future "abortions likely will not happen in Arizona because of those criminal penalties." Meanwhile, organizers like Chris Love and Alejandra Pablos are fighting back. Love is a spokesperson for Arizona for Abortion Access, a coalition of reproductive rights organizations working to put a constitutional amendment on abortion on the state's upcoming November ballot. The petition for the proposed ballot measure is still collecting signatures. "We know what we want: We want people to have the care that they need," concludes Pablos, who organizes for reproductive, racial and immigrant' rights.

The point is that in reality, people are being harmed including those who desperately wanted to carry to term. Harm can happen to anybody because of these laws no matter their political party, their religion, or their personal beliefs. Only doctors are qualified to help make these decision. Not politicians. Not judges. And certainly not nosey people who don’t care if others are harmed.

It would not have been, except that a 2019 law passed including a 15 week ban specified that the 1860 law was the law of the state, but had been blocked under Roe. The law included that the 15 week ban would sunset upon the repeal of Roe, and the previous law would take effect. At that time, much like the Texas law at the same time, nobody took these seriously because it was assumed that no judge would dare. Now it is the case of the dog catching the car, and trying to figure out how to escape the penalty of their own foolishness, similar to the "maybe we can offer the EU a deal" party in Britain.

@@AnneofAvonlea not voting is not an answer. I agree all children are precious and are a gift from God; however, many women have miscarriages and need abortion immediately. If they do not, infection can spread and they may not be able to conceive. My wife had five miscarriages and had to undergo abortions to prevent infections. It was an emotionally extremely difficult time; however, nine years later we had two healthy babies. They are in college. My wife and I were lucky because we received the best medical advice. I want all women to have that. I am religious and go to church but I believe religion and science should not be mixed.

The 1864 law was on the books in Arizona on abortion in 1864 it didn't matter if you had an abortion you would be going to jail and find the doctors would be going to jail also . Arizona did locate and repeal a lot of old STATE laws that were conflicting with modern laws or were just outdated, but I don't think they went back to check the territorial laws. There may be some good ones to bring back.

Unfortunately, in 2019 the state congress had passed a 15 week ban with the postscript that this 1860 law was the actual law of the state, and the 15 week ban was a stopgap until roe was overturned.

Agreed! But this isn't just a women's rights issue. Little girls (who are children, not women) will have to give birth at great risk to their lives and happiness if this law is instated. Also, I'm six months pregnant right now in a red state with a six week ban, and my life is on the line if anything should go wrong because medically necessary abortions are routinely being denied here...and I'm nonbinary. So only talking about women's rights excludes me and many others like me who are affected. I'm not offended or trying to start a fight, just reminding people this movement affects so many people, not just women. ❤ and solidarity

The France thing is an entirely meaningless symbol, a move of apaisement from a very contested governement (especially in the context of the opposition to the recent Darmanin law). Using the terms "enshrine in the Constitution" also holds vastly different meaning in France than in the US - the US constitution is from the 18th century, whereas France's current constitution is from our current political regime, the 5th republic which started in 1958. When you've had like 15 constitutional documents, it's not at all as meaningful to add something to the latest one.

Regardless of the gender of the pregnant person if you have a body it has to be your choice whether or not to create another person within in it. If this choice is denied then you are no longer a legally or philosophically free person as the state of your being has been superseded by some outside force which then means your rights, body and life-including your rights over your genetic legacy is no longer in your hands. It means that your womb belongs to the State. The womb is not meant to be a piece of property that one’s criminal liability lives and dies upon. All of these womb criminalization laws are designed to protect not life but the illogical sensibilities of a portion of our fellow humanity which is only invested so far as it can bask in its supposed moral superiority among its own groups. I doubt that 99 out of 100 of these people would ever put their own lives and bodies on any such hard line if push came to shove. My guess is that most do not have the biological capacity to ever be in the position they are forcing others into; ie being at risk of becoming pregnant. Pregnancy is the oldest and riskiest biological condition that all organisms must face as a condition of life. Dismantling almost every guide rail that our species has been able to invent in order to make this incredibly complicated process just a little bit safer in order to survive a pregnancy regardless of outcome is the same as removing seatbelts and speed limits from the law because it would interfere with the natural consequences of a life threatening situation and this thwarts some will of a god notion. At what point will an induced labor be considered an illegal abortion? What if the patient births a child that dies on its way out of the uterus? Is that not similarly a choice which was made by convenience and does not follow the natural law of a god? Or maybe not every viable embryo is implanted and so will there be requirements for each one to be implanted in any uterus available so that it must follow its predetermined biological path? The nonsense factor is so high when one follows the logical, legal, ethical, and biologically sound paths to their conclusions that it would seem utter rubbish to imagine that a modern society would enshrine any of these situations into the criminal code. And yet it is still happening. I believe we have become so numb to the notion that other people’s ideas about religious beliefs can and must be so seriously considered that they have a high probability of becoming the law for everyone that we stopped thinking twice about it. Where there is medical need no one sane stops to check in with the necessary treatment’s compatibility with the Hammurabi Code or if some invisible all powerful being is in agreement. And yet this is exactly what we are being forced to accept as a condition of living with a uterus in so many places nationwide. I am always struck by the profound disconnect between the illogical nature that our legal and political systems are comfortable allowing simply because we fear chaos would ensue if we were to rationally address the inevitable failures within human social contracts. Instead we give them much more power than they should ever have had and we end up feeling powerless against traditions of all kinds that are inherently flawed by their very humanly created nature. We end up self harming for no other reason than our own infantile lack of faith in ourselves to make changes when they no longer serve us. We have a bad case of stunted adolescence which gives so many of us the need to hang onto the blankie/binky of an imaginary all powerful parental being. We harm ourselves, and traditionally those who can become pregnant specifically because they have the temerity to actually create life and make adult decisions for these potential future lives without consulting or even needing any imaginary parent involved. The fact that everyone one of these new laws infantilizes and punishes those of us with wombs is not an accident. It’s just the outcome of a belief where only the chosen few are allowed full adult-human status and punished harshly for the crime of acting like a responsible adult when it comes to making decisions about the existence of their own future children. It’s certainly a rotten pretzel of a rational which has immediate life and death consequences. It’s a civil liberties violation that should immediately be challenged on the grounds of false imprisonment within an unwanted state of being.

Colonialism still exist in so many ways. The majority of women, including in my Caribbean so-called family, have been brainwashed to be/stay wilfully ignorant, baby makers, and to treat offsprings as slaves, just like European colonizers treated them to be slaves. The main person, in my so-called family who gave awful/unwarranted advice, was/is my so-called, christian, grandmother.

The problem is cost, availability, and the fact that Republicans are trying to make contraceptives illegal and harder to obtain. This also doesn't even address the fact of rape where the woman doesn't really even get a choice in contraceptive measures. The Right to Contraception Act passed with 228 to 195, and those 195 votes against were Republicans. After losing that bill they've been trying to do everything they can to destroy access to contraceptives on the state level.

Not educated is a big one. Birth control can be expensive, especially for women with no health insurance, but the morning after pill is relatively affordable. Young women are not educated enough to know this.

Love this interview and I’m fiercely pro choice.. but it’s so inappropriate to ask doctors what they’re willing to risk to give women abortion somewhat implying (though be sure this was not the intent of the interviewer) that if you’re a doctor that will not go to prison for decades to provide abortion you don’t care about women enough. that is an absurd expectation.

When you're pregnant going to a doctor for an ultrasound and to discuss the pregnancy, are you and the doctor using the term baby to discuss it or cells? Likely you're not even using the term fetus. Some states are enacting some of the most extreme abortion laws because Trump appointed some of the most conservative justices to the Supreme Court, so it's his fault. If you're angry about it, Roe your vote in November and make sure Trump and Republicans get the message.
