British-based lawyer James Drake has been appointed head of the Panel at the Court of Arbitration for Sport (CAS) that will decide later this month whether Russian figure skater Kamila Valieva violated anti-doping rules and should be disqualified from last year's Winter Olympic Games in Beijing, it was announced today.
The King's Counsel will be joined on the CAS Panel of arbitrators by American Jeffrey Mishkin, who was nominated by the International Skating Union (ISU) and World Anti-Doping Agency (WADA), and Mathieu Maisonneuve, who was chosen by Valieva.
The behind-doors hearing is due take place in Lausanne on September 26, 27 and 28 with an extra day allotted for September 29.
Valieva will not travel to the Swiss city to attend the hearing and will instead give evidence via video, CAS revealed.
In January, an independent Russian Anti-Doping Agency (RUSDA) Disciplinary Committee ruled that Valieva had tested positive for the stimulant trimetazidine through "no fault or negligence" of hers and disqualified the results at the Russian Championships on December 25 2021, the date of sample collection.
WADA, RUSADA and the ISU appealed against the decision and are seeking further sanctions.
WADA wants a four-year ban for Valieva, including disqualification of her results at Beijing 2022.
This would deny the Russian Olympic Committee (ROC) team of the figure skating gold at the Winter Olympics.
Valieva, however, is seeking a ruling from CAS that it lacks jurisdiction over WADA, ISU and RUSADA claims and that she did not commit a doping offence and should be reinstated in the results of the Russian Championships.
In the alternative, she is seeking a ruling that she bears no fault or negligence or that the violation of the rules was not intentional, so that the period of ineligibility shall be at most two years and that no results shall be disqualified.
At Beijing 2022, Valieva was only 15 and helped the neutral Russian team to gold with flawless execution.
She was the favorite for the singles title prior to being at the centre of a doping scandal.
The medals were not awarded for the team event and Valieva displayed an error-strewn performance in the free skate and slipped to fifth.
Second-placed United States, third-placed Japan and fourth-placed Canada are all in line for upgrades in the team event depending on the CAS decision.
Drake, an Australian by birth is now based in London. Drake has been involved in various high-profile CAS cases in the past, several involving Russia.
These included a CAS appeal in 2021 by many athletes banned as a result of WADA evidence uncovered during the investigation into Russian state-sponsored doping and a challenge against World Athletics' decision to suspend the Authorized Neutral Athlete scheme before the re-arranged 2020 Olympics in Tokyo.
Russia lost on both occasions.
He was also chair of the CAS panel that heard a case by US sprinter Christian Coleman before Tokyo 2020 against a ban imposed for a series of whereabouts failures.
Drake's Panel reduced his length of suspension to a year but he still missed the Olympics.
Mishkin is the former chief legal officer for the National Basketball Association before becoming the head of sports practice at the law firm Skadden, Arps, Slate, Meagher & Flom.
Maisonneuve, meanwhile, is professor of law at Aix Marseille University and a member of the French Olympic Committee Sport Arbitration Chamber.
Among the arguments that Valieva is expected to present is that the banned drug could have entered her system after she drunk from a glass her grandfather had taken prescribed medication from.
"An urgent fact was needed as to how this could have gotten into her body at all. It was clear: the ingress was accidental," Philipp Shvetsky, doctor of Russia’s figure skating team at Beijing 2022, told the country’s official state news agency TASS in July.
"We talked with the Institute of Pharmacology - for the complete elimination of this dosage it takes from 24 to 72 hours, no more.
"Therefore - yes, this is the first thing, what could have come to our minds."
According to CAS, the proceedings are due to start on September 26 with a short opening submission from each party, followed by the hearing of fact witnesses.
The following day, the Panel will hear expert witnesses and on September 28 will hear the parties’ closing submissions and rebuttals.
Should additional time be required, the Panel and parties have reserved September 29.

Carolina's disqualification was in fact totally unfair, in my opinion. She was clean, why the heck you make her pay for someone else's mistakes? Compared to that, the whole Valieva thing is just a big joke.

I'm taking trimetazidine for my heart condition. 1) The difference it does for my stamina and dnergy levels is very noticeable 2) It's a pill. Quite a hard one. You don't chew it, you swallow it. So how could grandad's glass be so contaminated to show up on a pee test several days later?

trimetazidine is manufactured in capsules too, though. and what many elderly ppl do in post soviet countires (i know it cos my grandma did it with other pills that come in capsules) - they take the meds out from the outer shell and mix it with water so they dont have to swallow the ''pill', instead they just drinking ''medicated water''. not saying i believe that is exactly what happened with kamila, but for ppl from ex ussr this doesn't sound as crazy as for 'westerners'

Many older people can not swallow a tablet or capsule whole due to problems with the esophagus, and so they grind it into powder or dilute it with water, this is how my father takes any tablets. Don't say you didn't know this! And you noticeably have a lot of attacks on Kamila

Omg, I used to work with Russians when I lived in New York City. They are incapable of little white lies ... if you ask them how they like your new haircut, you'd better be emotionally prepared to be put on blast. It was scary at first, but I grew to cherish them so much. Oksana reminds me of those ladies so much. I know she's from the Ukraine, but she's so straightforward. It's kind of her to share her point of view. Oksana ... I wish you had kept your 93 short program and changed your long program for the Olympics. You were born to skate Tosca. THE DRAMA would have been awesome. But I guess since you won, you did the right thing. 😅

I’m confident they won’t manage to pull it off this time. Sure, they’ll make her a martyr but she’ll get disqualified. Just for a short time but anyway we’ll never see her in international competitions again…I mean I doubt she’ll be able to beat Akatieva or Petrosyan or new seniors. We’ll get a decision probably next spring considering how long we waited for this hearing. In any case, the coaching will continue and so on with the doping…that’s the real problem.

So Kamila should get a long ban for one lousy doping test, when Jamaican swimmer Mackenzie Headley got a simple reprimand with no ban for 2 doping violations with multiple banned drugs each just because she's a protected person?? .....hmmm..double standards...😮😮😮

@@amyl6426 Richardson received the minimum suspension of 1 month which was reduced from 3 by USADA, which she accepted and didn't appeal...and completed a drug counseling program required to get that reduced suspension ...so instead of comparing her to Kamila, compare her to Headley, who got nothing....

I agree. It’s been the case for every other athlete who has tested positive in the past knowingly consumed the banned drug or not. It’s a disgrace to go through the whole ordeal making her an exception.

Are you sure about this when you look at the CAS judging panel? Since ISU and WADA nominated an US judge and the president who comes from the UK also lived in the US, I don't think Valieva will have a fair trial with such biased judges. It's all about politics and everything is all decided already.

She like most coaches has a team of experts working on her skaters jumps…she gets the glory of being the head coach. Many skaters already have their jumps when they go to these “top coaches”

It’s not a child’s fault who is forced to take drugs by her coaches. They should go after Russia and suspend the entire organization No neutrality. ETA: folks! I never said she shouldn’t be sanctioned- of course she should for many reasons. Saying she was forced doesn’t mean the whole thing doesn’t hurt the sport and lives.

Her medals definitely need to be canceled even if it's not her fault. As for the ban, I just can't think of any reasonable scenario where she can be unbanned before her Eteri expiration date. She chose to delay the investigation and continue skating for 2022~23 season, after all.

I am pretty sure that the coaches had Kamila and her family's consent to put the drugs into her. Because the athlete has to actively participate in this whole drug taking process to prevent from being tested. Kamila and her family are definitely not oblivious to this whole thing.

Not when you look at her jump technique & actual skating skills. Yes, she has extension but that’s about it. It’s really hard to comment on if she has musicality or not due to the Danny G programs & her using identical choreography with minor changes in different programs.

I find it really hard to judge her skating with the horrible choreography. Leg kicks, arms over the head, constant turning and twizzling. It's too many tricks and not enough skating.

I would be okay with an outcome on the basis of her age as a minor if Kamila gets a stern slap on the wrist... if it meant the adults or state *took responsibility* instead for said minor. Oh and affected athletes can get *fair and earned* results from being clean. So basically, unlikely, in my dreams, they'll rather put it on her to disqualify her rather than put consequences on the ones with greater responsibility over her. Honestly I think if anything, endurance enhancing drugs in this sport SHOULD be more punished than ones that are performance enhancing, as getting caught would imply it is taken over a period of time to be effective on performance.

Everything since the Olympics has been carefully calculated. Her weight gain, the laughing and smiling during competitions, the toned down content. That combined with the best costumes and programs while the others have to perform as Michael Jackson make her appear even more “other worldly” and “divine” as the Russians say (side note, it’s extremely creepy how adults are speaking of a minor that way). Yulia should’ve popped for steroids prior to bombing the individual event at Sochi because she would have been a martyr.

@@user-nh5qj7cz3m You ate exactly what the propaganda feed you. She won nationals, euros and olympic team event only and all while doped up on banned drugs. That is not a once in 100 years resume. That is not the resume of someone who wants to lay claim as the greatest ever. That is the resume of a skater that got caught doping in her prime and burnt out too soon for her light to truly shine. Sad? Yes. But true. At this point Sasha, Anna, Zagitova, Medvedeva, Lipnitskaya, Tuktamysheva will ALL go down in history as better and greater skaters than Valieva. Once Valieva is stripped of those three titles, she will be in the history books as the skater that got caught doping.

Her suspension will likely be the amount of time she has been excluded from international competitions since the Olympics. That would start with the banning of Russian skaters after Russia invaded Ukraine in 2022. By 2024, I think she will be allowed to compete, but only if Russia is allowed back, of course. I also think it is at least 50% likely that Not Russia will lose its team gold medal.

That's it. And this is correct, unlike the Americans and Canadians, since American judges will speak on their behalf in court. There is a conflict of interest. Will the court be independent or biased? The doubts are too great!

Kamila Valieva is not at fault. She is a child and the adults that surround her should bear the responsibility. She should not be banned and should allowed to keep her Gold medal. Valieva should be allowed to compete internationally - immediately.

Her metals still should be disqualified. Everybody else’s are disqualified. Otherwise, Russia will continue to do this, because even if they get caught nothing is done. Everybody else who gets caught is punished, so should she. It’s not fair to the other Athletes, or why even have the Olympics?🔺🔺🔺🔺🔺🔺

Her Euro and Olympic tests were clean, and she was ALLOWED to compete at those events while the Dec. Test was floating somewhere for 45 days...also you say everyone who gets caught is punished, yet Jamaican swimmer Mackenzie Headley got a simple waive of the finger and no ban for multiple doping violations with multiple drugs in each... so what is that all about??

For the lies that she pours on Russian athletes? She is Ukrainian, that says it all. You can’t trust a single word, because she hates Russians and all her words are biased because of this hatred. From 2001 to 2021, the United States committed aggression against Afghanistan and occupation of Afghanistan. From 2003 to 2021, the United States committed military aggression against Iraq and occupation of Iraq. In 2011, the United States committed aggression against Libya. All this time, the entire US team participated in the Winter Olympic Games and Summer Olympic Games. Why wasn't the US suspended? Why was the IOC silent? Why was Thomas Bach silent? He was a member of the IOC from 1991 to 1996, a member of the IOC Executive Committee from 1996 to 2000, Vice President of the IOC from 2000 to 2004, and was again elected Vice President of the IOC in 2006. He headed a number of IOC commissions. As of September 2013, he headed the IOC Legal Commission and the Sports and Law Commission. In 2013 he was elected President of the IOC. During the entire period of his work, he never spoke about US military aggression. The question is why? Was he interested in remaining silent? What was his interest in remaining silent: in the position of President? in money? Was it corruption?

O.Baiul said she doesnt understand how Valieva was accepted for Olimpics 2022 since she was a minor. 15 y.o Valieva already was in shape and ready, and why would she sit and wait, waste her time and life another 3 years and not perform there???!

Honestly this girl, I don't even know what to say. I mean she is really talented as a skater, but she is something else. Not only she wasn't responsible for doping that was found in her samples (which to be fair could be an accident, there have been precedents before), but she wants her gold medal back from the day it was found, since "she is apparently not responsible". And that has never been done before, even when the athlete had been found innocent of taking doping intentionally their results were still annulled and the medals allocated to the athletes who placed next on the podium.

I started watching isu figure skating in 2020. It was so exciting, I would binge watch the Grand Prix’s and championships. Now, without the Russian skaters, it is as boring as hell. They made it exciting and continued to raise the bar. Sorry to current skaters but I don’t bother watching ISU stuff anymore, it’s just too boring.

I agree, I find skating without the Russians incredibly boring. Russians raised the bar and they brought the drama.

I enjoyed the Russian skaters and their contribution but it IS a pony show and I can learn to adjust and appreciate the real sport and art that it is instead of body abuse and drugs by the likes of Eteri. It's similar to say people who start watching figure skating because of one skater but once that skater retires, the question comes, do they just like the skater or did they come to like the sport itself? Are we here to watch Russian skaters complete marvelous feats knowing they are doped while the other skaters skate normally in competition? Are we going to pretend women doing quads is normal in Russia but not nearly everywhere else where elite skaters' skills progress at a normal albeit slower pace? Let's be real: I can pay to go to an ice show or a circus for watching marvelous feats, and not have to pretend what I'm watching is supposed to be an elite level competition where it's fixed by doping, overscoring etc. Yeah, the quads were marvellous. I started watching in 2018 so it quickly became my perception of normal. But step out of that narrative for long enough and you realise it's really not worth engaging in a bad reality TV competition and not worth damaging children's bodies by age 17. I'm better of being bored and instead honing my ability to discern quality of glide, control, power, techniques instead. Also: People talk about loss of viewers because of the Russian ban but how many more people have already left because of all the cheating bs, for example those who left unhappy with Sochi? Why do we never talk about how the Korean market did after that? Did the Beijing Olympics bring in new figure skating fans and sponsorships after what we saw of the ladies freeskate WITH the Russians there - compared to people who could have gotten interested from the Olympics, if the freeskate experience wasn't so utterly awful? How many quit after that or took time out? How many more viewers could we have if more matured skaters with artistic expressiveness and power were rewarded for their charisma and if skaters had longer careers in the sport so they could develop a fan base over time, instead of this 1-2 year run in a factory?

No matter what decision would be.... No to Olympic Games without Team Tutberidze! No other coach in Russia beside Tutberidze at moment has such high standard figure skaters to represent Russia at Olimpics. And nobody in the world does!!! Therefore, this figure skating competitions should be invalidated without Russians.
