I knew CHP officers that patrolled Compton, Oakland, Richmond. They called it “No Man’s Land!” All my CHP friends left the state as soon as they retired! Im not saying where. I don’t want nutty lefties from CALOCO following me and F-ing up that other states with their insanity!

Aren't the laws for ccw permit holders a little different? In my last renewal class the deputy talked about securing the locked box with a cable and a loaded hand gun could be carried in the locked box by a ccw permit holder. Is this true?

@@rogerpeterson7581 you have a ccw permit you can carry a loaded gun at home, in public, and while driving. There are areas you cannot carry a gun like schools so you would then put your loaded gun in that locked container. You don’t always have to carry the gun wherever you go. The gun must not be easily accessible to children or people that are not legally allowed to use a gun, that is where a locked container comes in.

Transporting a firearm legally in California, depends fully, on what cop you're dealing with, and the mood he's in. Don't fool yourself for a second. In fact, doing anything depends on that.

One more thing, the transport laws apply at the front door of your house. As I read the law, in theory a cop could wait outside your house and see you transport a bare gun to the locked container in the car and charge you with a crime. Or a neighbor who hates you could call the cops. Best to lock up inside the house and dont be seen carrying a bare weapon.

No. You can have a gun on your property at any time. Concealed or openly as long as when openly carried to say your vehicle you are not doing it in a threatening manner (brandishing) and also not doing it in an otherwise conspicuous way, like holding it way about your head so everyone can see it. Just walk out to your car and put it in there. No laws broken. If your car is parked on the street instead of the driveway this might not apply

@@didamnesia3575 That's not true. If your front yard and driveway are fenced (doesn't need to be locked) then that is considered the same as a back yard and carrying is legal. The unfenced front yard or driveway is considered a semi-public area, crossing the threshold of your front door (there are exceptions) with a loaded or unloaded pistol or long gun, concealed or open, with it _not in a case_ is a crime. If you are within 1000 feet of a school, that's another charge. If the pistol isn't registered to you, that's another charge. If your magazine is standard sized, you will be charged with that too...

@@didamnesia3575 Read People v. Strider 2009. People v. Knight 2004. In re Zorn 1962. People v. Overturf might be relevant? IDK. It is not in the statute, (PC 25400, PC 25850, and others) it is enshrined in decades of case law precedents. You will have a bad time if you're cought carrying in your front yard (provided that it's not fenced, and of course, in law, there are always exceptions). [Disclaimer: I am not a lawyer, nor do I play one on TV. Listening to me may not be advisable.]

In California there's a school in every block so always keep your gun in the lock container at all times no matter what type it is handgun shotgun assault rifle doesn't matter keep it in a lot container I wish we had samples of what type of containers would qualify

The way I see it and counter that argument everytime is this. yup you are right the ar 15 wasnt invented which is why the founding fathers were extremely clear in their language and use of punctuation! You see, the founding fathers had just a very long and bloody war for our freedom and they had to match a tyrannical government in fire power! at the time muskets may have been that fire power but right now it is ak and ar and a whole lot of other things. They used a comma in the phrasing for this reason. a well regulated militia being nessecary for the security of the state, the right of the people to keep and bare arms SHALL NOT BE INFRINGED. this broken up means that it is necessarry to the state for us to have a military but to avoid a tyrannical government we the people are allowed to have equal firepower to the military to keep the sanctity of our freedom in which the founding fathers fought to ensure!

2:10 that's exactly what I was told after I moved here. Thank you for clarifying. People think your ammo needs to be in a separate container. Not true! Even CA has some bullshit gun laws, I've been surprised at how many gun owners actually think the laws are stricter or worse than they are. I'm a newere resident so I've been trying to really learn the laws. Thanks for this informative video.

Thanks for the info! A lot of people get confused on transporting a firearm and ammunition in the same container and I’m glad you cleared that up for them. I was at the gun range once and heard a guy who worked at the range and who apparently use to be a retired cop tell a customer he couldn’t store his firearm and ammunition in the same container. I felt compelled to correct him and I even had the applicable penal codes with me (which I always keep printed out in my gun box) and had to educate him on what the law says.

i thought i read some where that the ammo has to be stored separate from the firearm and the locked container could be a trunk or if in the cabin of the vehicle would have to be a separate container not including a glove compartment or center console. Thank you for this video as it has encouraged me to look deeper in CA gun laws.

Love this video and this is the third time I have watched it to just have the reminder of what we can't and can do. Could you do a video about transporting across states lines, please? I am moving from CA to TN in a few weeks and would love to know the best way to transport my guns and rifles so I don't get in trouble. We will misty likely be traveling in an RV. I carry my firearms in CA the same way I carry them in every state, territory and possession of the Republic. Locked, cocked and ready to rock. Otherwise, they're just expensive clubs and paperweights. It's outside CA's lawful Subject Matter Jurisdiction. The Constitution of the U.S. says we don't need any government officer's permission to exercise our rights because they are ENJOINED by the "supreme law of the Land," to which they've all sworn Oaths of Fidelity in some form, from infringing or, even abridging, upon them in any way, no matter how small the intrusion. All this, "core right," "compelling governmental interest," and "public safety" crap is just that, judicially made up crap with NO LAWFUL BASIS in our organic, foundational, supreme Laws.

You “SAY” it’s “Outside CA’s lawful Subject Matter Jurisdiction”.... and I may agree with you... but then all of sudden you get pulled over with your “Locked, Cocked and ready to rock” pistol... and they arrest you. You and I both may agree that State of California is in the wrong but guess what... you may now have a felony on your record and for me... I just can’t afford to do that. And with a felony, you can no longer own any firearms. But more power to you. Again... I hate these stupid California do nothing gun laws.... but I also don’t want to be a felon either.

Councelor, I wish you would do video on transporting in California with a ccw...because I've heard a lot of different things concerning leaving a ccw firearm in your car in types of lock boxes cable afixed...bolted..., 'quick access/release boxes', on body carry...off body carry...Leaving the State lines...reentering state lines...Californians in posession of out of State Non-Resident ccw's as well....California county to county differences...

What if your home is physically within 1000 feet of a school? Can you still use a firearm for self defense inside that home?

[I'm not a lawyer, this is not legal advice] Yes, in both your home and your fenced yard. Most front yards & driveways aren't fenced, you cannot carry in those places without a CCW permit. Carrying a concealed weapon is legal in your home, most campsites,* business or other private, not publicly accessible (with permission) places. Just don't accidentally walk out the front door with it. If you do, and it's concealed, would anyone notice? But You could be charged with 3 separate crimes. They will become felonies if it's not registered to you. *(Campsite means campsite, not the general campgrounds. In an RV, in a campsite, it is okay, in an RV pulled over on the side of the road, probably not. Other restrictions apply.)

Keep it simple... Keep all ammo,in or out of the magazine separate from the gun... Keep the gun in a locked box, as far away from the driver and passengers as possible. If the car has a trunk , that's where it should be,if the truck bed has a tool box,or locking she'll, that's where it should be. If not,put it behind the passenger seat,or if an extended cab ,on the passenger side under or behind the passenger side seat. So as far as you can get it away from you and passengers.

There never was a problem carrying ammunition in the magazines in my unlocked range bag. I'm wondering whether there's been any restrictions placed on traveling with loaded magazines which are accessible in California. Thanks for going through the transport laws. Very helpful.

If you have a shotgun with those she'll loops on it. If it's holding shells it's attached to the shotgun and considered loaded.

All these sub definitions of a fire arm are nuts at a point, glad we got this guy to help clear things up. One that has me for some time is at what point does a rifle become a firearm..ok say I have it in back seat yet Bolt is in glove box or other locked container? Or for that matter any vital part?

A few years ago at a shot show in Rahauges in Chino, CA, a couple were selling locked containers for handguns. The locked container, they said, could be placed right beside your leg near the console. You would have to drill it in place in your vehicle. They claimed that you could carry your handgun in the locked container at all times and therefore have access to it should you need it. That would be a problem if you don't have a CCW. But to prevent any problems with LEOs, they provided a list of gun ranges and their hours of operation. If you got pulled over you could say that you were going to one of several gun ranges, some of which were open 24 hours provided you had special access via a key or an arrangement made with the owners. I was tempted to get one but I felt something was wrong with that set up. Thanks for clearing up this issue because I was nervous about transporting my guns and ammo even if what I was doing was legal. I have the unfortunate luck of living at the edge in one of the worst counties in CA, the same one that's on your cap. It's ironic because I live a few miles away from Orange County and San Berdoo County. Forgot to add that the container was a quick-access type that you could also carry around. The sellers stressed that the container was very convenient. I still haven't seen one nicer and it wasn't just one of those crude boxes. It was well designed and it looked anything but a gun container.

@@handynothandsome261 right you are! I’m my partially disabled mother’s caregiver and we had an incident 2 years where I almost shot 3 of four ghetto thugs. I applied for a CCW before that incident and two others a year after that major incident. I took the required 3-day class and I spent over $300 but was denied a permit. I have a perfect recoded, haven’t had any infraction since like 2003 or before. Getting a CCW also has it’s drawbacks. You’ll be on the radar once you get it and worse, an anti-2A LEO might hold you at gunpoint based on his twisted logic that you’re a threat because you have a CCW. It’s happened several times. But even if this wasn’t a factor, you think I’m going to worry about when and where to carry when I need to protect and defend my life and loved ones? The first sheriff that showed up 15 minutes later (!) after my first major incident complained about why I didn’t engage the ghetto thugs by talking to them. She was more concerned about filling out a report that she hadn’t finished. Our incident was a major inconvenience to her. My mom got an enlarged aneurysm as a result of that incident, and later had open-heart surgery. To all those like her and leftist elites who expect law-abiding citizens to be victims of criminals...🖕🖕

The Southern California of today isn't the one that older people were once familiar with say...50 plus years ago. The L.A. area gradually changed for the worst when Tom Bradley was mayor. He put L.A. on the map as an international city but that's not always a good thing. With that came leftist infestation and democrat plantations throughout greater L.A. The demographics changed drastically. In order to maintain the democrat plantations running efficiently, you need new blood! What better way to do that than declaring L.A. a sanctuary city. It's no coincidence that illegals from all over the world are being handed many things on a silver platter. Most conservatives and pro⎼2A people are inactive and not really willing to do anything to fight back. They're too few compared to the majority in this area. I think it's a lost cause because the L.A. area and probably most of CA is under tight democrat control by powerful leftist elites. Can you carry a pistol/revolver/shotguns in a locked container unloaded in your vehicle at all times? You emphasized AW travel straight to point A to B, but does that apply to other types of firearms?

Yes you can. Restricted stops and school zones are for registered aw. You can transport long guns unloaded, no lock container. CA legal

One of the reasons I left Cali was the anti 2A issues. I now reside in Nevada which is a pro 2A state. So when I visit friends am I able to bring in hand guns/AR’s that are off-roster? Also am I limited to capacity in my magazines and can I bring into Cali my ammunition. I know it’s a lot but you asked for questions. Look forward to your thoughts.

Do you have to follow all of them if you are transporting through california? like if you're coming from California going to Oregon and you cut through California, or some of your state of origin law apply (like with the registration)

I used to be a security guard. My company had a security guard arrested and got 2 years I jail for having 10 rounds in the magazine that was in the trunk and the handgun was in an original gun case with a lock on it. They said that ammo should be in a separate location/compartment of the car from the firearm. So from what I understand is that if a firearms are in the trunk locked, the ammo is in the car itself (not trunk) even if a gun has separate lock on it or it's compartment.

very informative, thanx, i was one who was under the misconception that you could not have ammo in your locked case... personally i keep both locked in separate locked containers. ok 2 questions one my vehicle has a storage compartment that does not lock, if i were to put a lock on the lid to fasten a push lock to would that be considered ok? and 2 what about transporting your firearms to an area for hunting and camping for protection from dangerous animals?

does a console vault that is bolted to the vehicle but is within the center console count. Specifically if that container has four walls ie. it doesn’t use the center console itself as the “walls” but slides into the console.

Also, if you are traveling interstate through California from, say, from Arizona, up through California, and on your way to Washington State, you are also protected under the McClure-Volkmer/Firearms Owners Protection Act of 1986 from local prosecution.

Love this video. Really clears things up. That being said, I would like to put some emphasis on the "grey areas" in California law that you mentioned. Referring to these as "grey areas" is dangerous and misleading and part of why we as Californians are as oppressed as we are, though I know that was not your goal. These should be referred to as exactly what they are; purposefully crafted inconsistencies built into law so that corrupt California politicians and judges can selectively apply these laws to us peasants, but make their peers immune. They right the laws this way to subvert Article 1 / Section 7(b) of the California State Constitution. This is ironic to some degree because they BLATANTLY ignore that section while granting LEOs, politicians, and their families rights and privileges that We The Peasants are not allowed. For example, normal new fucking handguns in common use around the entire country by non-LEOs!

Just incase I get stopped while transporting my gun lol Also just to be clear, I can transport my gun and loaded magazine in a locked container but does it have to be in a specific area in my car? To be safe, you're best bet is to take out the mag, unload it, throw the bullets out of the window, completely disassemble the firearm, encase each part in a block of concrete, and put said blocks of concrete in the trunk.

When does "CA Fish & Game Code § 2006" apply? It states that a rifle or a shotgun is only loaded when there is a live round in the firing chamber but not when the only cartridges or shells are in the magazine.

Does a StopBox with a cable lock to the bottom of the seat qualify? The only “lock” on the stopbox is the thumb and 4 finger depressive tabs on the exterior of the case. Also am I allowed to lock my gun in a locked container and leave it in my car? Thanks!

Im visiting California this weekend. Im wondering whether a shotgun can be transported within Los Angeles County openly or in locked container within my vehicle. I read one website that stated a destination requirement such as from home to gun range and back without unnecessary stops in a requirement for pistols thereby rendering only non AW long guns as thr only option to transport firearms within a vehicle freely without a destination requirement (just in case scenario). Is this correct?

I transport my rifles as 2 pieces, upper and lower in a locked pelican box. This way I can keep the ammo in the case as well. Hand guns are in locked pelican cases separate from ammo.

Standard rifles or any long gun unloaded need not be in locked container nor ammo. Handguns may travel in locked container with as much ammo as you want as long as it's not attached to firearm

I remember The Daily Shooter made a video regarding transporting firearms, but he made it clear that he's wasn't a lawyer, so just to be safe. I never loaded my mags nor store it near any firearm I bring to the range. I'm glad you clarified a few things and rather trust a guy with a BAR lic. for this matter. My question is, I'm aware of transporting Handguns and registered AWB from A to B such as from your Home to FFL dealer and or the range. But what about temporary residences such as hotel/motel or timeshares? Sometimes I do travel....any thoughts would be appreciated. Thanks man.

Handguns do not have point A to B restrictions. Unless of course point B is a school of other firearm restrictive location. At Airbnbs, hotels and campsites or other temporary dwellings it is permitted to have a unlocked LOADED legal firearm of any kind or carry it openly or concealed

Quick question. I have a lock box where I carry my kimber 1911 in. So obviously it requires a key to open the box and obviously it's considered a locked container. I carry it with the pistol and two 9 round magazines loaded, obviously not inserted in the gun, but all in the same lock box. Now my question is... do I still have to put that lock box with my firearm in the trunk? Or can I just throw that lock box in the back seat or wherever in my car since it's already in a locked container?

What if I have one of those bedside FOB or pin lock "handgun safes"? The type you get at Costco or similar outlets. Can I keep it in the utility compartment under my middle seat? Would this be legal?

One thing I have not heard is transportation regarding lowers. When you go to your LGS and pick up an Aero or Anderson lower, sometimes they are boxed or even in the blister pack (my last two lowers I bought in CA last year were purchased this way). Usually there is no trigger or barrel installed, yet this is defined as a firearm. Do these have to be locked up under these rules or follow the guidelines of the transportation of a rifle? Also I assume non residents visiting must follow these rules.

For clarification, if my 12 guage shotgun has a side saddle with rounds in it, it is considered loaded? Or if I have a sling hooked on it with rounds in it, it is considered loaded because it is technically attached to the firearm? But if I unhook the sling it would be considered unloaded?
