Today we visit Asda Distribution at Magna Park in Lutterworth.
The security staff seem to think that they can stop us filming from the outside looking in.
Eventually he was educated and all ended peacefully.

If you are OUTSIDE the premises then you can video what you want

If you are INSIDE the premises you can video what you want. Fair do; the landowner can use reasonable force to remove you. But he can’t stop you recording.

In the first few seconds you videoed a sign the clearly stated that you were on private land. The guy that drove up stated quite clearly that beyond the yellow line the land was Asda's and private property. The land outside that boundary belonged to Magna Park and was also private property. Beyond the main roundabout unless you had business specifically on Magna Park you were trespassing. I often watch DJ Audits and I don't recall the channel to have been in the wrong previously. This time you definitely were!! Sad but true.

@@andrrwprice7281 so what if he WAS trespassing? It’s a civil matter. Let them sue. You can only sue for a quantum amount. What is their loss? They can use reasonable force to remove you though.

@@andrrwprice7281 , the sign referred to private roads and the speed limit which applied to those roads, not private land. As the roads are on private property I would assume that the speed limits would not be enforceable by Police and so the owners can request that drivers comply with unofficial signs.

The guy with the beard seemed a decent bloke, respectful, identified himself straight away, happy to be corrected if he was wrong, and just wanted to cover his own ass with his bosses that are probably sending him out there... Fair play to him... well informed... great job.

Top marks to the bearded security guard that turned up, was cordial in his approach and was willing to listen and take the information provided and pass it on so others would know for future reference. Credit where's credit due sir, keep up the good work ;-)

Yeah he was spot on, actually might make a better police officer than many I've seen. He even remembered to let a member of the public know he was being filmed. The police virtually never do that!

These security guards are all Ex Gurkha regiment, sound loyal guys who fought for us all! They followed the orders they are given so won't know public photography laws! Used to deliver to that depot regularly so know how sound they are.

You have to respect the ex Gurkhas even though they may be doing security. Most have served 18-22 years in the British army. For that they will always have my respect.

I have heard a few stories about the Gurkhas from mates who have served. One was on guard duty at a base that had some Gurkhas temporary stationed there. The first night he felt something lightly touch his foot, looked down and saw nothing. Next night the same. After it happening a third time he reported it his Lieutenant who told him not to worry it was just a Gurkha out doing their thing looking for enemies. They do this by checking to make sure your shoelaces were laced correctly.

There is no doubt this is the best team of security staff I have ever seen. No one expects everyone to know everything but staying calm and being polite makes people look great. I bet that is a happy place to work ….respect given.

Its not the companies. Its the SIA training. They dont train about photography in public and barely mention trespassing laws. The training companies literally take people by the hand through the course. Its a scam.

@@paulkirton8945 I have served along side them. They are a fine body of men who have my upmost respect. How many here would leave their family and friends to go and swear allegiance to a foreign monarch and fight and possibly die far from your loved ones. 99% of the haters here have not the minerals to take the Queens shilling, but will sit at a distance and be a keyboard warrior. These men ARE warriors.

​​@@markhughes9092. . That's the whole point. 'Officials' subjectively apply their own interpretation and thoughts (like areas where there is no signage). When this is reversed and a subjective criticism is made, the official's defence is to call it: insulting; derogatory; rude and objectionable. The Police try and stop this by using the Public Order legislation. So the public can have no criticism and the 'authoiries' have every right even if they do not comply with the law, by-laws, policies and guide-lines. . . .this doesn't affect the majority of people, but when it does go wrong the unsuspecting general public pay the price: physically; financially and occasionally get killed. Are we supposed to thank Wayne Couzins for the failings of accountability now? 😮

Baldy Beardy was excellent! Proper good attitude, proper respectful and human interaction, credit to his job, love him. Asda security boss man … frustrated copper, just can’t help give unnecessary advice, needs to go into town to check old dears are safe doing their shopping I didn’t catch first guard name, love his passion, but he did make me chuckle 🤭 😂- its not China, mate, just chill a bit ☺️

@@jackangus4530 yeah just look around you, open your eyes and maybe you will gain the knowledge or get the answer...we tend to do these jobs because we do not have criminal records, we can be drug tested and all of our paperwork checks out fine. What I did now was try to mock you with that generalisation that all of us are like that. This is just like the generalisation that all security guards n so on n so forth....

Also SF is open to everyone from all of the Armed Forces, if they put their request in to try selection then if they are at a standard that the C.O agrees with then they attend. Never done a survey of all Ethnicity that's been successful on selection 🤔

That went well, without any tears or jumping up and down by their staff or external security. They acted professionally throughout. I do like your latest videos with the drone going overhead though, as that adds another dimension to the videos and sets some people ballistic. I might even buy one of those drones, but not to do what you are doing or to do anything illegal (Not that you are!) My daughter surveys domestic properties and climbs up large ladders sometimes, and so the drone you use in later videos will help her job role enormously.

Someone may of told you, in a previous comment. The winch is used to lower the light stand, from vertical, to horizontal, to replace faulty light fittings, instead of having to use a Cherry Picker, and work at heights. Another excellent video, Stay safe

I used to work here, as a driver for 18 years, and over the road at the chilled depot. Most of the security are ex-army Gurkhas. The nicest, most polite of any security personnel I have ever come across. Mess with them at your peril!

@@CrazedFandango , I know a bloke who flogged 5 members of the Police ( Victoria, Australia ) when he was 15 years old, and then gave the public order squad a tune-up when they came to his home to get revenge. They probably thought that he was nothing special until they were being placed into the Ambulance. I also met an Army officer at Raffles Hotel many years ago who was in charge of some Gurkha soldiers and from what he said i would not be in a hurry to annoy them.

That is a telescopic sectional mast and the winch is to lower it if needed in, say, severe winds. Good fun on this audit with the guard. Stay safe guys.

Public Order Act 1936 Section 9 (1) "Private premises” means premises to which the public have access (whether on payment or otherwise) only by permission of the owner, occupier, or lessee of the premises; This is the one that many people forget. Even though some places have public access, If they are privately owned, the 'owner' can state terms of the access by the entrance to the 'private' place. This would be more relevant to a shopping mall for instance. They are within their rights to ask you to leave even though you have implied access.

Again this is the issue that can impact on auditors. As soon as you enter onto private land any access granted to the public is an implied access right. If the owner/occupiers of the property (or in this case their authorised agents) object to you recording on their property and you refuse to comply they can revoke your implied right of access. In those circumstances the provisions of Section 33 of the 1972 Criminal Justice act do not apply. If the owner/occupier or authorised agent has removed your implied right of access, then it immediately ceases to be a ‘public place’ Crucially in this case none of the security staff actually revoked your implied right of access though one of the guards did make a suggestion about all the roads on that estate being private property. Had they done so you would have been obliged to leave the area.

Roads vs paths and the estate makes no signage referencing permissive pathway restrictions. Have they restricted access on an annual basis over the last 20 years? Chances are No, as they have no effective means to do it. So likely now there is an implied right of access set through precedence. And as usual, no signage saying something like "private land, no photography"

Security guard with the beard was open to discussion and able to adjust his approach, professional and polite. Doing his job to a good standard, great to see. I work with the public in a security capacity so I'm happy to see security staff being friendly. You can come film me whenever you like.

If a public notice for an application to build or add a building on a site or location the notice is placed in a public location accessible to the public ...it can not be hidden or placed in a location not accessible to public it is not acceptable . If it is incorrectly placed it will affect the application in fact delaying it . If this is so the notice must be reposted in a public place and the application period is recommenced from the start

If you are on private property to which the public have an implied access, then they can record you. Their land, their rules apply.

@@Aidankiwi however, the film they collect is subject to GDPR, as they're an institution. Generally they should put up signs making you aware you're being recorded as they are becoming data handlers. Private individuals, on the other hand, are not subject to GDPR.

If it is a private estate (think you said that at the start) with only implied access rights you actually should leave when asked. The whole estate is not a public area and the roads along with pavements are all unadopted and privately funded. Correct or not?

First security guard was from China, his home country has that kind rules, there you cannot take photo of person without consent and if person say delete photo you have to do it. If you do not do it its prison time. They forgot that is not law outside of China, when they travelling or live other countries.
