When renting an apartment we always tell them we won't be able to secure an aval, and ask if we can supply a recommendation from our last landlord. So far, so good.

Not sure about other States, but in Jalisco an aval can also be avoided by using a contract that assigns the “Instituto Justicia Alternativa” to serve as the arbitrator if issues arise during a lease. As far as I know, this is to avoid the long and unnecessarily arduous process of using the civil courts. Basically it helps protect the landlord from being screwed over.

I am glad you addressed this topic because it is interesting and informative. In my case, when we moved to Mexico because of my wife being a Mexican we have relatives who we could have asked to be our "aval", but we did not want to ask that kind of favor and also because, at least in the city we live in, it is required for the "aval" to have a property which it is presented as guarantee. I believe in each state the requirements are different or have some similarities. My experience with many foreigners moving here, they think this is some kind of scam, they do not understand how difficult it is to collect a rent owed debt for a landlord.

Essentially a co-signer. I would rather pay half of the total lease up front, if it were an option, than throwing away cash on fees for unnecessary insurance. That and don’t let emotions get in the way of living accommodations. Always have walking away an option. I did co-sign for my daughter for a 1 year lease. She decided she had to bail on it, (for very good reasons too), so I put on my legal hat and went to bat as I was not going to cover a years worth of rent or force her to stay in a bad situation. I learned a lot about tenancy laws but it was only a different province in Canada, not a different country operating in a different language. I found a loop hole that the managers failed to close and got out of it with some very heated phone calls and never had to involve lawyers. I couldn’t imagine getting into that in Mexico.

Can you do a video on mexican car insurance and maybe recommend a company we can contact and apply online for the policy? Thank You for all the informative videos you put out. They have helped us alot and we always check with you when we need to know something . We have just become temporary Mexican residents through the expired visa program, have been able to import our car through the chocolate car program so all is good. We have been living here in Mexico since 2014 and just love our life down here. Viva Mexico

My wife and I rented a house in Zapopan Centro. My wife has relatives who agreed to be our aval. Also we agreed to pay the year in advance. Which gave pease of mind to sister-in-law. Paying in advance gave us a good discount. Might mention that when renting you might have to go to a closing meeting where there is a Judge to preside over the transaction. More $$$$ to pay out of pocket. All is good. We really like living here. There is a lot to do, and shopping is all walking distance. Malls, and hyper grocery store short trip in car. I rented an Airbnb in Mexico City for six months, and as that term was coming to an end I asked the owner if she was willing to rent to me as an ordinary tenant. She agreed and I’m getting a good deal for 5700 MXN a month

Hey Paul. Have been watching your videos for over a year now and they are incredibly valuable. I bought your Consumer Protection Law cards and I have 'Liked' all of your videos. I purchased a property in Mexico which will not yet be completed until early next year. I am planning on completing my residency (Canje) in August 2023. At that time, the lease on my rental house in the US will have expired and I will not have a US address. I do plan on getting an iPostal1 remote address. Should I be concerned that not having a residence in the US will prevent me from obtaining my residency? I know how busy your channel has become, so a simple yes or no will suffice. Thanks for all that you do.

Very informative Paul, and helpful. I pers do not co sign for anyone even here in Toronto - never have and never will. I've seen people reneg with no hesitation leaving cosigner responsible for debt. It's always important as a renter to keep your rental unit in excellent condition, keep an excellent relationship w your neighbours and property mgmt. I can see where notarized letters of reference from current and previous landlords would be acceptable to Mexican property owners for LTR.

A great Fiscal Tip, the easiest way is the insurance method, but you really have to calculate your rental timeline. I see these types of Aval insurance contracts becoming very common.

Once again an awesomely interesting and useful video Paul ! And a topic i knew nothing about but a topic which is super important to those of us thinking to relocate to Mexico. One tiny point: I see that Liberty Fianzas is part of the US Conglomerate Liberty Mutual which one of the 100 largest companies in the USA. That US-connection makes me more comfortable in dealing with Liberty Fianzas although, naturally, others might have a different perspective. I just wonder if they keep an emú in their offices

i've used the Homie app to get around needed an aval or large security deposit. in my case using it in Mexico City and surrounding areas have shown a great range of LTR's, however, it seems other cities i've searched don't seem to many properties (if any) to select from. definitely recommend it for folks looking for LTRs in Mexico.

Great video as always. Besides the "fianza" there is another kind of insurance known as "Póliza Jurídica" which is most commonly paid by the interested tenant. This last one, can go from 35% to 45% of one month's rent and it is also paid once a year. While paying in advance several months could be an option to avoid contracting either one, it is going to depend on the landlord's flexibility.

Keep in mind that most property management companies do not have a formal and sufficient power of attorney to represent the landlord, thus a lease agreement signed without the POA then that lease is null and void. A common and often malicious practice by landlords is not issuing a receipt for the first and last and or security deposit; the Civil Code demands, concerning rentals, that the Landlord issues receipts to tenants. Lastly, many agreements tendered by landlords contain illegal clauses whereby the tenant waives rights to several rights, keep this in mind, most Civil Codes prohibit the waiver of rights by a tenant, and even if the tenant agrees to that, a Judge will consider it null and void.

First time not renewing my rental lease this is last last month i pay rent . Basically just speak to the rental person. I didn't have an Aval. I just paid fianza de arredamiento that's it .

Thank you! Two questions. You imply, though don’t outright say, that the aval needs to be located in Mexico. Is that right? Also, any concern about paying out the entire term of the contract up front to avoid all this?

Often landlords require the aval to be in the same city as the rental and to own property there.

Absolutely on point, just say no. Many of those insurance companies are kind of shakeyyyy organizations. Better to have money on account ( retainer) with a good lawyer and have your lawyer sign. This also helps keep your lawyer motivated

Hi Paul, We would love to hear from you about rental payments in Mexico. Things like, my landlord will only take cash or my landlord wants only USD or my lease agreement is only in English. Many Americans rent out casitas or other parts of their property and want only cash in USD or the equivalent in pesos. What say you?

Are there any services where a professional trustee or other fiduciary holds the entire year's funds and pays it out as it becomes due? That's what I would prefer as a tenant, and I'm sure that would work for landlords too.

Paul you are the greatest!! I am interested in living on lake Atitlan Guatemala, maybe San Pedro or San Marcos or Santiago... a few blocks from the water. Do you know anything about these places? Is Guatemala or El Salvador or Nicaragua bad options, compared to MX?

I usually use the Mexican version of Trovit to find rentals. There are a few listed in Tecate on the site, but not many: casas.trovit.com.mx/

Fortunately, in Ecuador, if you're a gringo, the dueños will just ask for a one-month security deposit. In order for the lease to be legal (renters have a lot of rights here), the owner and the renter have to go to a notaría (notarías are similar to abogados here) so that the lease can be legally registered, which is about $30.

Rent direct from a decent landlord and this can be avoided. First,last and attorney to draw up the the contract agreeable to both parties. The End. Oh...avoid realtors. It's better.

@@qroo And one more small point: usually family members act as the aval. This is a type of social control. For los gringos wanting to be an aval (and only do this if you've known the person for years and years), it could help to say you're 'cousins'.
