People could be forgiven for thinking the saga of Baby Reindeer would have petered out by now, but as Netflix’s side of the story continues to unravel, a legal firestorm has slowly coalesced in the State of California. Fiona Harvey’s US lawyer Richard Roth catches up with Piers Morgan to discuss their lawsuit against the streaming giant.
Roth discusses where the company may have gone wrong and also defends the eye-watering sum of $170m that they’re asking for, reminding viewers that as his client sits at home afraid to go out for groceries, Richard Gadd and Jessica Gunning continue their North American publicity tour.

@melissafrancis-brown: What matters most is truth, not how worthy a person is. This legal situation highlights the importance of integrity, and fairness or truthfulness, even when the person is repulsive. Netflix could have avoided all of this by stating, "Based on a true story," or, "Inspired by a true story." But Netflix didn't. One is not allowed to lie because the character is, Hitler. The fact that Fiona is an unsympathetic "victim," does not justify abandoning principles. Melissa, let principles be your guide for behavior, not sentiment.

She might not have been jailed but she absolutely IS a stalker and she absolutely IS unhinged not to mention the fact that she was so easily found based on her behaviour shown in the series and she publicly outed herself so for her to be rewarded for such malicious behaviour towards everyone she comes into contact with is outrageous - she is not a victim.

I saw the interview before I watched part of the show. If she hadn’t gone on Piers, I don’t think I would have watched the series. Now I’ve watched her interview multiple times, and I haven’t finished Baby Reindeer. Her behavior is so bizarre, it’s specifically what I am fascinated and horrified about. Aside from that, this show is clearly not a documentary.

It’s crazy she is now playing the victim. After the hell she put that poor lady through and her family. Who already had a lot to deal with as their child is severely disabled. And this awful woman made her life hell!! I have NO sympathy for this woman. I’m glad she’s scared to leave the house. Now she finally knows how it feels!

Yes! And that poor lady Fiona tortured for years said in her Piers interview that if Fiona wins any money from Netflix, she'll sue her. AND I hope she follows through on that because she's the only one who deserves compensation. Fiona put her through a stalking nightmare for 5 years !!! The families and wrongly convicted person can only sue the police department, county or state prosecutor, prison, parole board, basically they are limited to the criminal justice system -- all government entities who exist to serve the public good. Netflix is a for-profit corporation with huge money bags that Fiona Harvey can tap into if she proves her case. Netflix has made a ton of money off of this story, fictionalized or not. The police and prosecutor do not have any personal gain or wealth acquired no matter how many people they convict. Also, they are funded by taxpayers, not subscribers, so any enormous lawsuit claim does not come out of their pockets but ours, the taxpayers who support them.

Why do people make up stuff rather than just state the facts? Gadd and Laura Wray both said that they never reported Fiona to the police. That means they never pressed charges, your comment is false. Convicted or not, she was a stalker. Stalking is not ok & can be upsetting and distressing for anyone who has experienced it, so she is going to make $175 million dollars of stalking someone. No one was concerned about her mental welbeing back then, so why are Piers and the lawyer concerned about it now, when there is money and publicity to be made on the back of this dramatisation of Richards Gadds life during that period.

It will all come out in discovery. Once they have all the evidence she actually did at least 50% of what is claimed, she will be forced to drop the case, or Netflix will settle for way less than she’s asking. I don’t personally think she has a case, and she will lose if this goes to court and they start calling witnesses like Laura, Richard, and anyone around them she harassed.

Agreed, and to the two commenters before me, the information provided by both Gadd and Laura, as well as the complete absence of defence on any of the claims aside from charges being made, are very good indications that she's probably guilty. She just wasn't charged, but given the fact that she's been unable to hold a job because of her crappy personality I don't see how she should ethically or legally make any money off of this. Even her behaviour recently showed she is dishonest and has narcissistic tendancies, it doesn't look good for her and honestly given enough time watching her, she wouldn't have needed Netflix to blow her up if she happened to be found instead starring in a viral KZfaq video. Karen's have their life ruined regularly, she's just been fortunate to remain undiscovered this long.

The convicted bits in the sgow make up maybe two or three minutes of a six part drama. Take them out and the story remains the same, and the stalker and her behaviour still extremely awful.

@whatwas, this is a defamation case. It's irrelevant whether someone was "unhinged" or not. The question is whether Netflix defamed Harvey by portraying her in an identifiable way, and whether they wrongfully represented her as having criminal convictions and serving prison sentences. It's not a criminal trial, it's a civil one; her mental status is therefore irrelevant.

Definition of story.. noun 1) an account of imaginary or real people and events told for entertainment. "an adventure story" Similar: tale, narrative, account, recital, anecdote, chronicle, history, yarn, spiel 2) an account of past events in someone's life or in the development of something. True story is a story, the facts were changed but is reflected in the final roll by Netflix at the end of the film where they state some things were changed. This is all hype and money making and Fiona came out herself to confirm what some were saying, and voluntarily made herself a victim. Had she kept silent, doubt anyone would have known, and could not have damaged her reputation as seems she made herself her own. The lawyer has admitted there's money to be made, from this situation. All so disgusting. Stalking is horrific, and yet everyone who wants fame and money are exploiting the whole message the film was meant to highlight. Stalking happens and any victim would be upset that now people are putting more emphasis on making money off the backs of those who suffered.

She doesn’t work and somehow is surviving. And that basic check doesn’t include any time spent in an institution. She was adamant that she never went to jail. That doesn’t mean she didn’t spend time in an institution. I’m not sure about the UK, but in Canada, you’re provided a living allowance if doctors have proved you incapable due to mental illness. Maybe that’s the puzzle piece left out by that “basic CVS”.

How about a more comprehensive background search? The lawyers only released a basic background check on Fiona, which only includes minor crimes of the last 5 years. Also, the fictional disclaimer is in the closing credits. Fiona has outed herself whilst simultaneously claiming she isn't Martha as a guest on this channel. She sought out the interview, rather than denying her connection and closing her twitter.

I haven't heard this saying but I totally agree with it. I'm a lawyer and I like to think that I'm an honest, ethical one. My clients reflect me to a large extent. I certainly know lawyers who attract clients just like them.

You see, I´ve been working with a bank for decades (risk-, and restructuring management) and I`ve had a lot of court proceedings on behalf of the bank. Both "my" lawyers and I could always tell exactly which lawyer our respective client was hiring. Crook clients had crook lawyers, decent clients had decent lawyers. This could even be applied to my colleagues: sneaky colleagues took the sneaky lawyers from the bank lawyer portfolio and decent colleagues took the straightforward and solution-oriented lawyers. Netflix will be fine because each episode ends clearly stating: "This program is based on real events: however certain characters, names, incidents, locations, and dialogue have been fictionalized for dramatic purposes." It's not a documentary and even documentaries can be editorialized and fictionalized. Netflix has a rigorous vetting process and legal protocol that should end up protecting them here. Also, Gadd never admitted that it was her, Fiona outed herself. Fiona is clearly pressuring Netflix into a settlement. She and her lawyers definitely don't want this to actually go to court because that would mean that she would be exposed as stalking Richard Gadd. Everybody knows she sent him more than a handful of emails. However, if Netflix does settle out of court then that would set an odd precedent and open up a can of worms for them because so many films and shows have done exactly this in the past but people are up in arms about this particular show for whatever reason.

I have an odd feeling that Netflix has a trump card in the form of proof of all of what's alleged. They've been very fervent in their assertion that it's a true story. I wonder if they have an ace up their sleeves. Remember that the DBS check they've publicised is a basic one- all records wiped after 5 years. And if the time spent was actually in an institution, it wouldn't show up on those records.

I cant listen to this. Fiona is guilty as they come and Richard made it clear in multiple interviews that his stalker had NOT gone to jail...but that the rest of the story was true. Fiona doesnt deserve a penny and I bet she revealed herself. Shes an awful person and I dont want to listen to some lawyer defend the horrible stalker.

He only denied that she was imprisoned for her behaviour towards him. Its already been confirmed that he also lied in the series about her being convicted and jailed previously for criminality towards Laura Wray and her family. With that in mind would it be ok to suggest publicly that you yourself are guilty of a sexual assault, multiple physical assaults, stalking of a police officer, multiple convictions, harassment of someone's elderly parents and serving a previous jail sentence with absolutely no proof to back it up? Or is it just ok to do that to Fiona Harvey because she has been portrayed negatively and behaved inappropriately 25 years ago?

They are not suing Gad. They are suing HBO/Netflix claiming the story is true. They could have said based on true story. I agree. It really upsets me how he keeps diminishing Gadd’s experience because he was also a wounded individual. Many people who find themselves in abusive situations are wounded. That doesn’t make their experiences any less valid. It is totally victim shaming, and if Gadd was a woman Piers would have been crucified for this.

I think this lawyer is going to get a little surprise about that, "this story may have fictional elements" disclaimer at the end of each episode that he so blithely dismissed. I would also love to hear his take on the movie and show, "Fargo." From the movie, to as far as I know, every season of the show, the opening credits say, "This is a true story." What's his response to that? Would it be something along the lines of, "oh, well, we all know Fargo is fictional, so that's just a hook they add for fun?" But do we know that, really? The way this guy talks, Fiona has led a life of a proper person and would never have DREAMED of doing some of the things we've been told about. From reports of people FAR more credible than she is, she has stalked and harassed people for years, and now she has the nerve to bring a lawsuit, with a New York lawyer, no less? I wonder how she's going to manage the court costs when she loses.

Yes she has a very strong case. No Netflix technically never said that "this is the real Martha". But Netflix never has to admit she is the real Martha, they gave enough clues that any rational person and access to the the internet could figure it out within a few minutes. Martha has a very very strong case and Netflix will probably settle this case quickly.

The irony. Gadd is tormenting her to tens of millions of people with serious slander pertaining to hate crimes, assaults involving weapons, SA and so on. Even his claims of being abused prior to meeting her have absolutely no merit and didn't make any sense given the context. This Gadd guy has ironically harassed somebody for money and fame and resorted to slander to tens of millions, how he is hailed a hero and not an evil scumbag is absolutely beyond me. I don't know if I'm the only one but I remember watching the show and it CLEARLY saying some parts have been dramatized for our entertainment after I saw that I never took the show word by word the dramatization was obvious to me ! it wasn't a documentary of any sort it was a series . the only part I could understand is them failing to protect her identity but then and again she did make multiples peoples life absolute hell and she refuses to admit that she was behaving like or stalker or sent any texts or emails so she simply isn't to be trusted and were going to need to see her being called out on her lies also .

The whole storyline is true and as it says at the end of the episode for entertainment purposes things have been dramatised and the dramatisation is clear ! Her knocking over tables and bear fighting a woman’s who happens to be a therapist and wants to help Martha is clearly dramatisation so piers shouldn’t focus on it when it comes to legal purposes . In the end it states that it’s dramatised simple as . They need to concentrate on the bigger issue which is Martha being a stalker and ruining lives in the process ! No one gets convicted of stalking these days it means nothing that she wasn’t convicted .

They’ve missed the bullet here, Netflix doesn’t put this is a true story during the beginning of every episode, only the first, I believe the first episode is the only episode that is “true” and the rest is based and fictionalised, that will be how Netflix bypasses it because every other episode will say at the end “this is based on a true story” and they cannot be blamed for those who don’t watch the credits!

I don’t think I’m the only person who could care less whether or not she went to jail as far as my opinion of her or the story. It doesn’t change anything that she wasn’t convicted; other than that when I watched the Netflix show I was sympathetic to her, and now after hearing her speak, I’m not anymore. It didn’t make the way she tortured these people matter any less because she wasn’t charged. The show did a very good job of making you feel for and even care about her. Personally, I think she’s the one who’s making herself look worse… not that it isn’t her right to speak her peace. I just found her far more sympathetic in the show than I do in real life and I don’t think that them saying she went to jail was a factor in anyone’s mind about how appropriate or inappropriate her behavior was. That’s just my two cents.

As far as I’m concerned, the way he portrayed himself gives more credence to his story, not less. Anyone that would be willing to be that vulnerable and reveal the deepest, darkest ugliest parts of themselves is more likely to be telling the truth about someone else, who by the way he portrayed in a sympathetic way.

Assuming the gist of the story is true (which is personally all I find relevant as a viewer), he was so brave and vulnerable in telling his story, and not many people would have owned their contribution to the events, or made their victimizer seem so sympathetic. I was very affected by this story, and would be shocked and angry if I found out the essence of it was fabricated

That lawyer gives off big "ambulance chaser" vibes. Interesting that HBO is the named defendant and not Gadd. Means that they don't really have to prove if she's actually the stalker or if the story is true or not, just that Netflix was negligent somehow. But they're not trying to actually win the case. They saw deep Netflix pockets and decided to try for a fat settlement.

I bet Fiona will refuse to settle, I have a good feeling that she has the evidence to show against Gadd and will go all the way. Check out the interview with the lawyer in the Hollywood Reporter, where he states that they have witnesses available to refute Gadds lies. I hope Fiona sticks with it.

At the end of each episode, in the credits, it says, " This program is based on real events, however certain characters, names, incidents, locations and dialog have been fictionalized for dramatic purposes." Doesn't matter if in the "SHOW" it says it's a true story. There are plenty of shows that say things are true in the show as part of the show. Their disclaimer is clear. Case closed.
