A bar complaint has been filed against Maricopa County Attorney Rachel Mitchell, alleging ethical misconduct. Rachel Mitchell's campaign responded saying that it's a ploy ahead of Tuesday's election. The 46-page complaint was filed Friday by defense attorneys for Nubia Rodriguez, who was charged with negligent homicide in the traffic death of Phoenix officer Paul Rutherford.

I do not care if an incumbent candidate has and R or a D after their name. If they were hiding video evidence to prosecute an innocent person, they should be disqualified, disbarred and then prosecuted themselves.

I see this happening FAR more often with Prosecutors who are Democrats than Republicans, as Democrats always have to go out and show that they are NOT Soft on Crime. Were I that Judge, I would have thrown all three of those prosecutors in jail for 10 days for Contempt of Court to give the State AG time to look at this case and file charges. I hope this Judge dismissed these charges WITH Prejudice, then the DA’s office needs to reimburse Ms. Rodriguez for ALL costs, expenses and lost wages.

Even officers who were witness to the incident and treated the entire event as an accident were convinced to change their story and speak against an innocent. Why are they still receiving a paycheck and not the jail time they tried to force her into?

Exactly. This was a malicious prosecution. There should be people criminally prosecuted for this. They tried to send a person they new was innocent to jail for over a year! That's a far worse crime than many that we have on the books!

DAs lied and withhold evidence all the time because it is a culture of winning a case and not to seek justice.Justice should always e the goal not winning while turning down our justice system by hiding or manufacturing evidence! They knew this woman was innocent and sought to falsly convict her for something she did not do! That is evil as hell and tainted the memory of the officer who died in the tragic accident! Ruined the woman life and turned her children's lives upside down.The woman lost her job as well as a foster child she was in the process of adopting! This corrupt DA needs to be held accountable for her unethical behavior!

I believe that the prosecutors should be charged with malicious prosecution and deprivation of rights under color of law. All parties to this miscarriage of justice should spend time in prison for violating the rights of an innocent person. I hope she sues Maricopa County for millions of dollars. NO IMMUNITY FOR CRIMINAL CONDUCT!

He may have been killed in the line of duty, however, she did not intentionally hit him... he ran out in front of her car. She should not have been charged. It was an accident. Now, they have compounded this horrible occurrence by ruining this woman's life. Let alone the guilt she already feels for having (accidentally) caused a police officers death.

They're not being prosecuted are they? They are being referred by the woman's lawyers to the state bar but that is not being charged with a crime. They should be charged.

The fact that they specifically withheld the security camera footage from the Grand Jury should merit criminal charges against the County Attorney, the DA, and the prosecuting attorney. Absolutely horrible what they put Mrs. Rodriguez through.

They aren’t obliged to show it to the grand jury but they certainly are obliged to take it into account when deciding if charges are warranted. They had video evidence she was innocent but still attempted to have her jailed,that in my book is corrupt behaviour and all involved should face the courts for their heinous actions.

This type of prosecutorial conduct must be ended. They are supposed to be representatives of the public at large and the rights of people. When a prosecutor has evidence of innocence they should immediately produce it and suspend any further actions towards the accused.

It’s sad that the officer died while performing his duty, our sympathy should lie with his family . But for the state to pursue a prosecution against the car driver in light of the video and other evidence is inexcusable. If they were all aware of all the evidence and still conspired to continue this case , they should not be censured or suspended or whatever jargon they use , they should be fired and prosecuted to the fullest extent of the law .

You mean to tell me that a lawyer lied? And they have evidence? Bar grievance these people for each and every incident and by the way-you can file a bar grievance if you are normal every day Joe and need only to have personal knowledge of the incident. I am not a lawyer but I’m realizing that I know more about law than most bar members. I don’t play one either. Lawyers confuse legal processes with law-two different things altogether.

Turn an innocent woman into a felon because of what, justice you think needs to be served. Neither one is more responsible than the other. It was a tragic accident just an accident no more no less. It looks like everyone involved in the police department and the DA's office can live their lives like they did nothing wrong as that poor woman and her family suffered. They all deserve to be prosecuted of a felony and sent to jail for at least a year (like they pressed for the innocent woman), but I doubt anything will happen. They had evidence that proved her innocence in this matter but withheld it. Disgusting.

I'm a fan David ... I think your reporting is generally spot on and though I haven't watched or read everything in this story the loss syffeted that MsRodriguez and the child she was about to adopt are immeasurable. So that Mitchell claims it's a ploy with such language seems to indicate she's got a big fat potato instead of a heart. Does she think with the charges put forth they have a weak case against her? It definitely seems stronger than the case they tried to put together against Ms Rodriguez

It is sad that our legal system seems to be more interested in convictions than truth and justice. If they don't get a conviction they feel they lost while they should be more focused on the truth. Not convicting an innocent person should be a victory too.

Just think if the top prosecutor is willing to go to these lengths to lock up someone who is clearly innocent just think what lengths they would go to, to lock someone up that they didn't like or didn't share the same beliefs with.

The reason for pushing the criminal case is that under Federal law of Police Officer benefits there is a HUGE difference in the benefits paid out in officers deaths. The officer's family gets a lot more benefits if the death is in the line of duty, a victim of a criminal act. The death needs to occur in the performance of police work. Not just a random occurrence. And the officer can't be negligent in the death causing incident.

There is a Reason Attorneys are times times are held with Contempt. Another Attorney, an Older Woman who represented Nicholas Cruz, gave the Judge, the Families of the Victems, the 17 who perished and the 17 surviving Victems, gave the Middle Finger as well as laughing thru out the Trail. Charges need to brought against her, whether or not it's Disbarred, Censured Contempt.

how about the young lady whos windsheid was caved in by a Vandle and the cops arrested her for DUI and Felony hit and run. Even after they saw the video they still arrested her.

Unfortunately the Attorney and Prosecutors have judicial immunity unless the Defense can prove ethical misconduct and I sure hope they can. They all need to lose their bar license and be sentenced to jail for absolutely ruining Ms. Rodriguez's life and that of the child she had adopted. Justice must prevail here and if found guilty I would be going back to look at other cases with shoddy evidence that these tyrants cooked up to put other innocents in jail. This is absolutely disgusting and appalling behavior.

The Judge was much more remorseful to the cop's family for stating the cop was to blame for the accident than the innocent woman who was falsely accused for more than 3 years and lost a child over it. None of the family members ever stepped up publicly and said this is wrong and begged for the prosecution to stop. This whole case had to be over survivor benefits.

What I don't get is why? It's not like they wanted to "send a strong message to deter others from being in the wrong place at the wrong time when a cop decides to sprint into oncoming traffic". What was the motivation for this, other than sheer meanness?

Insurance. The family got double insurance money for an accident on the job. They get nothing for negligence on the part of the officer. They under estimated how hard this woman would fight. They were desperately hoping she would take the plea bargain to make it go away. But she couldn’t because it included jail time.

The man that ran across the street without looking isn’t getting a payout. If that same man is hit by a woman “driving recklessly “ it’s double the pay out. And accident in the line of duty.
