The plaintiff hired the defendant, a doula, to help prepare for the birth of her first child. The plaintiff says she wanted to save the placenta because she is considered high-risk, but she argues the defendant couldn’t get into the hospital because she didn’t have a negative COVID-19 test, so she’s suing for a refund of the doula services. The defendant says she was never informed about needing the negative test, so she doesn’t think she owes anything.

Doula did herself a disservice with her not-so-bright defense. Makes me wonder if maybe that industry should be regulated by the Board of Nursing.

In California it is regulated. Must pass a certification test, do continuing education. It is not an easy process here. I am a Death Doula and had to have certification also. It is all about support and information. This was a bad Doula. In California Sooo many people take their placentas home to plant a tree. All Placentas are saved in Pathology for 7 days. It is the Law. I just walked down to the lab and picked mine up. I am sorry that they lied to her.

@@honeyvoss1477 It is the person that supports the dying and having their wishes respected. Then as the transition begins I support the family with empathy and information about the stages of dying. We also create rituals and memories to create a deep and moving experience. We have "Death with Dignity" here in California. It is revolutionary in its' concept of death on their own terms.

Doula should have settled out of court. What a way to bring to notice to the world that she might be carrying COVID and is willing to transmit it to newborn babies and new moms.

The fact that she told Doug at the end how the hospital is known to have unnecessary barriers proves that she should have been prepared and reached out to the hospital to see what she'd need for access...

@@popcorn526 the barriers are unnecessary at these hospitals and there’s more serious virus than coronavirus such as, Ebola, Influenza (flu) caused a lot of deaths and HIV. Hepatitis and HIB. Also, I work at a hospital and most infectious diseases are contracted in hospitals because healthcare staff neglects hand washing from patient to patient

Oh please! The defendant putting blame on the hospital is such BS. And those safety protocols in place that she called “barriers” are there to PROTECT babies, moms and medical staff. 😒

I absolutely agree! She should be tested regularly 2 times monthly to assure she will be able to serve her clients on demand. That’s just ridiculous that she said during her testimony that her and her partner don’t walk around with a negative Covid test. Well if you are a professional “ YOU ABSOLUTELY SHOULD BE ABLE TO PROVIDE A NEGATIVE TEST”! How else would you be able to perform your specific work duties. This make no sense at all.

@@Blessed241 for real. Very sad because doulas are really needed and need to be trustworthy. The fact the hospital accepts 14 day tests gives her absolutely no excuse. I feel bad for the mommy because she had to be stressing.

It is simply inexcusable that the doula did not know this requirement ahead of time. She voided their contract with her ignorance that prevented her/her rep from attending the birth. Too bad she skirted her responsibility in it and blamed the hospital in the end. She should have apologized to the Momma instead of passing the buck.

What did she say that doula is not in the medical field but last time I checked, common sense is everyone's profession. You know you going to be around the mother, baby and Dad and you have so many other clients during a pandemic. Why would you not just already have weekly or bi-weekly test done. Not the only Hospital asking for that documentation upon entry.

I agree. I owned a service business that operated in nine states in the US during the early COVID times and each city, county, and state had their own rules. I had to wake up two hours early everyday and go through my list of government websites to make sure that I was up-to-date on everything. All she had to do was call a couple hospitals. It couldn't have taken more than ten minutes.

Wow… the doula took no accountability at all. She’ll blame the hospital, but not acknowledge her not calling ahead of schedule to confirm the hospitals requirements during a pandemic. Feel bad for the mom, glad she had a successful birthing.

When I had my daughter pre-covid the doula made sure to be aware of the hospital rules when I was in labor. It was definitely unacceptable this doula didn't keep up to date on the hospital policy. But good on mama for doing it without that extra support!

It actually not because the first month you technically aren’t pregnant. Week 1 is your period and then next week 2 or 3 is ovulation and the week after implantation. So that month you actually aren’t technically pregnant but that’s how they count it.

@@stephaniehowe0973 By the way drs count it yes 10 months. But technically you do not carry a baby for 10 months. As I said, if you subtract your period, ovulation and implantation then it would not be 10 months. It’s only 10 because they consider your first month from the first day of your last cycle but you aren’t actually pregnant at that point. Are you pregnant before you conceive while on your period? I think not.

WOW!!!! My mother kept all of my siblings' placentas and planted them with native trees here in New Zealand... hearing that the plaintiff wanted to keep it just brought back bittersweet memories.

That does sound like a really cool idea its sad her and her daughter won't be able to do that maybe she can go out and buy a sapling with the money she's getting back and plant that with her daughter.When my husband was a kid my mother in law would get live trees for X-mas and afterwards she planted them in her yard she has around 10 of them in her yard i always thought that was a cool idea.

I'm a bit lost here. What does 'color' have to do with it? I can understand the "experience" part but it seems that the plaintiff is more concerned about the afterbirth not being saved.

I agree. She is a horrible doula and completely in the wrong line of work if she's not gonna care about the birthing mother. A doula is supposed to support, advocate, educate, assist, encourage, protect, etc...A LOT of things she didn't do and appears to not even be capable of. She seems so cold.

@@4everThoughtful there’s a deeper explanation as to why Tiara mentioned a woman of color. To sum it up quickly is that, it has been stated in many cases that women of color have not been taken seriously when it comes down to pain levels and other complications when a woman is giving birth. Also, the death rate is high in Women of color so seeing as though she hired a doula who is a woman of color, she was hoping for a different outcome instead of the traditional hospital birth. Either way, it was inconvenient and expensive hospital birth. I’m happy she and the baby are healthy and that’s all that matters.

And then she kept talking over the judge!! She needs to do better going forward giving birth whether first time of 5th time is always going to be a BIG DEAL

I had my baby girl January 2020, right before the stuff hit the fan so my hospital experience was the usual (i have 3 other children so i know the drill) my heart really goes out to all of the mothers out there who had their babies during this pandemic. My sister gave birth to my niece a few months after my baby girl was born and I didn't even get to go to the hospital and hold her. No visitors were allowed at all.

That's rough. Studies show that babies who are not held by their aunties in the first 24 hours after birth are not likely to suffer any physical or emotional problem because of that. However studies also show that 90% of aunties are likely to complain about it for 30 years or more.

Me at 23, just got off job 1, walking my dog before job 2 and 3, labor starts, call in to both jobs, then driving myself to the hospital where I was alone and didn't have any planned ob there. Real alone.

The Doula should be testing a couple of a month to be safe. The doula made continued excuses until the very end. She was operating under a lot of assumption. She needed to do a her due diligence with every mother.

It is ridiculous that the Defendant did not have a negative Covid test already on her while she works within the hospitals. Covid tests are FREE! How hard is that? The Plaintiff deserves most of her money back. Anyone can look stuff up. This was malpractice by the Defendant. Good judgment Judge M 👏! I feel sad for the Plaintiff not being able to do what she wanted to do with the placenta. 🌳💜

When you're dealing with other people in close quarters, ESPECIALLY during Covid, AND you're about to go to a live birth, and you don't think it's necessary to test negative for Covid, AND you deal with other clients, and you're going into the public...... get tested..... frequently. The doula should get tested often for her own safety and the safety for her clients!

Wow! $1,800 for a doula. 😬 I have had 4 home births, all with midwives & doulas. My 2013, 2016 & 2018 home births were $1,000 total. My November 20, 2021 home birth was $1,500. All home births included midwife & doulas visits/services, delivery, postpartum, everything but an ultrasound. I live in the very rural midwest but $1,800 for a doula seems a lot to me. In the hospital setting here where I live, the doula is considered part of the birthing team and the Covid testing would be exempt here.

A doula isn't giving birth to your baby though. A midwife does all the services that an obstetrician (OB) does. $1,500 for BOTH services or $1,800 for just the doula who can't birth your baby and is solely there for mother's comfort.

@@honeyvoss1477 You aren't understanding what I wrote. How much for OB/midwife services in addition to doula cost? In comparison I spent $300 more for 10 months of medical visits, tests, the delivery and aftercare. A doula can't birth the baby and is there solely for mothers comfort.

The more we rely on other sources to navigate our lives the less we are in touch with ourselves and our own needs. She said she wanted to ask questions about what typicaly happens (What ? no such thing as typical ) at a birth. It's just a trend and not needed. Trust yourself.

As someone who has been ignored in Maternal spaces and didn't have my placenta saved both times I was told it would be.....I get why she paid for this. This is also triggering for me and very hard to watch this episode. 😢 I also don't believe the Doula. I had two of my own in NJ (where I live) but they could cross state lines. I gave birth in February also in NY. But they both knew we needed a negative test and my husband to enter the room.

Saving placenta isn’t normal practice so they don’t do that for women of any color. It doesn’t have Jack to do with your race. My placenta wasn’t saved for 3 children, I’m white. If you don’t ask them to save it they won’t. And there are so many people working in a hospital setting I’m sure it is easy for something to slip through the cracks.

I had my placenta saved for 2 of my children that were born in the hospital because my midwife saved it. @Nanny News & Views states she requested them to save it and they ignored her request after telling her they would save it. And its is a well known issue that women of color are treated the worst during Labor and Delivery.

How someone is treated in a birthing situation is reliant on many factors-race isn't the end all be all. I had my first 2 children as an older teenager and was treated like an uneducated, voiceless baby vessel because I didn't know what to expect, ask or accept. My other two were born in my 30's. By then, I directed my care. I'm black and believe me, if I were rich and/or famous, I would have a much better birthing experience than someone with less money and/or prestige then me- color notwithstanding.

It's a system that assumes we don't have insurance or enough education on the topic to ask the right questions. Or to be heard when we say "something dosen't feel right" If your not aware that this happens that is fine. But I am, so don't be another person who won't listen to us. We are collectively having these experiences all over this country.

I had my oldest at 33 weeks, and people didn't realize this was almost 2 months early b/c we actually are full term at 40 weeks (10 months, not 9) so they were surprised I stated she was premature.

I had my son during COVID and I had a Doula and she was wonderful. She answered the phone whenever I needed her. She was even out of state and help me prepared my birthing plan. There was a lot that she did during my pregnancy and after.

I am a Pediatrician at a hospital nursery in NJ and I can state that all of the rules and regulations related to COVID evolved rapidly and changed frequently. It was my responsibility to stay on top of all of the requirements related to masking, testing, vaccination etc.

I understand taking the placenta and burying it. That's what we do in my culture. Defendant didn't have any good reasoning as to why she didn't get that covid test.

I HATE listening to the in chambers with the judge and her husband. She talks over him all the time . its super rude and annoying to listen to. Irony is she hates when the litigants talk over her. Smh

This case could've gone either way but in the end the plantiff should get something back because the defendant due to not having a negative covid test failed to provide her services.

The Doula seemed to contradict herself when she mentioned that in the past, she and the other contractor had trouble locating testing sites they would allow them to do a walk in. Why would they even be seeking quick Covid testing, unless the same issue had come up in the past?

tbh KZfaq taught me a lot about parenthood I was on youtube 24/7 during my pregnancy and the pediatrician was shocked how much I knew being a first-time mom at 22. The internet has come a long way and I think no one should ever debunk what youtube can teach individuals.

KZfaq birthing vlogs are my favorite! 😍 it's amazing what you can watch and learn from educated professionals for free. I just had a baby 11/20/21 & used the videos from various midwives & doulas to refresh my breathing techniques during labor. It's an invaluable tool 😊

I recommend everyone get a doula! I had my babies at home and our midwife was great, but our doula was the cherry on top. She kept me sane!

I hear you, but give me a bed an an epidural any day. I delivered my first baby-9 lbs 1.5 ozs, 21.5 inches long without any pain relief and a 2nd degree episiotomy...after that I said nope, get me an anesthesiologist lol

Yes NOW, back then the 'rapid' antigen test didn't exist, and it was the full PCR test and it took a couple of days...

My mother, grandmother and my aunts were all the Doulas I needed. They had all the wisdom I needed to birth 4 healthy children. The last 2 being twins.

Shout out to my Doula who was very supportive of me during my entire pregnancy 17 years ago. She got on the bus when I went into labor at 11 at night to help me deliver my daughter. I often think about her. I truly hope her and her family are well💕

I had a doula. The fact that this doula didn’t have her crap together, didn’t see her when labour started at home and wasn’t supporting during the entire labour, and then didn’t get there at all is ABSOLUTELY RIDICULOUS.

Yikes. It isn't 10 months though. We gotta remember a month doesn't have 4 weeks exactly. It is 4.3. That fraction adds up at the end. At 13 weeks, you are 3 months. At 39 weeks you are 9 months. And let's not forget you aren't pregnant week 1 and 2. It isn't until week 3 technically that you are pregnant. Aside from that, I wanted a doula during my pregnancies. Hubby said no. :-( Joke's on him. He served as one. For free 🙃

Pregnancy is governed by the lunar calendar. 7 days in a week. 28 days in a month. That makes it 40 weeks. I have tested positive at 10 days with both of my kids and was definitely considered pregnant...lol

@@mzche1999 yes but the way we calculate pregnancy is by first day of lmp. So by the time a bfp shows up you already passed 2 weeks of waiting for ovulation and then the week after conception. Making you technically already "3 weeks" or "4 weeks" when in reality you are only 1 or 2 weeks. That's amazing you got bfp so soon though. It isn't the same for all of us lol Sometimes what can happen also is that a woman can have irregular periods. That can throw off our whole calendar. Anyway, I still think a woman is pregnant only 9 months, not 10 lol Thank you for the chat. Have a good day and God bless.

@@rafymayrivor9295 I was a high risk patient who saw one of the best perionatologists in the country, both times. I found out at 10days with early pg tests and blood work. She definitely says that pregnancy is 40 weeks based on the lunar calendar. In any event, I have 2 beautiful children. I wish the best to everyone one trying to conceive. It can be hell!

Even if vaccinated, people should still get regular tests because the vax doesn’t keep people from getting and spreading it. The fact that vaccinated people as a whole don’t realize this leads to an assumption of “100% protected” that’s very harmful.

All pregnant experiences are different. Read books 📚 that’s what I did and the books told me just enough to get me through it. I was ready for the 2nd but it was night & day from the 1st.

To all you women out there who are strong and brave enough to endure pregnancy and childbirth, then sacrifice 20+ years of your lives raising kids, I applaud you. I could never do it. I have never desired or wanted children. Thank God I found a man who feels the same. We have been happily childfree for 19 years. The whole process just seems horrific to me. Many women are never the same after they go through that, so no thanks. Blessings to you all🤗!!!

The plaintiff wrong for saying husband and ain’t no ring on her finger. Cmon now! Glad she was able to recover some funds. Invest it for your lil one!

The plaintiff could have just paid herself $1800. The doula was horrible. For the Mom to be told to watch KZfaq videos and receive what was tantamount to a pat on the back, during labor is wild. The Doula was unprofessional and people should steer clear of her and her “partner”.

How is the doula expected to know when she'll go into labor and have a current covid test result on hand? Even if she knew the due date that does not mean the mother will have the baby on that date. The hospital should provide rapid test for situations like this. I saw a video of a father being taken out of the delivery room by security because he did not have a recent test. He missed the birth of his first child for this reason. So why can't the hospital test the person and get it over with.

I don't think it's unreasonable for a doula to be tested every 14 days since they have multiple patients that give birth each month. Taking the test twice a month to be able to enter the birthing unit at any time shouldn't be a big deal. They could even include the cost of covid testing for all the doulas at the agency into the fees that they are charging 🤷🏻‍♀️

Just FYI, hospitals in Australia required anyone coming to the hospital or working at the hospital to have daily covid tests. Not fortnightly! Thats crazy! You can get covid the next day after taking a test
