The plaintiffs say they gave the defendant a deposit for their son’s bar mitzvah, which got canceled through no fault of their own. He won’t return the money, so they’re suing. The defendant says the plaintiffs are trying to back out of the party and using the pandemic as an excuse.

The Judge is right, the pain IS SO REAL from the loss in 2020. Loved ones, important moments, lost memories. I became an Aunt for the first time and I couldn't even go to the hospital to hold my niece. My son graduated 5th grade and he never had a real ceremony or a 5th grade field trip, and thats nothing compared to people who lost loved ones and couldn't even say goodbye... I feel like things are far from normal but getting SLOWLY better at least. I pray for all of us in 2022.

A governor's mandate is NOT a law. A governor cannot tell you that dancing is not permitted.

Yes it is : A 'law' is passed by the senate and the house of representatives and signed by the governor. A 'mandate' is made by the governor, with the power given to them by the legislature in a state of emergency...

16:47 Judge Milian went to law school at Georgetown (#15 of all law schools in US) and her husband (John Schlesinger) at Suffolk University Law School (private school in Boston). Schlesinger is a former assistant United States attorney, who in 2004 was elected to the 11th Judicial Circuit Court for Miami-Dade County, Florida, the same position that Milian held before retiring to The People's Court. They live in Coral Gables, Florida, with their three children. During "normal" times (non-COVID), Milian travels to Stamford, Connecticut, bimonthly for three days of taping of The People's Court.

I feel the judgement was mostly fair, but because he was able to accommodate the celebration somewhat, he should have been able to keep $500--$800 of the deposit. Situations as this one are definitely more difficult to rule on. 🙄

I don’t think this is one of those situations. The venue is either entitled to keep the deposit or the plaintiffs are entitled to get it back; it’s not a situation where some of the agreed-on work is completed or something similar.

I agree there should have been some form of payment to the venue since they had to hold the date for them and considering no where was allowed to hold that type of venue so it’s not like he was gonna get the kinda party he wanted either way. But I also see there frustration in that had they held the party it wasn’t going to be the type of party they booked for

2020 was rough for everyone. I got an eviction notice 2 weeks after lockdown began, while I was living in the house that I bought 17 years prior. Wound up living in hotels with my husband & son during the pandemic, and my son wound up getting sick. It was a hellish year.

This is not a situation where the plaintiff gets most of the deposit back and the venue gets to keep some. You’re either entitled to the deposit back or the other side is entitled to keep it. It’s not a situation where some of the agreed-to work was completed so the defendant gets to keep the value of his work. You can’t just slice & dice the judgment because it’s a hard issue to come down on.

well business owners who lost money becuz the pandemic got relief money if they applied for it and i would bet the defendant got some govt relief money so why should he get to keep the relief money and the plaintiffs money ? so i agree with the ruling . and also businesses got forgivable loans worth tens of thousands and some hundreds of thousands so why not refund these people.

@@marleonetti7 not entirely accurate. Just because you applied for the gov relief money didn’t mean you got it. I know several business owners who struggled through the shutdowns, who applied for relief money, and didn’t get any. Fact: most of the gov relief money went to big companies/chains, not small businesses. Also I think it’s irrelevant about whether he got to keep the relief money and the plaintiffs money or not - all that matters in this case is the contract and the performance/reasons for nonperformance.

This was interesting. I work at an event venue and we were similarly impacted. We, however, already had in our contract that basically if an event couldn't happen through no fault of either party (i.e. act of god, like a Pandemic), then the deposit was forfeit but no other additional fees could be levied and we just allowed them as a courtesy because of the circumstances to re-schedule. We heard a lot of arguments similar to the plaintiff's but in our estimation, given that there were NO possible venues to host the event given the government mandates, we weren't in breach as long as we provided for them once events could be hosted. Given how much of a stickler Judge Milian is for contracts I'm curious why none of that factored in.

I think she ruled the way she did because it would be an unknown amount of time before the venue would be able to host the type of party they were originally contracted for (a party where he could break dance) and, because it was a party to mark a particular milestone, the venue could not guarantee that they could host the type of party they were originally contracted for in a reasonable amount of time from the intended event.

@@shootingcomet082 The thing is everyone in the world has had to compromise except for the 13 year old kid. The venue was able to host his Bar Mitzvah but without the dancing, why couldn't he just accept that like so many others throughout the world have. The kid should consider himself lucky that he was even able to have a party, come to Melbourne Australia, the most locked down city in the world where churches have been forced to close, funerals could only have 10 mourners, weddings were banned, we couldn't even leave our homes unless it was for work, grocery shopping, medical reasons or an hour of exercise.

@@shootingcomet082 oh yeah i get that part but given that NO venue could accommodate that request, i.e. they have no choice but to wait regardless, i don't see how it constitutes a breach on the part of the establishment. It's not like the venue suddenly decided to not host their event and was thus responsible for the date needing to be pushed. They didn't lose anything because the party couldn't happen irrespective of anyone's wishes. That's not to mention that if the dancefloor restriction was anything like the one we had in Chicago it meant not having a dancefloor for people to dance with each other like a club but performing would be permitted if the floor acted as a "stage". So break dancing could certainly happen. I totally get how frustrating it would be for the Plaintiffs but like, what other choice do you have but to wait in the end anyway? Circumstances, at that time especially, call for patience and innovation.

Because of the pandemic, the guy that that couldn't accommodate his customers for their venue because of the pandemic can look into filing an Insurance claim for "LOSS OF USE". I'm wondering if this would work. Unless of course insurance companies have found a way to applying endorsement amending their terms and conditions to apply to the loss-of-use coverage

you pay for what you want. not whats convenient. im sure they work hard for their earnings, so why should they have to lose out because he wanted to reconstruct what they initially paid for. since he runs a business im sure he applied for that PPP loan since he only did 5 parties over the course of this horrible outbreak.

COVID impacted everything. A deposit is never refundable unless there's a clause in the contract. Think how much additional money party venue's lost and then went out of business. It has sucked for everyone.

Her decision is based on the venues original accomodations for the customer. I had this happen BEFORE the pandemic when I booked and paid for a family member's 21st birthday party. We put down a 50% deposit and signed the contract for a 5 hour party with a 1 hour setup time. 9 days before the event, the ownership changed hands and all of a sudden these "new" rules went into effect. We had to pay for security, and the party was cut short 1 hour, not to mention the security didn't like how grown adults were dancing provocatively. We sued them in court and won 25% of the cost and they quickly switched over to a 30+ lounge.

That’s not true I cannot stand when people say deposits are never refundable. So if you pay a deposit let’s say to hold an apartment and then you can’t get ahold of the guy to get the key to move in and you find out he rented to someone else and basically scammed you (which is a real case I’ve watched) that he gets to keep the “non refundable deposit” just bc contract states it’s non refundable? I don’t think so! Under the law deposits ARE refundable if there is a breach of contract.

not to worry, judge. When my mom was in her 80's, i gave her one of those grabby things that's on a 3 ft pole and has a handle on the other end....you know, pick up things from the floor without bending over. She yelled at me that she wasn't OLD and threw it back at me. I've had a GREAT time picking stuff up off the floor without bending over.... ps i heard that OLD is 10 yrs older than your actual age....

I think i would have awarded each £1000. The pandemic was/is a bloody Nightmare. I'm an Ambulance tech in England and have seen so many deaths. Trying to Balance who lost what is hard.

If the law allowed the party, and THEY backed out, the deposit should be forfeit. I'm mostly sure that bar and bat mitzvahs are religious as far as the laws are concerned.

JM was really losing me when she started minimizing the severity of covid and how people stopped seeing their elderly parents and governors state mandated orders ie no dance floors opening. I usually love her style and back her up 100% but when she started swaying a bit and essentially playing devil's advocate, I got a little frustrated with her. I do think the plaintiffs should plan a Birthday party with the defendant for their son at a later time (ie maybe a Sweet 16 at that point)

Maybe, but it is entirely dependent upon the governor if that will happen. No certainty at all. They wanted a dance party, and couldn't have a dance party. Not either of the two litigants' faults. The venue manager should sue the governor for the loss.

Is the use of the defence that a contract was "frustrated" used in The States? I am from the UK and when a contract is "frustrated," the nthat means that it is incapable of being performed. It is not an excuse that is used widely, but it has to be something whic his unforseen. This question might be answered within the video, but I just wanted to write it down before I forget. I would imagine that many contracts (both between individual parties and between corporates) have been frustrated because of all that is going on in the World.

Not really sure about the decision here. However in the end everybody won. The defendant got to keep his deposit and the show reimbursed the plaintiffs.

I'm kind of with the venue guy. He accommodated them within what the government passed as the new law and the new normal. The alternative to the parents isn't a different Bar Mitzvah, it's no Bar Mitzvah. And from the end interview it sounds like the kid got a fraction of what he wanted. A 25% capacity event would have been a hundred times better than a gathering on the front lawn after the service. Poor kid.

That guy was being greedy as fck and totally unreasonable. At first I thot too bad reschedule, so what. Ur not special, everyone had to make changes, but that gov. Stating no dance floor, who would want a party where u can't dance. Weddings, b days, sweet 16, etc. Ridiculous. Jus sayn.

This wasn't tough at all. The plaintiff's 1000 percent should have gotten their money back. Lol at the defendant's joke abt taking this to the Supreme Court 😅

@@mickm6309 no, by law, they get their deposit back. if I charge you a deposit for a cake, and then cake mix goes out of stock because of a shipment issue caused by a natural disaster, i can no longer provide a cake, i can OFFER you another pastry, but thats not the original agreement you paid a deposit, so at that time i would forfeit your deposit because I can not provide you with what you wanted. Period.

You can tell that the defendant did not understand one word of the law as it applied. He could not fulfill the contract as it was defined.

The point of a Bar Mitzvah is to celebrate becoming a "man". A man is someone who is glad to be alive and of service to others, and not upset because he can't break dance at an over $2000 party. The $2K was a deposit, not the entire cost. The plaintiffs should have paid at least a portion of the deposit.

The defendant is a "man" too. He should be glad to be alive and of service to others...and not upset he has to return a $2000 deposit to someone because he can't fulfill the original terms of the agreement.
