Are you allowed to work part time while your Social Security disability case is pending? If so, at what point will part time work hurt your case?
As I discuss, a key number to keep in mind is the dollar figure for what is called "SGA"
("Substantial Gainful Activity")
In 2023, you are presumed to be performing work at "SGA level" if you are earning $1,470 per month. This equates to only $17,640 per year, but SSA seems to think that a person earning $17,640 per year is, by definition, NOT disabled. :-(
So, if you decide to try to work you need to monitor your gross earnings every month.
If you exceed the SGA limit but cannot sustain a job at that level, your work could be considered "unsuccessful" which will actually HELP your case.
What you want to AVOID is a situation where your earnings EXCEED "SGA" for enough time to take you out of unsuccessful work attempt territory before you discover that you actually cannot sustain work.

Thank you Jonathan, this video showed up at the perfect time! I have been receiving SSDI benefits since September of 2020 and at this time I plan to go back to work. Not sure if I can work full-time again and it is amazing to have the information you provided. $1200 a month sounds like a good goal for me as I venture back to a working schedule.

Yes, the figures for SGA or a trial work period month are gross monthly earnings (not net).

Ya your attorney that gave me a free evaluation really was off of what you say here. Plus he only wanted to take a cse that he could win,basically a slam dunk type only. He wasnt interested in hearing or considering my disability issues/ect Basically he stunk. I need an attorney that would help fight for me,not just presenting a no contest case to a social security judge. Wtf

Hello Jonathon. Im 58 years old and I recently had my 2nd ADJ hearing. I believe I will get a favorable decision; the judge had very few questions, most of his questions was regarding the onset date, my onset date was the day after my unfavorable decision after my first hearing, and the vocational witness answered NO to all 3 questions from the judge. My question is if I owe back federal taxes from 10 years ago, would that be deducted from my lump sum/back pay?

I’m nervous about getting denied because I’m only 25 but I have severe depression in addition to Tourette’s and schizophrenia. I work part time to pay for my living expenses but it’s truly difficult for me to work anymore. If it’s not body pain, then I can’t focus. If I can focus, all I can focus on are my body pains. Tourette’s makes life so challenging. I applied in April. Still waiting for a decision.

My representative shared with me a letter to the ALJ after the hearing. He had issues with some of the VE testimony and his data, some of the required job abilities, and also pointed out places in the medical record recorded when asked about dates/doctors and I couldn’t remember. And pointed out things in the record that the judge never asked about. Can you do a video explaining this post hearing “letter to the ALJ”? Thank you

Thanks for the info. Do you have a video like this that pertains to someone who is already on SSDI? I’ve heard attempting to go back to work will trigger a medical review?

The rules for the trial work period are different than the rules for SGA (see 4socialsecuritydisability.com/faq/ssas-confusing-tables-of-numbers/). I'll add this topic to the list.

Jonathan listen I want to ask you a question I got Ovrrpayment from SSI actually I got the billing statement but I never get notice of Ovrrpayment so my question is if there is no notice of Overpayment there is no overpayment?? because Social Security “have” to send me notice of overpayment is that true?? Hello. I am currently on SSDI. I have a question, but its different from the video topic. Will a none injury(discrimination) lawsuit settlement cause me to lose my SSDI benefits and will I have to file a 1099?

Can you do a video about after, and you want to try working. I keep getting offers saying they can work with ssa and it'll only be light easy part time stuff. I'm 56, and already had one med review at 3 yrs. They also claim that if I can do it there will be no more reviews.

Applied for ssi and now gonna go in March 2024 for my consultive exam for dds and ssa to determine if I'm disabled enough to qualify for ssi,I'm about to be 61 in February this year 2024 ,I think mine 700+ but I don't bring home very much its less then 200 twice a month ,ssi is 943. A month for ssi, my q is how much will I get from ssi ? I'm in Texas by the way

I am terrified. I never went over SGA but I may have come close a few times. That looks really bad. How do I explain how I managed to work part time (but not every day) ? I recently got a work history form…a bad sign. Please tell me how to explain the work. My disability is mental.

Can you comment on how being part time self employed affects you if you are applying for disability? I read the rules differ some. I'm not talking about working for Uber though that's a question too. I mean occasionally selling crafts you make, doing a graphic design project, or teaching an art class occassionally. Of course I mean doing this while keeping the income under $800-$900 as you suggest.

Several years ago I was telling my clients that on-going part time work muddied the waters and could hurt your case. Now, with delays approaching 3 years, I think that most judges realize that you may have to pursue part time work - self employed or otherwise - to survive the backlog. I tell my clients to keep a log of what they are doing and difficulties that arise. When they testify I ask them about the part time work and why the part time efforts represent the maximum of what they can do.

How long can a jdge. Just sit on a case after 2 hearings without an answer? And the next step would be the higher court but he won’t budge to say yeah or neh to move to any sort of progress. Mind you that second hearing had to be requested 😮. Started last Winter … it’s almost winter again. This is absolutely just……. It’s gonna take God and the angels to move on this if you ask me!!

Please further elaborate how Volunteering in the Community could hurt someone's Application for Disability or a Recipient who already Receives Disability from keeping it. I have mentioned this before in some of the Facebook Groups I am in that Social Security could Use that against someone but several people don't want to believe this. I told one of them to Check out the other Video you did on this where you Touched on it briefly there too but they don't get it. They don't grasp that Volunteering can affect their Case for Disability either as an Applicant or as a Recipient of the Benefit. Since I last Talked to you I had mentioned I won my Case for SSI which was good but the Amount I got was very low because of other Money I Receive because of my Mom. Because of that it became unsustainable so I had to go to Work Part-Time at Amazon. As a result of me doing that I had my Check Suspended all together but am still Classified as SSI Eligible.

SSA defines "disability" in terms of how your medical problems prevent you from engaging in "substantial gainful activity" Volunteering can be considered substantial activity. If an activity is roughly equivalent to what you might do at a simple, entry-level job then SSA may considered that unpaid activity as SGA.

I do have a question though. I lost my job in August of 2022. In May of 2023 I had my leg amputated Before the amputation I was driving for a app-based business called roadie. I was trying to get government benefits and they consider that income. What they didn't understand was that I did not make much money after I paid for gasoline, insurance and wear-and-tear on the vehicle. Maybe about six to eight dollars an hour. I could use some money right now even a little bit. But how do I explain that to a judge for a social security disability? Thank you for your help.
